Hawk, City Manager SUBJECT: Agenda Item Comments and Other Items of Interest City Council Meeting 1. Agenda Item No. 5A. Appointment to Fire Reserve Force. This appointment will bring the number of volunteer Fire Reserves to thirteen (13). Of this number, two are on administrative leave. Six members of the former volunteers have not applied for appointment: Mike Totin, Richard Allen, Rexene Allen, Chris Moore, Chad White, and Eric Luiq. Additionally, one other former volunteer who was appointed to the Reserve Force, Tony Guiterrez, resigned. 2. Agenda Item No. 6A. Former Councilmember Hall will appear to bring City Council up-to-date on the City's participation in the KAB. 3. Agenda Items 8A&B, pertaining to Pecan Lakes have been withdrawn at the request of the applicant. Agenda Item No. 8C has been requested to be tabled by the applicant. 4. Agenda Item No. 8D. Ordinance No. 480-E. 1st Reading on Buffer Yard Requirements in Zoning Ordinance. The amendments as proposed includes the items covered in previous discussions with City Council. The preamble and boiler plate to the amendments will be delivered Tuesday by the attorneys. 5. Agenda Item No. 9A. Appointments to the P&Z. It is critical to our work that the appointment be made as soon as possible. In addition to the vacancy, Commissioner Samartin will be unable to attend P&Z meetings for approximately 90 days due to work requirements that will require out-of-state travel on Thursdays. 6. Agenda Item No. 9B. Appointment to Park and Recreation Board. Note that with the resignation of Board Member Randy Robertson there are now two (2) vacancies on this board. 7. Agenda Item No. 9C. Resolution No. 92-12. Intent to Issue C.O.s for F.M. 1709. We still have not received an answer from the Highway Department concerning our participation in the curb and gutter costs. However, we need to start the process if we are to keep to the construction timetable. We will discuss at length Tuesday night. 8. Agenda Item No. 10A. Solid Waste/Recycling Franchise. The "low bid" came from our current garbage contractor. They have Honorable Mayor and Members of City Council Agenda Item Comments April 3, 1992 Page 2 made a commitment toward recycling, as demonstrated by hiring additional staff assistance to handle recycling only. Although we have not endorsed a contractor, we have had a good experience with the current garbage contractor. 9. Agenda Work Session for Mid -Year Review. The withdrawal of several items from the agenda gives us an opportunity to spend time on our mid -year review. This is important as we prepare for our June retreat and our FY92-93 budget proposals. Hawk, City Manager FROM: Greg Last, City Planner SUBJECT: Timarron Phase I, Park Dedication requirements Amendment to the Phase I Developers Agreement The Developers agreement for Timarron Phase I was executed on October 24, 1991. The Park Dedication requirements were deferred until the January 1992 Park Board Meeting with the understanding that any fee required would also include accrued interest at the annual rate of 6%. Timarron representatives met with the Park Board in February but were unable to mutually agree on a fee payment at that time. On March 9, 1992, the Park Board voted in favor of recommending that Timarron be granted a 50% credit toward the Park dedication requirements for Phase I. Phase I has 162 lots, at $500 per lot the total fee would be $61,000. A 50% credit would reduce the fee to $40,500. Accrued interest at 6% (simple interest) from October 24, 1991 to the Council meeting, April 7, 1992 on this amount would be $1,105.15. The total fee for Phase I is $41,605.15. Attached is page 10 of the developers agreement showing the current section addressing park fees, and an amendment to the developers agreement. Please place this item on the next available Council agenda. The Developer will.. develop a 12 acre project park on Continental Boulevard which will be owned and controlled by:the Homeowners Association. The DevelQP&r will preserve 6 acres of open space in the Big Sear Creek floodway which will be owned and controlled by the Homeowners Association. The additional dedication of land or money in lieu of land for Phase I, to meet the ordinance requirements, will be made by January 1992. Decisions regarding the development of project open space for the entire project will affect the dedication requirements for Phase I as well as future phases. These decisions will be made between now and January 1992, thereby necessitating the need for deferment. C. PERIMETER STREET ORDINANCE: It is understood by and between the City and Developer that the Developer will pay for the engineering and const-ruction cost to improve Continental Boulevard,i between White's Chapel and the eastern line of Timarron, Phase I, to a new 31-foot wide street' paved with F1 AC. A portion of this length will be divided by a landscaped median and have two T1-foot lanes (one on either. side of the median).''*' Also included in the facilities constructed by the Developer will be drainage improvements and landscaping. In consideration of the expense incurred by the Developer, the following agreements are hereby made: 1. The Developer will dedicate one-half of the proposed 84-foot public rights -of .way for Continental Boulevard and White's Chapel along the perimeter of Timarron, Phase I. The Developer will also dedicate additional right -of way to construct the . di, ed portion of Continental Boulevard. 10 AMENDMENT TO DEVELOPERS AGREEMENT TIMARRON PHASE I It is hereby agreed by the following parties that the Developer's Agreement for Timarron Phase I shall be amended as follows: Delete the previous Section IV-B Park Ordinance and replace with the following section: IV B. PARK ORDINANCE: The Developer will conform to the requirements of Planned Unit Development restrictions as they relate to open space and recreational facilities. The Developer will develop a 12 acre project park on Continental Boulevard which will be owned and controlled by the'Homeowners Association. The Developer will preserve 6 acres of open space in the Big Bear Creek floodway which will be owned and controlled by the Homeowners Association. On March 9, 1992 the Park Board recommended that Council approve a 50% credit against the total fee required for the 162 lots in Phase I. On April 7, 1992, City Council approved the 50% credit. Gandy, Zoning Administrator SUBJECT: Proposed Revisions to Section 30, Planned Unit Developments/Nonresidential Building Sites Staff has initiated revisions to the above referenced section because the ordinance does not address development site plans for nonresidential buildings within residential planned unit developments. Typically, community/recreational and commercial buildings have been shown in the common areas, but with insufficient detail to process a building permit application. Staff would like to recommend that all nonresidential building sites submit either a concept plan or development site plan as required by the development regulations of the most intensive intended use. Currently, the City Council has approval authority for concept plans in all districts. Site plans prior to issuance of a building permit are approved administratively, with the exception of Residential P.U.D., Nonresidential P.U.D., S-P-1 and S-P-2 zoning districts which require City Council approval of both the concept plan and the site plan. In Section 30.7, the lengthy paragraph on page 30-4 has been broken into several smaller paragraphs for reading ease. Attached please find the recommended revisions to Section 30 as well as the existing P.U.D. section. jW KPG PLANNED UNIT DEVELOPMENTS SECTION 30.7 The zoning application may then be processed and a zoning classification of Planned Unit Development allocated to the site by appropriate municipal ordinance. The ordinance will identify the tract as a Planned Unit Development and will identify the types, intensity and density of land uses on the site. The ordinance will further provide that no actual construction can commence on any portion of the project until a Development Site Plan complying with the provisions of this Section has been processed and approved on that specific section or phase of the Planned Unit Development. Each Development Site Plan which, is submitted for approval of a specific section or phase of, the Planned Unit development shall cover a minimum of fifty (50) acres. This approach is designed and intended to allow a large development to be approved in concept and then constructed in phases. The City recognizes that it may not be feasible and it may be unrealistic to require a highly detailed site plan to be completed on a very large project when it is recognized that it will be constructed in sections or phases over several years. Any Planned Unit Development projects undertaken on the basis of concept plan approval rather than full development site plan approval do not reflect the concurrence of the City to any specific lot arrangement or sizing, street arrangement or pattern, or approval of any specific open space or public facility plans not reflected on the approved Concept Plan. Planned Unit Development zoning based solely on a concept plan reflects only zoning approval of the basic concept and may not be implemented until full development site plan approval on each section or phase has been granted; however, an applicant receiving approval of a Concept Plan shall be entitled to rely on, and implement by subsequently approved Development Site Plans, the type, intensity, and density of land uses set forth in the approved Concept Plan. A concept plan based upon the Planned Unit Development Ordinances shall be subject to the following additional restrictions: Consistency Requirement. Each and every development site plan submitted to secure implementation authority under the concept plan approval option must be consistent with the original concept plan. If the Zoning Administrator should identify any material variance between a submitted development site plan application and the approved concept plan for the Planned Unit Development, they shall reject the development site plan application and not accept it for processing until a new concept plan for the entire Planned Unit Development has been approved under the terms and provisions of this ordinance." 9 D-L SECTION 30.8 In any residential and nonresidential Planned Unit Development, all nonresidential building sites shall submit a separate concept plan, meeting the requirements in Section 41 of this ordinance, or a development site plan, meeting the requirements of Section 40 of this ordinance, whichever is required per the district regulations of the most intensive proposed nonresidential use. This plan shall be submitted either concurrently with the development site plan for that , phase of the Planned Unit Development or prior to requesting"a building permit. The approval of the applicable plan shall be -in accordance with the procedure outlined in the appropriate district for the intended use." I t)-3 SECTION 30 "PUD" PLANNED UNIT DEVELOPMENT DISTRICT 30.1 PURPOSE AND INTENT - The purpose of this district, sometimes identified as a suffix to one of the other districts, is to permit flexibility and encourage a more creative, efficient and aesthetically desirable design and placement of buildings, open spaces, circulation patterns and to best utilize special site features such as topography, size and shape. It is intended .that the flexibility permitted by this zoning category'- extends to discretionary approval, in conjunction with site plan or concept plan review, not limited to, but including such items as - those relating to parking space requirements, building "line setbacks, square footage of buildings and struc%zi=es, sign placement and specifications and protective scredning in order to achieve conformance with good planning practices. This district may also be used to accommodate planned associations of uses developed as integral land use units, including mixed uses, which may be planned, developed and operated either by a single owner or a combination of owners. 30.2 PERMITTED USES = The PUD District, when approved as a suffix to a particular zoning district, will allow the development of any combination of uses which are permitted in that district. The PUD District may also be approved for a specific use or uses, or a class of generic uses such as office, retail, personal services, educational facilities or warehousing. a. In the event certain uses are deemed inappropriate in a PUD district, whether approved for specific uses or as a suffix to another district, the use of the property may be specifically restricted by eliminating certain uses from the category of permitted uses. b. The City Council may approve residential development in a nonresidential PUD and nonresidential development in a residential PUD although said uses are not specifically listed in the approved PUD as long as said ancillary development does not exceed 10% of the total PUD development. 30.3 RESIDENTIAL PLANNED UNIT DEVELOPMENTS - Where the PUD District is developed primarily for residential uses, the tract shall have a gross area of at least fifty (50) acres. A residential PUD district may be designed to accommodate the following development: a. Dwelling units grouped into clusters, allowing an appreciable amount of land for open space. . b. Projects with much or all of their housing in townhouses or apartments or both. C. Higher densities than conventional single-family projects of the same acreage. d. Part of the land used for non-residential purposes, such as shopping or employment centers. e. Preservation or enhancement of areas exhibiting environmentally significant natural features. 30.4 NON-RESIDENTIAL PLANNED UNIT DEVELOPMENTS - Where the PUD District is developed primarily for non-residential uses, the tract shall have a gross. area of at least ten (10) acres. A non-residential PUD district may be designed to accommodate the following development: a. Commercial or industrial uses grouped into clusters, allowing an appreciable amount of the land for open space or joint use such as parking and storage. b. Commercial or industrial projects with part of the land used for residential purposes. C. Single purpose commercial or industrial uses projected to involve innovative land utilization. 30.5 DEVELOPMENT REGULATIONS - The height, setback, area, floor space, and other development regulations for permissible uses in a PUD district shall conform to the development regulations which would be applicable to such uses if the same were situated in the most restrictive district in which such uses are permitted. However, the City Council may approve more flexible development standards if other design features provide adequate protection to surrounding and adjacent properties. For any residential PUD, the maximum density permitted shall be equal to the maximum density permitted under the least restrictive single family zoning district at the time the PUD is granted. In any residential PUD, all buildings or structures shall have a maximum lot coverage not exceeding thirty percent (30%) of the lot area, except the sum total of accessory buildings shall not exceed 600 square feet. When developing a residential PUD in phases, the City Council shall establish in the individual PUD ordinance the maximum density permitted in each phase to assure that the maximum density of the entire residential PUD is not exceeded once complete buildout is achieved. (As amended by Ordinance No. 480-C.) I D-5 30.6 PARKING REGULATIONS a. All parking and vehicle use areas shall be paved with an all-weather surface. b. Off-street parking facilities shall be provided at - locations designated on the approved development site plan. C. Minimum off-street parking requirements shall be established in the approved development site plan. Any deviation less than the -minimum requirements specified in Section 35 shall require specific approval from the City Council. (As amended by Ordinance No. 480-C.) 30.7 APPLICATION - An application for a Planned Unit Development District shall be made to the Planning and Zoning Commission in the same manner that an application for zoning change is made. The application shall be processed according to the procedures specified herein. For purposes of application processing, all Planned Unit Development applications shall initially be divided into two (2) broad categories: 1. Planned Unit Developments encompassing one hundred (100) acres or less in land area. These shall require the submission and processing of a Development Site Plan and any specific Planned Unit Development ordinance approving such a proposal shall require specific compliance with the terms of the site plan which shall be incorporated by reference into the Zoning Ordinance Amendment. 2. Planned Unit Developments encompassing more than one hundred (100) acres of land area shall be given the opportunity at the time of zoning application to select between two (2) alternative processing procedures: a. The applicant may choose to submit a Development Site Plan in conformance with the provisions of this Section and thereby complete all processing requirements at the inception of the zoning action. b. The applicant may choose to submit a. Development Concept Plan for the entire Planned Unit Development area. In addition to the requirements set forth in Section 41.3 of this ordinance, the Development Concept Plan shall include the following: (1) A preliminary drainage study; (2) A preliminary major utility layout showing water and sewer mains, etc. (3) A proposed major thoroughfare plan; and V 1)-4 (4) A legend detailing space, the maximum land allotted to the minimum area of open density, the percentage of each use, and the general location of each use. The zoning application may then be processed and a zoning classification of Planned Unit Development allocated to the site by appropriate municipal ordinance. City/Developer Agreement. All Planned Unit `-Development zoning1granted on the basis of concept plan approval or, site plan approval shall be required to enter into a City/Developer Agreement prior to or contemporaneous with final plat approval.This Agreement is designed and intended to reflect the agreement of the City and the Developer as to the phasing of construction to insure the timely and adequate provisions of public works facilities and public type improvements. This Agreement is also intended to insure balanced intensity of development to avoid overloading existing public facilities during the construction phase. This Agreement will be individually negotiated for each project, but should address the following issues: (1) Any agreements on cost sharing for the installation or oversizing of major utility systems, lines or facilities. (2) Any agreements on cost sharing for the installation of interior or perimeter roadways, thoroughfares, or street systems. (3) Any agreements as to a mandatory construction or dedication schedule for a specific amount of park or open space area or improvements, school site or sites, landscaping or greenbelt development or other comparable items to be dedicated or constructed for each acre of property within the development released for construction by site plan approval. This requirement is intended to allow the City to insure that pre -planned public type facilities, improvements or amenities are installed concurrently with other development on the basis of a negotiated formula. A screening and landscaping plan shall be required where such treatment is essential to the proper arrangement of the development in relation to adjacent property. Such plan shall, when required, include screening walls, planting, wooded areas to be retained, and lawns if such are determined to be necessary by the City Council. 5. Any or all of the required features may be incorporated on a single drawing if such drawing is clear and capable of evaluation and interpretation by the Administrative Official. 30.9 DEVELOPMENT SCHEDULE - The Planning and Zoning Commission may, at its discreticn, require that an application for a Planned Unit Development District be accompanied by a development schedule indicating the approximate date on which construction is expected to begin and the rate of anticipated development to completion. The RFP was designed to allow the City to select a contractor for collection and disposal (Part 1) , recycling (Part 2) or a combination of collection, disposal and recycling (Part 3). Attached is a copy of the RFP and a bid tabulation of the results. The proposals were opened and read aloud at 10:00 a.m., Friday, March 27, 1992. The low bid proposal for solid waste collection, disposal and recycling (Part 3 of the bid tabulation) was Lakeside Sanitation and Waste Management of North America, each bid $8.45 per household. Presently, the City is charging residential customers $8.96 for collection, disposal and recycling ($7.15 for collection and disposal and $1.81 for recycling). Upon Council's selection of a solid waste contractor, staff will develop a contract containing, but not limited to, the following elements: A. Term of the contract; B. Insurance, liability, and workman's compensation requirements; C. D. E. F. G. H. I. J. K. Collection and disposal terms as outlined in the "Scope of Work" in RFP; Recycling terms as outlined in the Equipment requirements Type of containers Compensation Office and personnel requirements Modification of rates; RFP of the contractor; Hazardous and toxic waste requirements; and Termination of contract. Instruction to Bidders A. General This Request for Proposal is in three parts: Part 1: Solid Waste Collection and Disposal Part 2: Solid Waste Recycling Part 3: Solid Waste Collection, Disposal and Recycling The Bidder may bid on Part 1 only, Part 2 only, or Part 3 only, or any combination. The Bidder shall complete and submit the entire proposal no matter what part is bid. Any part that is not bid shall have "No Bid" placed on the line where the fee is required. The City Council reserves the right to award the contract to any contractor or contractors it deems is in the best interest of the City of Southlake. The City reserves the right to accept any Proposal or to reject any or all Proposals, and to waive defects or irregularities in any Proposal. The City intends that the Contract shall be awarded within thirty (30) days following the date that proposals are publicly opened and read. B. Receipt and Opening of Proposals The City of Southlake (the "City") invites and will receive Proposals on the forms attached hereto, all information on which must be appropriately filled in. Proposals will be received at the office of City Secretary by 10:00 a.m. Friday, March 27, 1992, and publicly opened and read aloud in City Council Chambers at that time. The envelopes containing the Proposals must be sealed and addressed to the City Secretary, City of Southlake, and plainly marked "Proposal for Solid Waste Collection, Disposal and Recycling". C. Conditions Each Bidder shall fully acquaint himself with the terms and conditions as described in Parts 1, 2, and 3 of this Proposal and shall have all questions answered in writing prior to bid opening. Written questions will be directed to the Public Works Director. The failure or omission of any Bidder to receive or examine any form, instrument, addendum or other document, or to acquaint himself with existing conditions, shall in no way relieve him of any obligations with respect to his Proposal. The Bidder shall make his own determination as to existing conditions and shall assume all risk and responsibility and shall complete the work in and under conditions he may encounter or create, without extra cost to the City. MNUSCU 1 The Bidder's attention is directed to the fact that all applicable State and Federal laws, municipal ordinances, and the regulations of all authorities having jurisdiction over the work to be performed shall apply to the Proposal throughout; and they will be deemed to be included in the Proposal as though written out in full in the Proposal. D. Competency of Bidder The opening and reading of the Proposal shall not be construed as an acceptance of the Bidder as a qualified, responsible Bidder. The City reserves the right to determine the competence and responsibility of a Bidder from its knowledge of the Bidder's qualifications and from other sources. Attention is brought to the fact that the cost of service per month for Parts 1, 2, or 3 is not the major factor in the selection process. Of equal importance to the City is the quality of service that the successful Bidder has demonstrated in the past in collection, disposal, and recycling of solid waste. Each Bidder shall furnish, with the proposal, written evidence of his/her qualifications, including financial information, recommendations from other governmental entities, etc. In the event that the City shall require additional certified supporting data regarding the qualifications of the Bidder in order to determine whether he is a qualified, responsible Bidder, the Bidder may be required to furnish additional information sworn to under oath by him. E. Service Area The service area to be included in all three Parts (1,2, and 3) of this proposal is the corporate City limits of Southlake. All Bidders shall familiarize themselves with the City limit boundaries of the City of Southlake. The City estimates that the number of Residential Units to be initially serviced is 2,450. This estimate does not include commercial or industrial collection service. The Bidder may wish to utilize his own or other estimates and to provide for growth or shrinkage factors. The City makes no representation as to the reliability of its estimate for Residential Units. F. Term of Contract It is anticipated that the successful Bidder or Bidders of all contracts will enter into a three (3) year contract with the City of Southlake with an option to renew or renegotiate the contract for an additional term as directed by the City Council. General This section of the Proposal includes the collection and disposal of all solid waste (except recycling) for residential homes only. Commercial, Institutional, and Industrial collection and disposal will not be included separately in this proposal. B. Scope of Work The following services will be provided for collection and disposal of solid waste. The Bidder will include all items listed below in his/her.fee for Part 1 in the Proposal Summary. 1. Collection: a. Remove all.solid waste from each residence twice a week with no limit on the amount of solid waste to be removed. Collection will be between the hours of 7:00 o'clock a.m. and 6:00 o'clock p.m. No collection will be made on Sunday. b. Removal of large items such as furniture, hot water heaters, refrigerators, freezers, etc. when called in by homeowner. One day advance notice will be required by the homeowner. C. Any missed pick ups will be picked up on the same day they are called in if the call is prior to 2:00 p.m. d. Furnish a chipper at Christmas time to chip all Christmas trees which will be gathered at one location. The chips will be left at site if so desired by City. The Contractor will allow the residents at least three weeks to accumulate trees, and the Contractor will have one week to chip the trees. e. Provide Southlake residents with a location to deposit brush, tree limbs, etc. during normal working hours. f. Provide City of Southlake residents with a location to dispose of motor oil, tires, and batteries during normal working hours at a cost to be determined by the Contractor for each item. g. Remove all dead animals within 24 hours notice when requested by the City of Southlake. h. Remove all leaves if set out by the curb in 30 gallon containers or less, with no limit as to VW-RCYC.R"ft4 SMb 3 number of containers. Remove all branches and bushes if set out by the curb provided they are cut and tied in bundles of four (4) feet or less with no limit- to -the number --of -bundles- and each bundle----------- - weighing less than 50 lbs. i. The Contractor may observe no more than four (4) holidays per calendar year. j. Contractor will furnish all equipment and labor necessary to adequately and efficiently collect and dispose -of all solid waste collected. All equipment shall be clearly marked with the Contractors's name and phone number and shall be in good repair at all times. Contractor shall use the latest and best equipment provided in the industry. The City reserves the right to inspect all equipment used. in collection and may require the Contractor not to use a piece of equipment for good and reasonable cause. k. The successful Bidder for Part 1 or Part 3 of the Proposal will be responsible for the collection and disposal of all commercial, institutional, and industrial customers. The Contractor will collect and dispose of the solid waste at such times as shall be reasonably requested by the customer. The Contractor will bill the customer directly but the City shall reserve the right to insure that the collection and disposal service is adequate and the rate is fair and reasonable. 1. The Contractor shall keep an office open to the public, Monday through Friday (except for holidays) from 8:00 a.m. to 5:00 p.m. M. The Contractor will establish his/her collection routes and will provide the City with a copy of the route map. n. The Contractor is not responsible to collect and dispose of any hazardous waste. o. The City will provide the billing and collection service for residential collection, disposal and recycling. The total receipts collected by the City for collection and disposal only shall be returned to the Contractor less 10% which will be retained by the City for the franchise, billing and collection charge. No commercial, institutional, or industrial accounts will be billed by the City. 2. Disposal: The Contractor will be responsible to dispose of all solid waste collected in the City of Southlake at a State of WS?-RCYC.R"fM SCJkb lea-- ? 4 Texas licensed landfill. The Contractor will be responsible to meet all local, State and federal laws pertaining to the disposal of all solid waste. Any cost associated with --- __ disposal will be -included---in--the -unit -cost per -residence- Part 1 and Part 3 of the Proposal Summary. III. Part 2. Solid Waste Recycling The City of Southlake realizes that the need to recycle municipal solid waste is becoming more and more apparent in municipalities throughout the United States. This need is no longer solely based on environmentally sound planning practice but is becoming a solid waste management necessity. Recycling will soon become a --'major component of all City solid waste management plans. After careful study of recycling alternatives as a potential component of the overall solid waste management service, the City of Southlake proposes to undertake a curbside recycling program within the following provisions: A. Both the City and the Contractor understand and agree that participation in the Curbside Recycling Program is totally voluntary. There are approximately 2,300 recycling customers and each residence shall be charged for this service. To facilitate optimum participation in the program the Contractor hereby agrees at its cost, and at no cost to program targeting the single-family residential units and public schools located within the City. A detailed plan to the education and advertising program will be submitted with the proposal. B. The Contractor shall supply all materials and equipment necessary at its own cost and no cost to the City to effectively service the City for curbside residential recyclable material pickup. Such materials and equipments will include: 1. Specially designed refuse vehicles for the collection of curbside recyclable material. 2. Single unit individual collection bins for recyclable materials for each single-family residential unit within the City. Units will be constructed of recycled plastic at least in part and will be 16 to 20 gallons in volume. Unites shall be distributed no later than the week prior to the commencement of curbside recycling. The Contractor may charge a replacement cost for bins which are lost, stolen, or destroyed after a customer is initially provided a recycling bin. However, there will be no charge for replacement of bins due to normal wear and tear. C. The Contractor shall clearly state on the recycling collection vehicle and each recycling bin the following information: 1. The name of the Contractor providing the service. WST-RCYC.R"IMISCIkb /toQ.-/D 5 2. A slogan such as "Recycle Southlake" or such wording as agreeable to the City and the Contractor. -D. Prior to the commencement -of -recycling -service to the City, - all materials and equipment to be used must be inspected and approved in writing by the City. The Contractor may be allowed up to three (3) months to procure necessary equipment and to coordinate public awareness from the date of the Contract. E. The Contractor shall submit to the City for review and approval prior to the commencement of service, a business plan which includes a marketing plan, community awareness and involvement plan and a schedule for collection.' The collection of recyclable goods shall occur no less than one time per week, Monday through Saturday, for all single-family residential units. • The proposal shall include a plan outlining the Carroll Independent School District's involvement in the recycling program. The City shall have final approval authority for the collection schedule. In addition, the Contractor agrees to add such projects as recycling for apartments as'such markets become available. F. Materials to be collected by the Contractor for recycling include: 1. Newspapers: Newspaper only. No magazines, mail, paper bags or other paper. 2. Glass Bottles and Jars: no mirrors, windows, ceramics, etc. 3. Cans: Cans only - beverage, food, beer, soft drinks. No scrap metal. 4. Plastics: H.D.P.E. and P.E.T. bottles. Bottles in this category would include two and three litter soft drink, milk, juice, water, shampoo, liquid soap, etc. The City reserves the right to include additional materials, such as magazines, cardboard, automobile batteries, and other materials as such markets become available. In addition, the Contractor agrees to add yard waste recycling, and office paper recycling as markets become available. Rate adjustments shall be changed as provided in the successful Bidder's Contract. G. Beginning with the date of commencement of this recycling program, the Contractor shall return to the City, no later than the 25th day of each month, 100% of all funds obtained for the sell of recyclable materials collected by the Contractor in the City. Such payment to the City shall be accompanied by a detailed statement indicating the weights and values of the recycled materials collected and sold. H. The Contractor shall also report to the City the quantities of recycled materials marketed quarterly and annual reports: Monthly and Quarterly Reports shall include: WST-RCYC. RFP/MLSC/kb 6 0 • Tonnage marketed, by materials • Participation rates by neighborhood • Discussion of problems and successful experiences in _ program -operation.- Annual Reports shall include: • Summary of participation rates and recovered material amounts. • Summary of public awareness activities and their impact on participation and recovered tons. • Summary of.successes and problems and measures taken to resolve problems. I. The Curbside Recycling Program.Contract will be a three (3) year contract with an option to renew the contract for an additional term as directed by the. City Council. At the end of the contract, the carrier and City will evaluate the program and decide either to renew or renegotiate the contract. J. The Bidder shall include a cost per residential unit per month for Part 2 in the Proposal Summary. Solid Waste_Collection, Disposal and Re This section of the proposal combines Part 1 and Part 2. The Bidder will base his/her bid for Part 3 on the terms and conditions listed in Part 1 and Part 2 of the Proposal.
