KNOW ALL MEN BY THESE PRESENTS:
That we, CAROL O. PETERKA, LORRIE W, BECK, and LESLIE W. KLINGMAN,
("Grantor"), for and in consideration pfthe aum ofTen ($10) Dollars and other ~ood and
valuable consideration in hand paid by Grantee herein, the receipt and sufficiency oiwhich is
hereby acknowledged and confeased, have granted, sold and conveyed, and by these presents do
grant, sell and convey to the City of Southlake, Grantee herein, of Tarrant County, Texas a
pennanent and perpetual non-exclusive easement for the purpose of installing, repairing,
maintaining, altering, replacing. relocating, and operating a 12" wa.ter line in, into, upon, over,
across and under that land in Tarrant County, Texas described as follows, to~wit:
Being a pennanent water line easement, described as follows:
See attached Exhibit 'A' for graphic depiction
See attached Exhibit 'B' for metes and bounds description together with the light of
ingrelils and egress as necessary for suoh purposes.
See attached Exhibit ie' for Utility Layout
See attacbed Exhibit 'D' for Detail of Utility Placement
Grantor reserves the right to make such use of the surface area oithe property described
above for purposes not inconsistent with the use by Grantee of such area for the ea~ement
purposes herein stated. Without limitation of the foregoing, Grantor reserves the right to cross
the easement area with sidewalkEl, driveways, and other access ways which. may be paved, and
reserves the right to pave and landscape across and along such easement area. Grantee agrees to
promptly repair any damage to any auch paving or landscaping caused by OranLee in exercising
its rights under this easement.
Grantor re$erves the right, subject to obtainina Grantee's prior consent, which sball not
be unreasonably withheld, delayed or conditioned, to relocate the lines located in the easement
herein granted to accommodate its development aotivities, provided that any such relocation snal1
be done at the sole cost, risk and expense of Grantor.
This easement shall be perpetual, except that if the Grantee ceases to use the easement
area for the purposes herein stated for a continuous period in excess of two years, then this
easement shall lapse and be of no further force: and effect.
TO HA VE AND TO HOLD the above described easementt together with all and singular,
the rights and appurtenances thereto, anywise bclonaing unto the said Grantee, its succe~sor;l and
assigns forever; and We do hereby certify that We are the owners ofthe property doscribed
herein and bind ourselves, our heirs and assigns, to warrant and to forever defend all and singular
the premises unto the said Grantee, its successors and assigns, against every person whomsoever
lawfully claiming or to claim lame or any thereof.

Permanent Utility Easement - Parcel 204UE
Being 0.333 of an acre of land, more or less, situated in the Richard Eads Survey, Abstract
No. 481, City of Southlake, Tarrant County, Texas and being a portion of land conveyed to
Carol J. Williams Peterka etal by deed in Volume 8516, Page 595, of the Deed Records,
Tarrant County, Texas, which 0.333 acre of an acre of land, more or less, is more particularly
described as follows:
BEGINNING at the point of intersection of the Northerly right-of-way line of F.M. Highway
1709 and the southeast corner of said Carol J. Williams Peterka tract;
THENCE
N 890 53' 01" W, for a distance of 724.34 feet to a point in the south line of
said Carol J. Williams Peterka tract, said point also being in the Northerly right-
of-way line of F.M. Highway 1709;
THENCE
N 000 06~ 59" E, for a distance of 20.00 feet to a point for a corner;
THENCE
S 890 53' 01" E, for a distance of724.21 feet to a point for a corner in the east
line of said Carol 1. Williams Peterka tract;
