KNOW ALL MEN BY THESE PRESENTS:
That I, Lela T. Rodgers, for and in consideration of the sum of Twenty-thousand
Eight-hundred and forty-nine ($20,849) Dollars and other good and valuable consideration
in hand paid by Grantee herein, the receipt and sufficiency of which is hereby
acknowledged and confessed, have granted, sold and conveyed, and by these presents do
grant, sell and convey to the City of South lake, Grantee herein, of Tarrant County, Texas
a permanent and perpetual utility easement for the purpose of installing underground
utilities and repairing, maintaining, altering, replacing, relocating, and operating utilities in,
into, upon, over, across and under that land in Tarrant County, Texas described as
follows, to-wit:
Being a permanent utility easement, described as follows:
See attached Exhibit 'A' for graphic depiction
See attached Exhibit 'B' for metes and bounds description together with the right
of ingress and egress as necessary for such purposes.
TO HAVE AND TO HOLD the above described utility easement, together with all
and singular, the rights and appurtenances thereto, anywise belonging unto the said
Grantee, its successors and assigns forever; and We do hereby certify that We are the
owners of the property described herein and bind ourselves, our heirs and assigns, to
warrant and to forever defend all and singular the premises unto the said Grantee, its
successors and assigns, against every person whomsoever lawfully claiming or to claim
same or any thereof

EXHIBIT 'B'
15' Permanent Utility Easement
Being a 0.399 acre tract of land in the Thomas Mahan Survey, Abstract No. 1049, City of
Southlake, Tarrant County, Texas and being a strip of land, over, through, and across a
tract of land conveyed to Lela T. Rodgers as recorded in Volume 9667, Page 2300
(D.R.T.C.T.), and more particularly described as follows:
BEGINNING at a 5/8" iron rod found for the southeast property comer of said Rodgers
tract and the northeast property comer of Lot 1, Block 1 of the Rodgers Addition as
recorded in Cabinet A, Page 3538 (D.R.T.C.T.), and also being in the west right-of-way
of North Kimball Avenue;
THENCE
N 890 00' 00" W, a distance of 22.02 feet along the south property line of
the Rodgers tract to a point for a comer;
THENCE
N 000 47' 03" W, a distance of 748.02 feet to a point for a comer, said
point being in the north property line of said Rodgers tract and in the south
property line of the Westerra Southlake LP tract as recorded in Volume
12615, Page 339 (D.R.T.C.T.);
THENCE
S 890 34' 46" E, a distance of 22.02 feet along said property line to a point
for a comer, said point being the northeast property comer for said
Rodgers tract, the southeast property comer for said Westerra tract, and
being in the west right-of-way line of North Kimball Avenue;
THENCE
S 000 47' 03" E, a distance of 748.17 feet along the eastern property line
of said Rodgers tract and said right-of-way line to the POINT OF
BEGINNING, containing 0.399 acres or 17,374 square feet of land, more
or less.
