REUTLINGER, COUNTY OF TARRANT hereinafter Grantors, for and in consideration of the promise of the CITY OF SOUTHLAKE, hereinafter Grantee, to purchase, pay for and install upon Grantors' property from which the hereinbelow described temporary easement is granted one (1) one inch (1") water meter which meter shall be installed and hooked up not later than thirty (30) days after Grantee's waterline to be constructed in the herein granted temporary easement is put into operation and the further consideration that Grantee shall either waive, or in the alternative, pay on Grantors' behalf any tap, impact or other assessment charged by the CITY OF SOUTHLAKE, TEXAS in connection with the hook-up of Grantors' property to the water line, the receipt and sufficiency of which is hereby acknowledged and confessed, have granted, sold and conveyed, and by these presents do grant, sell and convey to the CITY OF SOUTHLAKE, TEXAS, a Texas municipal corporation, Grantee herein, of Tarrant County, Texas, a temporary construction easement for the purpose of installing and altering utilities in, into, upon, over across and under that land in Tarrant County, Texas, described as follows, to wit: TEMPORARY EASEMENT AGREEMENT - Page 1 c: \wp51 \reutlinger\temp-ease.agr RETURN TO: City Secretary City of Sou~~lake 667 North Carroll Ave Southlake, Texas 76092 10361 1985 ..--..., .,..,-",-~--"",. See Exhibit A attached hereto and incorporated herein fully by reference a metes and bounds description with attached graphic depiction together with the right of ingress and egress as necessary for such purposes. The term of this Temporary Easement shall be for the shorter period of one (l) year, beginning on the date this Temporary Easement is executed and terminating one (l) year thereafter, or a period until the County of Tarrant, Texas purchases a permanent right-of-way or easement from Grantors or their successors or assigns, which includes the Temporary Easement herein granted to Grantee, at which time this Easement shall terminate. The County of Tarrant, Texas shall be considered to have "purchased" when it receives a signed, acknowledged permanent easement or right-of-way from grantors or when it pays its offered purchase price into the registry of the Court as provided in the statutes of the State of Texas regulating condemnation proceedings. If at the end of the one (l) year term Tarrant County, Texas has not yet acquired a right-of-way or permanent easement for Grantors, which includes this temporary easement, Grantors hereby grant Grantee an additional term of the lesser period of one (l) year from the ending date of the initial term or to the date Tarrant County, Texas purchases such permanent easement or right- of-way from Grantors, at which time this Temporary Easement shall terminate. Such Temporary Easement shall include the right to excavate or fill upon such property, but Grantee shall replace any fences, improvements, or other fixtures upon said property without cost to Grantor, or current owner thereof, and shall restore the property, the subj ect of the Temporary Easement, as nearly as possible to its condition prior to entry thereon, not later than the termination date of this Temporary Easement. TO HAVE AND TO HOLD the above-described Temporary Easement, together with all and singular, the rights and appurtenances thereto, anywise belonging unto the said Grantee, its successors and assigns; and I do hereby certify that I am the owner of the property described herein and bind myself, my heirs and assigns, to warrant and to forever defend all and singular the premises unto the said Grantee, its successors and assigns, against every person whomsoever lawfully claiming or to claim same or any thereof.
