COUNTY OF TARRANT
THAT INETTA A. SCHNITZER, individually and as x~cutrix of the
estate of F. J. SCHNITZER, deceased, (IIGrantorll) , , for and in
consideration of the sum of One Dollar ($1.00) cash to Grantor in
hand paid by the CITY OF SOUTHLAKE, TEXAS (IIGranteell), the receipt
of which is hereby acknowledged, and the further consideration of
the benefits to be derived by Grantor from the placing of drainage
facilities, sanitary sewer mains, lines, and lift stations, and
other public utilities,' on, under and through the premises
hereinafter described, has this day GRANTED AND CONVEYED, and by
these presents does hereby GRANT AND CONVEY unto Grantee an
approximately fifteen (15) foot wide, permanent and perpetual
easement (the IIUtility Easementll) to construct, reconstruct,
repair, alter, replace, relocate, operate and maintain such
facilities and to authorize any of such actions by any person or
entity, in, upon, under and across the following described land
(the lIutility Easement Tractll), to-wit:

All that certain tract, piece or parcel of land, lying
and being situated in the County of Tarrant, State of
Texas, described in Exhibit A attached hereto and made a
part hereof for all purposes, and as shown on Exhibit B
attached hereto and made a part hereof for all purposes.
Grantor has this day also GRANTED AND CONVEYED, and by these
presents does hereby GRANT AND CONVEY unto Grantee a temporary
easement (the "Temporary Construction Easementll) for access to and
the construction of said facilities in, upon, and across a twenty-
five (25) foot wide strip of land as shown on Exhibit B (the
IITemporary Construction Easement Tractll).
TO HAVE AND TO HOLD the utility Easement perpetually to
Grantee, its successors and assigns, together with the right and
privilege at any and all times to enter said premises, or any part
thereof, for the purpose of constructing, reconstructing,
repairing , altering, replacing, relocating, operating and
maintaining said facilities and for making connections therewith;
all upon the conditions that Grantee will at all times, after doing
any work in connection with said facilities, reasonably restore the
surface of said premises to a condition similar to that which the

same were found before such work was undertaken (after giving
effect to such work).
Grantor covenants and agrees that Grantor and Grantor's heirs,
representatives, successors and assigns shall at no time erect,
place, or construct, or cause to be erected, placed, or
constructed, on or across the surface of either the utility
Easement Tract or, during its effectiveness, the Temporary
Construction Easement Tract, any temporary or permanent structures
other than a lift station or improvements such as driveways,
surface parking lots, curbs, gutters and related drainage
facilities.
The Temporary Construction Easement shall expire upon the
completion of construction of the herein described facilities and
their acceptance by the City of Southlake, Texas.
The utility Easement and the Temporary Construction Easement
are made and accepted subject to all restrictions, covenants,
liens, and encumbrances of record that validly affect the utility
Easement Tract or the Temporary Construction Easement Tract.

UTILITY EASEMENT TRACT
For a tract of land in the Little Berry G. Hall Survey, Abstract No. 686,
situated in Tarrant County, Texas and being a portion of the tract described in
a deed to F. S. Schnitzer in Volume 5154, Page 347, Deed Records, Tarrant
County, Texas (D.R.T.C.T.), being more particularly described by metes and
bounds as follows:
Beginning: at an iron pin in the north right-of-way line of Farm-to-Market
1709, said point being the most southerly southwest corner of a tract described
in a deed to E-Systems, Inc. Pool Trust of Record in Volume 7949, Page 722,
D.R. I.e. T.;
Thence: South 75 degrees, 55 minutes, 31 seconds West, along said north R.O.W.
line, 15.34 feet to a point for corner;
Thence: North 02 degrees, 00 minutes, 47 seconds West, 151 perpendicular to
and parallel with the east line of the Schnitzer tract, 505.63 feet to
a point for corner in t~e north line of Schnitzer tract;
Thence: South 89 degrees, 58 minutes, 09 seconds East, along said north line
of Schnitzer tract, 15.01 feet to an iron pin for the northeast corner
of Schnitzer tract;
Thence: South 02 degrees, 00 minutes, 47 seconds East, along the east line of
