KNOW ALL MEN BY THESE PRESENTS:
That we, Westerra Southlake LP , for and in consideration of the sum ofTen
($10) Dollars and other good and valuable consideration in hand paid by Grantee herein,
the receipt and sufficiency of which is hereby acknowledged and confessed, have granted,
sold and conveyed, and by these presents do grant, sell and convey to the City of
Southlake, Grantee herein, of Tarrant County, Texas a permanent and perpetual easement
for the purpose of installing, repairing, maintaining, altering, replacing, relocating, and
operating utilities in, into, upon, over, across and under that land in Tarrant County,
Texas described as follows, to-wit:
Being a 15' permanent utility easement and temporary construction easement, described
as follows:
See attached Exhibit 'A' for graphic depiction
See attached Exhibit 'B' for metes and bounds description together with the right
of ingress and egress as necessary for such purposes.
TO HAVE AND TO HOLD the above described easement, together with all and
singular, the rights and appurtenances thereto, anywise belonging unto the said Grantee,
its successors and assigns forever; and We do hereby certify that We are the owners of
the property described herein and bind ourselves, our heirs and assigns, to warrant and to
forever defend all and singular the premises unto the said Grantee, its successors and
assigns, against every person whomsoever lawfully claiming or to claim same or any
thereof.

15' PERMANENT UTILITY EASEMENT
Being a 0.362 acre tract of land in the Richard Eads Survey, Abstract No. 481, City of
Southlake, Tarrant County, Texas, and being a portion of a tract conveyed to Westerra
Southlake, LP, as recorded in Volume 7770, Page 1167 (D.R.T.C.T.) and being more
particularly described as follows:
COMMENCING at a PK nail found for the northeast property comer of said Westerra tract,
said point being in the centerline ofE. Highland Street and also being the northeast comer of
said Richard Eads Survey;
THENCE SOlo 02' 15" E, along the east property line of said Westerra tract, for a
distance of22.26 feet to a W' iron pin found in the south right-of-way line of
E. Highland Street, said point also being the POINT OF BEGINNING;
THENCE SOlO 02' 15" E, for a distance of 15.00 feet to a point for a comer, said point
being in the east property line of said Westerra tract;
THENCE S 890 34' 00" W, for a distance of 1051.97 feet to a point for a comer;
THENCE N 000 26' 01" W, for a distance of 15.00 feet to a point for a comer in the
south right-of-way line ofE. Highland Street;
THENCE N 890 34' 00" E, for a distance of 1051.79 feet to the POINT OF
