CITY OF SOUTH LAKE MEMORANDUM (May 17, 2022) To: Shana Yelverton, City Manager From: Rob Cohen, Director of Public Works Item 4F Subject: Approve an Encroachment and Joint Use Agreement of a new residential structure within a drainage easement and flowage easement located at 1033 Hatch Court. Action Requested: Approve an Encroachment and Joint Use Agreement of a new residential structure within a drainage easement and flowage easement located at 1033 Hatch Court. Background Information: The property owner of 1033 Hatch Court is requesting to construct a new residential structure within a drainage easement located within 1033 Hatch Court. There are no City utilities within the portion of the drainage easement located on 1033 Hatch Court, and the Army Corps of Engineers has confirmed that the proposed new residential structure is located outside of the flowage easement. The existing residential structure is located within the dedicated drainage easement and is located outside of the flowage easement as determined on the FEMA Firm map dated September 25, 2009. The proposed new residential structure will be constructed in approximately the same location as the existing residential structure that will be demolished. Per the drainage memo provided by G.A. Dixon Associates, LLC, construction of the new residential structure will increase the impervious area, however, G.A Dixon Associates determined that the proposed new residential structure will not impact the adjacent creek and will not impact drainage to the adjacent properties. Staff is requesting City Council to consider the proposed drainage easement encroachment for the proposed improvements at 1033 Hatch Court. Financial Considerations: This is a no cost agreement to the City. An authorized agent of the landowner must submit a Power of Attorney. PLEASE SUBMIT ALL OF THE FOLLOWING REQUIRED DOCUMENTS: 1. One copy of the Application with an original signature. 2. One copy of the Easement Joint Use Agreement with an original signature, signed and notarized. Do not submit copies of signatures and notary acknowledgments. One copy of EXHIBIT NO. 1 that contains the precise metes and bounds description of the part of the easement to be used. This information is best provided by a registered land surveyor. Note that the City staff is not authorized to prepare this information. Do not place drawings or plats on this exhibit. 4. One copy of EXHIBIT NO. 2 which shows in graphic form the nature of the encroachment with dimensions. Please limit the area of usage of the easement to only that needed to accommodate your needs. Plans or drawings may be reduced, provided the final document is legible. City staff will make final decision on legibility. 5. The Public Works Department may require an additional EXHIBIT NO. 2A which may include a detailed drawing or cross sectional drawings of decks, signs, retaining walls, fences, driveways, piers, footings, etc. to fully evaluate the extent of the encroachment 6. One copy of EXHIBIT NO. 3 with original signatures, signed by all agencies listed regardless of whether they have utility equipment in the easement. This will need to be done before submitting to the City of Southlake. 7. After this agreement is filled out, you will need to return it to Public Works Department and pay: • The Public Easement Encroachment Permit Fee of $155. 8. This agreement will be circulated through the Public Works, Planning and Development and Building Inspection Departments within the City of Southlake. Please allow approximately seven to ten working days to complete the circulation process. 9. This agreement's final review and approval rests with the Director of Public Works. 10. After approval by the Director of Public Works, a copy of the signed agreement is forwarded to the Building Permit Department for retention in any pending permit files, a copy is retained in the Public Works Department and a copy is sent to the applicant for their records. The Government acquired flowage easement on Tract A-39 at Grapevine Lake, Texas up to elevation 572 feet National Geodetic Vertical Datum. As shown on the attached licensed survey, the current stone and frame house is located above the Government's flowage easement interest. Any future alterations made to the house within the area above the flowage easement does not require U.S. Army Corps of Engineer (USACE) approval. However, construction or placement of any other structures below this elevation requires USACE approval prior to the activity. Please submit an after -the -fact request for all structures below the flowage easement elevation depicted in the survey. Please provide your request to the Grapevine project office within 60 days for review. Once a consent has been fully executed by the Real Estate Contracting Officer and filed in the county records, a release of the above mentioned Notice of Encroachment will be issued referencing the executed consent. Dear Mr. Cohan. I am licensed by the State of Texas as a registered Professional Engineer (#93675) and am actively engaged in the practice of engineering. I obtained a Bachelor of Science degree in Hydrology Engineering from Tarleton State University in 1998 and a Master of Engineering degree in Civil Engineering from the University of Texas at Arlington in 1999. 1 am also a Certified Floodplain Manager ("CFM") in the State of Texas (#0474- 03). 1 am currently President of G.A. Dixon Associates, LLC, a Registered Texas Engineering Firm (#15836) since 2014. My professional engineering experience includes the evaluation and design of numerous projects involving storm water, sewer, paving, grading, drainage, as well as providing Professional Engineering opinions as requested. We have been retained to review the drainage concerns associated with the development of 1033 Hatch Ct. in Southlake. 1. Development of 1033 will not impact drainage on the adjacent properties. Developments at 1033 Hatch Ct are at a lower elevation (573.00) than the existing adjacent residence. The existing adjacent residential structure at 1037 is at elevation 578.00. The majority of this property drains onto 1033 Hatch Ct. The existing adjacent residential structure at 1029 Hatch Ct is at an elevation approximately 576.00. Per our Drainage Plan water from from the adjacent properties onto the subject property at 1033 Hatch Ct. 2. We have calculated the impacts of impervious surfaces on the Proposed Drainage Plan. Based on the increased footprint of the proposed structure and the removal of the existing barn the increase in impervious surface from existing 21,832 sf, to Post project impervious surface 23,293 sf, results in an increase of stormwater run off from 10.65 to 10.98 cfs per 100 yr. frequency storm. 3. Proposed development of 1033 Hatch Ct will not alter the Existing Base Flood Elevation. FEMA FIRM 48439CO105K, effective date 9/25/2099 shows the upstream elevation of the 100yr base flood elevation upstream of 1033 Hatch Ct as 565.00. When the 565.00 elevation from the FEMA panel, is compared with more recent NCTCOG LIDAR the footprint of the proposed structure is clearly above the 566.00 If we compare the NCTCOG contours to the Floodplain line, it is clear the map was drawn utilizing older topographic data, as floodplain lines should not cross topographic contours perpendicularly. In addition, the floodplain encroachment on 1033 Hatch is the same AE Zone as Lake Grapevine which has a 100 yr. base flood elevation of 565.00.
