Item 6D - Staff ReportCITY OF S0UTHLA1<,,,E Department of Planning & Development Services STAFF REPORT June 14, 2022 CASE NO: CP22-0001 PROJECT: Land Use Plan Amendment for Highland Terrace EXECUTIVE SUMMARY: On behalf of White Chapel Southlake, LLC, the Sage Group is requesting 2r,a Reading approval of a Land Use Plan Amendment from "Public/Semi-Public" to "Medium Density Residential" Land Use Designation on property described as a portion of Lot 1 R1, Block 1, Southlake Assembly of God, City of Southlake, Tarrant County, Texas and located at 101 E Highland Street., Southlake, Texas. Current Zoning: "CS" Community Services District. Proposed Zoning: "SF-20A" Single Family Residential District. SPIN Neighborhood #7. DETAILS: The property is generally located on the southeast intersection of N. White Chapel Blvd. and E. Highland Street. The purpose of this request is to propose a Land Use Plan amendment appropriate for developing a 9 lot single family residential subdivision on an approximately 5.358 acres portion of the 6.77 acre church site (See Case No. ZA22-0018). The church site occupies approximately 1.4 acres of the overall site. The remaining 5.358 acres is unimproved and is proposed for residential subdivision. The current the "Public / Semi -Public" Land Use Designation does not include residential development as an appropriate land use. A Land Use Plan Amendment to the "Medium Density Residential" LUD is needed to justify the proposed residential development. Existing Land Use Designation — Public/Semi-Public Case No. CP22-0001 The Public / Semi -Public land use category is defined by the Southlake 2035 Comprehensive Plan as: The Public / Semi -Public land use category is suitable for a wide range of public, civic, and religious uses, such as government offices and facilities, public and private schools, churches and related facilities (including parsonage and parochial schools), cemeteries, and Public Parks/Open Space uses in conjunction with these developments. The Medium Density Residential land use category is defined by the Southlake 2035 Comprehensive Plan as: "The Medium Density Residential category is suitable for any single-family detached residential development. Other suitable activities are those permitted in the Public Parks/Open Space and Public/Semi-Public categories." Highland Street, Southlake, TX. LEGAL DESCRIPTION: Lot 1 R1, Block 1, Southlake Assembly of God LAND USE CATEGORY: Public / Semi -Public PROPOSED LAND USE CATEGORY: Medium Density Residential on a portion of the existing property and maintaining the current Public / Semi -Public land use category on the remaining property. CURRENT ZONING: "CS" Community Services District PROPOSED ZONING: "SF-20A" Single Family Residential District HISTORY: A plat showing for Lot 1, Block 1, Southlake Assembly of God Addition was approved by City Council on September 4, 1984 (ZA84-39). A special exception use permit for a church and church related activities was approved on September 4, 1984 (ZA84-39). The zoning was changed from "AG" Agricultural District to "CS" Community Service District with the adoption of Comprehensive Zoning Ordinance 480 in 1989. A plat revision for Lots 1 R1 and 1 R2, Block 1, Southlake Assembly of God Addition was approved on October 20, 2009 was filed on June 21, 2010 (ZA09-037) PLANNING AND ZONING COMMISSION: May 19, 2022; Approved (5-0) subject to the Staff Report dated May 13, 2022. Case No. Attachment A CP22-0001 Page 1 Applicant's Highland Terrace Narrative: The proposed Highland Terrace neighborhood is intended to be a high -quality, half -acre lot development, consistent with "Medium Density Residential" designation of the City of Southlake Future Land Use Plan. We are requesting SF-20A zoning, and all lots will be at least 20,000 s.f. in size. It will be developed by Hat Creek Development, with a long track record of delivering high quality neighborhoods in Southlake. Development Layout: The property is currently an open space area owned by the adjacent church. It falls off from the frontage along White Chapel (on the western boundary) to the east a total of almost 40'. The plan anticipates a single cul-de-sac road from White Chapel, with lots on either side "terracing" down the slope. Each home will be approximately 8 feet, in elevation, higher or lower than the neighboring home, allowing each to access the great views to the east. Home Design: Each of the 9 homes in this development are intended to be built by local Southlake area based custom home builders. The plans for each homesite will be subject to a comprehensive design and review process to ensure the high level of quality for design, layout, materials and construction methods. Case No. Attachment B CP22-0001 Page 1 ORDINANCE NO. 1257 AN ORDINANCE ADOPTING THE CONSOLIDATED FUTURE LAND USE PLAN AS AN ELEMENT OF THE SOUTHLAKE 2035 PLAN, THE CITY'S COMPREHENSIVE PLAN UPDATE. WHEREAS, a Home Rule Charter of the City of Southlake, Texas, was approved by the voters in a duly called Charter election on April 4, 1987; and, WHEREAS, the Home Rule Charter, Chapter XI requires an update to the City's comprehensive plan elements every four years, WHEREAS, the City Council recognizes that the Consolidated Future Land Use Plan is an element of the Southlake 2035 Plan, the City's Comprehensive Master Plan, WHEREAS, the City Council has determined that the Consolidated Future Land Use Plan complies with the Southlake 2035 Vision, Goals, & Objectives, WHEREAS, the City Council has deemed that the Consolidated Future Land Use Plan has been formulated with adequate public input, WHEREAS, the City Council has deemed that the recommendations in the Consolidated Future Land Use Plan herein reflect the community's desires for the future development of the City, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, THAT: Section 1. All of the findings in the preamble are found to be true and correct and the City Council hereby incorporates said findings into the body of this ordinance as if copied in its entirety. Section 2. Future Land Use Plan designation for parcels indicated in Exhibit "A" is changed from "Public/Semi-Public" to "Medium Density Residential" Land Use Designation. Section 3. The different elements of the Comprehensive Master Plan, as adopted and amended by the City Council from time to time, shall be kept on file in the office of the City Secretary of the City of Southlake, along with a copy of the ordinance and minute order of the Council so adopting or approving the same. Any existing element of the Comprehensive Master Plan which has been heretofore adopted by the City Council shall remain in full force until amended by the City Council as provided herein. Section 4. This ordinance shall be cumulative of all provisions of ordinances of the City of Southlake, Texas, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. Section 6. The City Secretary of the City of Southlake is hereby authorized to publish this ordinance in book or pamphlet form for general distribution among the public, and the operative provisions of this ordinance as so published shall be admissible in evidence in all courts without further proof than the production thereof. Section 7. This ordinance shall be in full force and effect from and after its passage and publication as required by law, and it is so ordained.
