City Council Meeting
1. Agenda Item No 4. City Manager's Report. The departmental
reports are in your packet. Let me or the Directors know if
you have any questions.
2. Agenda Item No 5A Excuse of absence from two consecutive
meetings of P&Z member Larry Samartin is requested by P&Z
Chairman, Joe Wright. Mr. Samartin was out of town on
business February 20 and March 5, 1992. He will be in
attendance March 19. Feel free to contact Mr. Wright if you
have any questions.
3. Agenda Item No 7A Ordinance No 555. 2nd Reading. Tri-
County Electric Rate Increase. This item was approved on
first reading last meeting.
4. Agenda Item No 10A Agreement for Adventure Camp at
Bicentennial Park. This program, recommended by the Park and
Recreation Board, is identical to the program conducted by
Mrs. Harvey last year.
OTHER ITEMS OF INTEREST
5. Please note the letter from Councilmember Hall resigning her
position on the Council to run for the school board.
6. The Agenda length represents our "Spring Break." Remember
that Tuesday will be St. Patrick's day, so wear your green!

tendering my resignation from Council, to be effective
immediately.
I am filing for Place 6 on the Carroll Independent
School District, School Board.
It has been a rewarding and wonderful experience
working with you. Each Council member has contributed
immensely towards a dynamic City government. Your
honesty, concern, diligence, and ability to work as a
team has and will continue to provide the focus and
direction needed for our City.
I would also like to thank Curtis, our Department
Heads, our City Secretary, and the entire staff. Your
professionalism, commitment, and hard work and
enthusiastic involvement has been fantastic.
In closing, I would like to also thank our advisory
boards, and various task forces, for their valuable
input, and I am looking forward to continued
involvement in our community.

Mr. Joe Wright, Chairman, Planning and Zoning Commission, has
requested your consideration in excusing Larry Samartin's absence
at the March 5 and March 19, 1992 P&Z Commission Meetings.
Section 11.03 of the City Charter as amended by the voters in
January, 1991, provides that " ..a member of the Commission shall
forfeit his office if he fails to attend two (2) consecutive
regular meetings of the Commission without being excused by the
Council."

SUBJECT: TRI-COUNTY RATE INCREASE
At the December 3, 1991 City Council meeting, the City Council
suspended for 90 days action on the proposed Tri-County Electric
Cooperative rate change request. The rate change was scheduled to
go into effect January 1, 1992. The 90-day suspension delayed the
change until April 1, 1992.
The State law provides for the suspension period to allow cities
time to study the requested increase. The law also requires the
City to hold a public hearing on the request. The required public
hearing was held last City Council meeting, March 3, 1992.
City Council approved the rate change on first reading of Ordinance
No. 555 last meeting, March 3. Our Charter (Section 10.06)
requires that public utility rates be regulated by ordinance. The
Charter requires two readings to approve an ordinance. In addition
to the public hearing held last meeting, Ordinance No. 555 will
provide a public hearing.

AN ORDINANCE APPROVING PROPOSED CHANGES IN RATES AND
SERVICE REGULATIONS FOR TRI-COUNTY ELECTRIC COOPERATIVE,
INC. AND PROVIDING AN EFFECTIVE DATE THEREFORE; PROVIDING
CONDITIONS UNDER WHICH SUCH RATES AND SERVICE REGULATIONS
MAY BE CHANGED, MODIFIED, AMENDED, OR WITHDRAWN; FINDING
AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW;
PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL
ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Southlake, Texas is a home rule city
acting under its charter adopted by the electorate pursuant to
Article XI, Section 5 of the Texas Constitution and Chapter 9 of
the Local Government Code; and
WHEREAS, in accordance with Section 17(a) of the Public
Utility Regulatory Act (Article 1446c, Vernon's Annotated Civil
Statutes), and its City Charter, the City of Southlake currently
exercises exclusive original jurisdiction over electric utility
rates, operations, and services; and
WHEREAS, on November 4, 1991, Tri-County Electric Cooperative,
Inc. filed an Application For Authority to Change Rates and
Statement of Intent with the City of Southlake; and
WHEREAS, Tri-County Electric, contemporaneously with its
filing with the City, filed an Application with the Public Utility
Commission of Texas to approve the implementation of rate changes
contained in its Application For Authority to Change Rates and
Statement of Intent; and
WHEREAS, the City Council of the City of Southlake has
reviewed the rate request filed with the City and finds that said
rates are just and reasonable; and

WHEREAS, the City Council of the City of Southlake, after
having thoroughly considered the matter, is of the opinion P that the
best interests of the City and the citizens will be served by the
approval of the proposed rate changes and service regulation
changes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SOUTHLARE, TEXAS:
SECTION 1
The City of Southlake hereby -approves implementation of and
authorizes Tri-County Electric Cooperative, Inc. to charge, within
the corporate limits of the City, the rates allowed and approved
by the Public Utility Commission in Docket No.
with the
effective date of the new rates to be contemporaneous with the
effective date of those changes allowed by the Public Utility
Commission. Said approved rates shall be effective until same may
be changed, modified, amended, or withdrawn by the approval of the
City Council of the City of Southlake.
SECTION 2
Nothing contained in this ordinance shall be construed now or
hereafter as limiting or modifying in any manner the right and
power of the City Council of the City of Southlake, under state law
or City Charter, to regulate the rates, operations, and services
of Tri-County Electric Cooperative, Inc.
SECTION 3
It is hereby officially found and determined that the meeting
at which this ordinance was passed was open to the public as
required by law and that public notice of the time, place, and
purpose of said meeting was given as required by law.

SECTION 4
This ordinance shall be cumulative of all provisions of
ordinances of the City of Southlake, Texas, except where the
provisions of this ordinance are in direct conflict with the
provisions of such ordinances, in which event the conflicting
provisions of such ordinances are hereby repealed.
SECTION 5
It is hereby declared to be the intention of the City Council
that the phrases, clauses, sentences, paragraphs and sections of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted
by the City Council without the incorporation in this ordinance of
any such unconstitutional phrase, clause, sentence, paragraph or
section.
SECTION 6
This ordinance shall be in full force and effect from and
after its passage and publication as required by law, and it is so
ordained.

Parks and Recreation Board. In looking over the application, I would

First, we are currently living in Trophy Club, and have been for the
last. _ i:z months . We are having a house built in the Chimney Hill
section of Southlake, and it is e:.pected to be complete January 15th.
Our new address, is shown on the application, but the phone number is
for my office at IBM, as we obviously don't have a home phone yet.
As far as the experiences listed on the application, I do have a Park
Administration degree from Texas Tech University in '78, and 7-8 years
e.-;perience in landscape architecture. As a matter of fact, my minor
was Landscape Architecture. However, I have been working with IBM the
last 13 years. and have I:ot. had any professional landscaping
experience during that period of time. IBM has a way of keeping you
busy.
I would love to serve on the Board. Number one, I would like to get
involved with the ..,mmunity. Number two, I have both a parks business
background that I believe would be beneficial to the community. Feel

SUBJECT: "ADVENTURE CAMP" AND RECREATION PROGRAMS PROPOSAL
Tina Harvey of Adventure Club in Grapevine has made a proposal to
the City of Southlake to coordinate a summer camp and additional
recreational programs for the citizens of Southlake this summer and
fall. The summer camp will be called "Adventure Camp" and will be
held from 7:30 a.m. to 6:00 p.m. June 15-19 at the Bicentennial
Park Lodge or the newly acquired community building if the new
facility is ready for use by June 15.
Ms. Harvey coordinated last year's "Adventure Camp" for the City
which proved to be very popular with area children. The camp is
geared for children ages 6-12. The Southlake Parks and Recreation
Board recommended City Council approval of the "Adventure Camp"
proposal at their March 9, 1992 meeting.
City staff has drafted an agreement with Ms. Harvey for her
services related to the organization of "Adventure Camp" 1992.
The agreement contains a provision granting 5% of profits derived
from the camp to go to the City of Southlake.
In addition to the "Adventure Camp" proposal, Ms. Harvey has
included a Phase II proposal for expanded recreational programs for
the City. These programs include plans that initially call for a
Babysitting class and a Rids-N-Motion program to be held in late
summer or fall 1992. If these programs are a success Ms. Harvey
would like to set up similar programs next year. The Parks and
Recreation Board has also recommended that Phase II of Ms. Harvey's
proposal be implemented. This portion will be brought before the
City Council once details have been worked out.
Tina Harvey and Parks Board representatives will appear to make
this presentation and/or answer any questions regarding the camp or
the new recreation programs.

PERSONAL SERVICES AGREEMENT

This agreement is made on the day of 1992
between the City of Southlake herein referred to as "City" and
herein referred to as "Coordinator,"
who will provide the services to the City noted on the attached
Exhibit "A".
1. The activities and services herein described will be conducted
by and under the supervision of the Coordinator, subject to
the following conditions:
A. The Coordinator will not discriminate against anyone on
the basis of race, national origin, age disability, creed
religion, sex, or place of birth in the provision of
services to the public, and will comply with all
applicable provisions of TITLE VI of the Civil Rights Act
of 1964, the Rehabilitation Act of 1974, and the
Americans with Disabilities Act of 1990- In addition,
the Coordinator understands that the City may cancel this
agreement.
2. The Coordinator agrees to indemnify, defend, and hold harmless
the City of Southlake, its elective and appointed
representatives and any employee oagent firm, e city
corporation, any
and all claims on behalf of any person,
agent, including Coordinator, arising from the performance of
this agreement.
3. The Coordinator understands that this agreement is not
accepted or final until it is approved and signed by the
authorized representatives of the City; and that this
agreement may be terminated by either party without cause.
4. The Coordinator and the City both agree that this contract
shall terminate immediately with no obligation by the City to
pay any amounts to the Coordinator under this agreement unless
a minimum number of participants are registered and paid in

5. Terms of Payment: The City agrees to pay the Coordinator an
amount equal to all registration fees less 5% to be retained
by the City. The Coordinator shall also receive all funds

necessary supplies, equipment, etc. Payment to the
Coordinator shall be paid upon completion of the Adventure
Camp.

the City of Southlake has developed a park facility rich in
resource and opportunity. Southlake is a city comprised of active
and involved citizens. The need for organized youth and adult
activities is obvious.
Adventure Club proposes a viable solution for answering these
recreational needs by way of a contractural agreement with the
City of Southlake. Last summer, Adventure Club held the first
summer day camp sponsored by the City of Southlake at Bicenten-
nial Park. The program was very enthusiastically received by
