PERMANENT COMMON ACCESS & UTILITY EASEMENT
THE STATE OF TEXAS
COUNTY OF TARRANT
KNOW ALL MEN BY THESE PRESENTS:
That We, First American Savings Ban~ for and in consideration
of the sum of Ten ($10) Dollars and other good and valuable
consideration in hand paid by Grantee herein, the receipt and
sufficiency of which is hereby acknowledged and confessed, have
granted, sold and conveyed, and by these presents do grant, sell
and convey to the CITY OF SOUTHLAKE, Grantee herein, of Tarrant
County, Texas a permanent and perpetual easement for the purpose of
installing, repairing, maintaining, altering, replacing,
relocating, and operating utili ties in, into, upon, over, across
and under that land, and for a common access easement for the
purpose of egress and ingress upon that land in Tarrant County,
Texas described as follows, to-wit:
Permanent Common Access and Utility Easement:
See attached Exhibit I A I for metes and bounds description.
See attached Exhibit 'B' for graphic depiction.
together with the right of ingress and egress as necessary for such
purposes.
Such permanent easement shall include the right to excavate upon
such property and ingress and egress across said property, but
Grantee shall replace any fences, improvements, or other fixtures
upon said property without cost of Grantor, or current owner
thereof, and shall restore the property as nearly as possible to
its condition prior to entry thereon.
TO HAVE AND TO HOLD the above described easement, together
with all and singular, the rights and appurtenances thereto,
anywise belonging unto the said Grantee, its successors and assigns
forever; and We do hereby certify that We are the owners of the
property described herein and bind ourselves, our heirs and
assigns, to warrant and to forever defend all and singular the
premises unto the said Grantee, its successors and assigns, against
every person whomsoever lawfully claiming or to claim same or any
thereof.

EXHIBIT A
PERMANENT UTILITY AND
COMMON ACCESS EASEMENT
BEING 0.042 acres of land located in the City of Southlake, Tarrant
County, Texas, and being situated in the Little Berry G. Hall
Survey, Abstract Number 686, and being a portion of that certain
tract of land conveyed to First American Savings Banc as recorded
by deed in Volume 10641, Page 1628, of the Tarrant County Deed
Records and being more particularly described as follows:
COMMENCING at a five-eighths inch iron rod (stamped C & B #3937),
same rod being the northeast corner of a 4.884 acre tract of land
conveyed by deed to E. J. Schnitzer ETUX Inetta, as recorded in
Volume 5154, Page 347, of the Tarrant County Deed Records, said
iron rod being, by deed calls, South, 2103.6 feet and West 534.6
feet from the Northeast Corner of said Hall Survey;
THENCE South 02 degrees 00 minutes 52 seconds East, 501.78 feet,
along the east line of said 4.884 acre tract to a five-eighths inch
iron set (stamped C & B #3937), same iron rod being in the north
line of tract of land conveyed to the State of Texas, as part of a
right-of-way take for Farm to Market Highway Number 1709, as
recorded in Volume 9185, Page 22;
THENCE South 75 degrees 43 minutes 02 seconds West, 84.00 feet,
along the said north line of Farm to Market Highway Number 1709, to
a five-eighths in iron rod found;
THENCE South 81 degrees 09 minutes 08 seconds West, 137.83 feet,
along the said north line of Farm to Market Highway Number 1709, to
a five-eighths in iron rod set (stamped C & B #3937), to the POINT
OF BEGINNING;
THENCE South 81 degrees 09 minutes 08 seconds West, 41. 00 feet;
THENCE North 02 degrees 01 minutes 47 seconds West, 45.00 feet;
THENCE North 81 degrees 09 minutes 43 seconds East, 41.00 feet;
THENCE South 02 degrees 01 minutes 47 seconds East, 44.99 to the
POINT OF BEGINNING and containing 0.042 (1831 square feet) within
the metes recited, more or less.
