That TBC CONSTRUCTION INC., GRANTOR herein, for and in consideration of
the sum of Ten ($10.00) Dollars and other good and valuable consideration in hand
paid by the cm OF SOUTH LAKE, home rule municipal corporation of the County of
Tarrant, State of Texas, GRANTEE herein, the receipt and sufficiency of which is hereby
acknowledged and confessed, do hereby grant, sell and convey unto the said GRANTEE
a permanent and perpetual easement for the purpose of installing, repairing,
maintaining, altering, replacing, relocating, rebuilding, removing, and operating water
facilities in, into, upon, over, across, under and through all that land in Tarrant County,
Texas described in:
Exhibit "A" and Exhibit "B" attached hereto and incorporated herein.
together with the right of ingress and egress as necessary for such purposes.
GRANTOR covenants and agrees that GRANTOR and GRANTOR's heirs,
representatives, successors and assigns shall at no time erect, place or construct, or
cause to be erected, placed or constructed in, into, upon, over, across or under any
easements granted herein any temporary or permanent structures, and it is further
agreed that GRANTEE shall have the right to excavate and fill upon said permanent
easement and to remove from said permanent easement, any fences, buildings or other
obstructions as may now be found upon said permanent easement.
It is further intended that the Permanent Water Line Easement herein granted to
the GRANTEE shall run with the land and forever be a right in and to the land belonging
to GRANTOR, and GRANTOR'S successors and assigns, and said grant is expressly
excepted from any right of reversion of said premises under any prior deeds in
GRANTOR's chain of title. The Permanent Water Line Easement, rights and privileges
granted therein are exclusive, and GRANTOR covenants that it will not convey any other
easement or conflicting rights within the area covered by the grant to any other person.
CERTIFICATE OF ACCEPTANCE
This is to certify that the interest and real property conveyed by this dedication
instrument dated the ')0 day of (Vl r ' 2003, from

subject to all terms and conditions contained therein, and the City Council has
consented to recordation of such dedication instrument by its duly authorized officer.

BEING a 20 foot wide strip of land located in the R. F. ALLEN SURVEY,
Abstract No. 29, Keller, Tarrant County, Texas, and" crossing the Tract of
land conveyed to TBC Construction, Inc. by the deed recorded in Volume
13136, Page 535 of the Deed Records of Tarrant County, Texas. Said 20
foot wide strip of land being more particularly described by metes and
bounds, as follows:
BEGINNING at a point in the South boundary line of said TBC Construction,
Inc. Tract, being located N 890341 07" E 20.06 feet, from a 1/2"
iron rod found, marking the original Southwest corner of said TBC
Construction, Inc. Tract, and said point of beginning lying at the
Southeast corner of the Tract of land conveyed to the City or
Keller for right-of-way expansion of U.S. Highway No. 377 by the
deed recorded in Volume 14641, Page 183 of the Deed Records or
Tarrant County, Texas;
THENCE NORTHWESTERLY 136.33 feet, along the East boundary line of
said City of Keller Tract, being the new East right-of-way line of
said U. S. Highway No. 377, with a curve to the right having a
radius of 3,739.83 feet, a central angle of 020 OS' 19", and a
chord bearing N 03046' 15" W 136.32 feet, to a point in the North
boundary line of said TBC Construction, Inc. Tract;
THENCE N 880 35' 05" E 20.01 feet, along the North boundary line
of said TBC Construction, Inc. Tract, to a point;
THENCE SOUTHEASTERLY 136.68 feet, along a line 20 feet East of

TEMPORARY CONSTRUCTION EASEMENT
THE STATE OF TEXAS
COUNTY OF TARRANT
That TBC CONSTRUCTION INC., GRANTOR herein, for and in
consideration of the sum of Ten ($10.00) Dollars and other good and
valuable consideration in hand paid by the CITY OF SOUTH LAKE, a home rule
municipal corporation in Tarrant County, Texas, GRANTEE herein, the receipt
and sufficiency of which is hereby acknowledged and confessed, do hereby
grant, sell and convey to GRANTEE a temporary construction easement for
the purpose of water utilities installation on that land in Tarrant County,
Texas, described and shown on Exhibit "A" and Exhibit "B" attached hereto
and incorporated herein.
The temporary construction easement shall commence upon 30 days
following the notice to proceed date given to the contractor of the project
and shall terminate 30 days after completion of the construction of the 42"
water distribution line. The temporary construction easement shall include
the right to excavate and fill upon the temporary easement, but GRANTEE
shall replace any fences or other fixtures upon the temporary easement with
cost to GRANTOR, and shall restore the property which is subject to the
temporary easement as closely as possible to its condition prior to entry
thereon.
TO HAVE AND TO HOLD the above described temporary construction
easement with the right of ingress and egress thereto, together with all and
singular the rights and appurtenances thereto in any wise belonging unto
GRANTEE, it successors and assigns, for the term described, and GRANTOR
does hereby bind himself, his heirs, successors and assigns to warrant and
forever defend, all and singular, the said premises unto the GRANTEE, its
successors and assigns, against every person whomsoever lawfully claiming
the same or any part thereof.
