TEMPORARY CONSTRUCTION EASEMENT

KNOW ALL MEN BY THESE PRESENTS:
That L Art Janes for and in consideration of the sum of Ten ($10) Dollars and other good and valuable
consideration in hand paid by Grantee herein, the receipt and sufficiency of which is hereby acknowledged and
confessed, have granted, sold and conveyed, and by these presents do grant, sell and convey to the City of
Southlake. Grantee herein. of Tarrant County, Texas a permanent and perpetual sewer Easement for the purpose of
installing, repairing. maintaining, altering, replacing, relocating, and operating utilities in, into, upon, across and
under that land in Tarrdllt County. Texas described as follows. to-wit:
Being a Permanent Sewer Line Easement, described as follows:
See attached Exhibit . A' for graphic depiction
See attached Exhibit ' B' for metes and bounds description together with the right of ingress and egress as
necessary for such purposes.
TO HAVE AND TO HOLD the above described easement, together with all and singular, the rights and
appurtenances thereto, anywise belonging unto the said Grantee, its successors and assigns forever; and We do
hereby certify that We are the owners of the property described herein and bind ourselves, our heirs and assigns, to
warrant and to forever defend all and singular the premises unto the said Grantee, its successors and assigns. against
every person whomsoever lawfully claiming or to claim same or any thereof by. through or under grantor, but not
otherwise.
I. The temporary construction easement will expire and be of no further force lO days after the completion of the
construction and installation of the sanitary sewer line.
2. Grantee hereby agrees to repair and restore the Property to its condition as existed prior to the commencement of
installation of utility lines in the easement herein grant, with such repair and restoration work to be completed
promptly following the completion of the installation of such utility line.
:; . Grantee hereby agrees to indemnify and hold Grantor harmless of and from any and all loss, cost, expense.
liability. damages. action or cause of action (including, without limitation, any therefore relating to injury to person
or damage to property) arising from or relating to: (i) the construction and installation of utility lines and related
facilities within the casement herein grantec:l and (ii) the utilization. maintenance and repair of the utility line within
the casement herein granted
4. The easement herein granted is non-exclusive and Grantor retains the right to utilize the property which is
encumbered by the easement herein granted and to grant other easements within the area encumbered by the
easement herein granted so long as such use or other easements do not unreasonably interfere with the rights of the
Grantee hereunder.

Southlake, Tarrant County, Texas and being ~ 15 foot wide strip ofland, over, through, and
across a tract conveyed to Art Janes in Volume 8239, P.297, (D.R.T.C.T.) and being more
particularly described as follows:
Being a 15 foot wide strip of land having a centerline east, a distance of 7.50 feet from the
west property line of said Janes tract and being continuous across the limits of said tract,
containing 0.188 acres or 8,170 square feet ofland.

Sanitary Sewer Easement
Dear Mr. Janes:
I am in receipt of your memo dated July 9, 1999 via fax. The City will
eliminate the "utility" designation from the existing drainage1and utility
easement on' your property and be limited to a drainage or flood easement.
With your cooperation, the City will make best efforts to correct the
drainage problem along Peytonville in front of your property. The City
will also waive the $1300 participation fee. The City would request you to
execute the easement documents for the sake of time since the City has
agreed to your demands in writing. If you have any questions, please call
me at (817) 481-5581 extension 846.
