Evans, hereinafter referred to as "Grantor", for and in consideration of the sum ofTen ($10) Dollars and other good and valuable consideration in hand paid by Grantee herein, the receipt and sufficiency of which is hereby acknowledged and confessed, have granted, sold and conveyed, and by these presents do grant, sell and convey to the City of Southlake, hereinafter referred to as "Grantee", of Tarrant County, Texas a permanent and perpetual sanitary sewer easement for the purpose of installing, repairing, maintaining, altering, replacing, relocating, and operating a sanitary sewer line in, into, upon, over, across and under that land in Tarrant County, Texas described as follows, to-wit: Being a 15' permanent sanitary sewer easement described as follows: See attached Exhibits for graphic depiction and metes and bounds description together with the rights of ingress and egress. Grantee shall advise the "Grantor", as a matter of courtesy, when it is necessary for Grantee to repair, inspect, service, or relocate the sanitary sewer line. Grantee shall provide two sanitary sewer hook-ups in an area designated by the Grantor or their successors to serve the two houses on the property. The City agrees to waive the participation fee for each hook-up for said houses. The Grantor hereby grants, sells, and conveys to the Grantee a 20-foot temporary construction easement parallel to said permanent sanitary sewer easement for a period of 120 days from the effective date ofthis agreement. Grantee is currently in negotiation with the Grantor to purchase said Evans' entire property located at 315 and 379 North Shady Oaks. If the property is not purchased by the Grantee, then the said permanent sanitary sewer easement shall be purchased by the Grantee in the amount of $11,600.
