Hawk, City Manager SUBJECT: Agenda Item Comments and Other Items of Interest City Council Meeting 1/02/1990 AGENDA ITEMS 1. Agenda Item No. 5. Permission to advertise for public works vehicles. These vehicles are budgeted items. As pointed out in the memo from Mike Barnes, Public Works Director, our intentions are to order these through the Houston/Galveston Area Council of Governments in order to take advantage of the volume purchasing price. To date we have not received their bid list to order from. We do no yet know for sure if HGAC bids pickup trucks. We are in great need of these vehicles, so we would like to proceed with advertising as a precautionary measure. In the meantime, we are also exploring other possibilities, e.g., the state bid list (which may be our best option), that will enable us to save on the purchase price. Prior to advertising bids, we will make certain that no other avenues are available. On the bid advertisement we will specify that the City may choose to reject all bids. 2. Agenda Item No 6. Request to advertise for janitorial services. With the new addition and renovation/remodeling to City Hall, we will need to expand the scope of our janitorial services contract. Our current contract provides only minimal services. The current contract has expired, but we wanted to wait until the additions were'6%'mplete before readvertising. We will have a draft of the specs available for you to look at Wednesday. 3. Agenda Items 8-12 are fairly routine, and explained by the agenda memos. 4. Agenda Item No. 12. Amendments to Subdivision Ordinance No. 483-A. There were no changes suggested by City Council on first reading. This is the same ordinance we had on last agenda as a discussion item. Note that we crossed out the reference to archery equipment and crossbow as City Council suggested. 6. Agenda Item No. 14. Award Bids for N-3 line to Carroll High School. Note the low bid of $107,853.50 plus engineering costs of $13,644.52 ($1,280 City/$12,364.52 School) makes the total project cost $121,497.02. The City's project share of $15,188 will come from the N-3 bond funds. We will ask you to accept the bid contingent upon the school's acceptance. 7. Agenda Item No. 15. This is to proceed with the installation of three (3) box culverts provided for in the budget to ameliorate local drainage and traffic situations. 8. Agenda Item No. 16. Zoning Ordinance No. 480-C. Note the P&Z continued its discussion of this item to January 17. Thus you need to continue the item before you to February 5 in order to have the P&Z recommendations. 9. Agenda Item No. 17. Special Election. Staff will have for your review by Wednesday a proposed mail out. The holidays slowed us down somewhat on this. OTHER ITEMS OF INTEREST 10. Phone System Upgrade. Our phone system upgrade is complete. We are still working out a few bugs, which are related to our programming of the telephone coverage and the voice mail. For the most part it is working as planned. For example, during the period covering 10:00 a.m. Wednesday, December 26 to 4:00 p.m. December 27, we received 871 total calls. Of these 580... answered by auto attendant 124... call answered by employee directly (extension number was used) 158... went to voice mail 480... transfers completed by auto attendant (i.e., transferred to number) 31... receptionist answered and completed call 37... callers abandoned line 4... transfers were incompleted. We will continue to monitor the system. We can get a print-out for any time period needed. The purpose of the phone upgrade is to free up time of the operator/receptionist for other work, while at the same time increase our capability to answer all our calls. As those who call us regularly get to know the extension numbers our efficiency will increase. We are preparing a directory of extension numbers to be given out. we will also publish a list of extensions in the Chamber newsletter. In the meantime, attached hereto is an updated setccted phone list which includes extensions. 11. Note the letter from Wayne Olson concerning the recycling contract. I feel a little uncomfortable commenting on the basis of a newspaper article with no additional factual basis to support the allegations. Based upon what I have been furnished, my legal comment to you and the Council is that the mere settlement of a lawsuit does not impute guilt or wrong on a party. It is not unusual for lawsuits to be settled despite a party's firm conviction that he has done no wrong. I tend to agree with the quoted comments from Fort Worth City Services Director Tom Davis, who stated that in this part of the country, he sees no indication that BFI and Waste Management are anything but aggressive competitors. These are two large international companies which are subject to different management practices in the different regions in which they operate. HALL SURVEY, ABSTRACT NO. 686-, BEING A PORTION OF TRACT 3D, AND MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A" FROM AGRICULTURAL DISTRICT TO COMMUNITY SERVICE DISTRICT IN ACCORDANCE WITH THE EXHIBIT ATTACHED HERETO AND SUBJECT TO THE SPECIFIC REQUIREMENTS CONTAINED IN THIS ORDINANCE; CORRECTING THE OFFICIAL ZONING MAP; PRESERVING ALL OTHER PORTIONS OF THE ZONING ORDINANCE; PROVIDING A SEVERABILITY CLAUSE; DETERMINING THAT THE PUBLIC INTEREST, MORALS AND GENERAL WELFARE DEMAND THE ZONING CHANGES AND AMENDMENTS HEREIN MADE; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2000.00) FOR VIOLATIONS OF THE ZONING ORDINANCE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. -I--- WHEREAS, the City of Southlake, Texas is a homerule City acting under its Charter adopted by the electorate pursuant to tkbr Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Texas Local Government Code; and, WHEREAS, pursuant to Chapter 11 of the Local Government Code, the City has the authority to adopt a comprehensive zoning ordinance and map regulating the location and use of buildings, other structures and land for business, industrial, residential and other purposes, and to amend said ordinance and map for the purpose of promoting the public health, safety, morals and general welfare, all in accordance with a comprehensive plan; and WHEREAS, the hereinafter described property is currently zoned as Agricultural under the City's Comprehensive Zoning Ordinance; and WHEREAS, a change in the zoning classification of said property was requested by a person or corporation having a proprietary interest in said property; and WHEREAS, the City Council of the City of Southlake, Texas, at a public hearing called by the City Council did consider the following factors in making a determination as to whether these changes should be granted or denied: safety of the motoring public and the pedestrians using the facilities in the area immediately surrounding the sites; safety from fire hazards and damages; noise F-- producing elements and glare of the vehicular and stationary lights and effect of such lights on established character of the neighborhood; location, lighting and types of signs and relation of signs to traffic control and adjacent property; street size and adequacy of width for traffic reasonably expected to be generated by the proposed use around the site and in the immediate neighborhood; adequacy of parking as determined by requirements of this ordinance for off-street parking facilities; location of ingress and egress points for parking and off-street loading spaces, and protection of public health by surfacing on all parking areas to control dust; effect on the promotion of health and the general welfare; effect on light and air; effect on the over -crowding of the land; effect on the concentration of population; and effect on transportation, water, sewerage, schools, parks and other public facilities; and, WHEREAS, the City Council of the City of Southlake, Texas, further considered among other things the character of the districts and their peculiar suitability for particular uses and the view to conserve the value of the buildings, and encourage the most appropriate use of the land throughout this City; and, WHEREAS, the City Council of the City of Southlake, Texas, does find that there is a public necessity for the zoning changes, that the public demands them, that the public interest clearly requires the amendments, and that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and, WHEREAS, the City Council of the City of Southlake, Texas, does find that the changes in zoning lessen the congestion in the streets, helps secure safety from fire, panic, and other dangers, promotes the health and the general welfare, provides adequate light and air, prevents the over -crowding of land, avoids undue concentration of population, and facilitates the adequate provision of transportation, water, sewerage, schools, parks and other public requirements; and, WHEREAS, the City Council of the City of Southlake, Texas, has determined that there is a necessity and need for the changes in zoning and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the tract or tracts of land requested for a change since the tract or tracts of land were originally classified and therefore feels that the respective changes in zoning classification for the tract or tracts of land are needed, are called for, and are in the best interest of the public at large, the citizens of the City of Southlake, Texas, and helps promote the general health, safety and welfare of the community. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: 30.14? - 2 - Section 1. That Ordinance No. 480, the Comprehensive Zoning Ordinance of the City of Southlake, Texas, passed on the 19th day of September, 1989, as originally adopted and amended, is hereby amended so that the permitted uses in the hereinafter described areas be altered, changed and amended as shown and described below: Being approximately a 0.35 acre tract of land out of the Littleberry G. Hall Survey, Abstract No. 686, being a portion of Tract 3D, as more fully and completely described in Exhibit "A," attached hereto and incorporated herein. From Agricultural District to Community Service District. Section 2. That the City Manager is hereby directed to correct the Official Zoning Map of the City of Southlake, Texas, to reflect the herein changes in zoning. Section 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said Zoning Ordinance and all other applicable and pertinent ordinances for the City of Southlake, Texas. All existing sections, subsections, paragraphs, sentences, words, phrases and definitions of said Zoning Ordinance are not amended hereby, but remain intact and are hereby ratified, verified and affirmed. Section 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting the health, safety, morals and the general welfare of the community. They have been designed, with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets; to provide adequate light and air; to prevent over -crowding of land; to avoid undue concentration of population; and to facilitate the adequate provision of transportation, water, sewerage, drainage and surface water, parks and other commercial needs and development of the community. They have been made after a full and complete hearing with reasonable consideration among other things of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. Section 5. That this ordinance shall be cumulative of all other ordinances of the City of Southlake, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. Section 6. Every lot shall abut on a public street or a private street. B. All lots, regardless of zoning or whether or not zoned, that are not served by a public or quasi - public community sewer system, shall contain a minimum area of one acre to support a private septic tank and leach field. Commercial or Industrial lots may be allowed a smaller lot size upon approval of the proposed sewage treatment system by the Director of Public Works. A subdivision may, at the discretion of the Commission, be deemed to be served by a public sewer system if a Developer Agreement has been executed with the City outlining provisions for extending public sewer service to the development and providing for payment by the development of all required approach main, connection and impact fees necessary to acquire the service. C. Double fronted residential lots shall not be allowed. However, lots which are backed up to an arterial street shall be allowed when there is no access allowed from these lots to the arterial street. D. All lot lines shall be perpendicular to the R.O.W. lines or radial in the case of a cul-de-sac or curvilinear design. E. A row or tier or lots having a minimum lot width of 125 feet at the rear property line shall be provided adjacent to any property that is currently zoned or platted residential and contains lots of one acre or larger. SECTION 7 That Section 8.02, Sight Triangle, of Ordinance No. 483 be amended by revising Paragraph A to read as follows: "A. Definition: A sight triangle shall be the triangle created by connecting a point which is 10 feet along the R.O.W. at the intersection and a point extending away from the intersection a distance of 40 feet (see Figure 8-1). This line shall extend by projection to the back of curb on improved streets or the edge of pavement on unimproved streets along both streets impacted. The sight triangle herein referenced shall include all area between the above defined line and the street pavement." SECTION 8 This ordinance shall be cumulative of all provisions of ordinances of the City of Southlake, Texas, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 9 It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared stake%subdvmd.ord .S_ 162"4, 0 unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 10 Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000.00) for all violations involving zoning and shall be fined Five Hundred Dollars ($500.00) for all other violations of this ordinance. Each day that a violation is permitted to exist shall constitute a separate offense. I& BC/kb ORDINANCE NO. 527 AN ORDINANCE PROHIBITING THE DISCHARGE OF ANY GUN, PISTOL OR ANY OTHER WEAPONS DESIGNED AS AIR PROJECTILES; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Southlake, Texas is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, the City of Southlake deems it necessary for the health, safety and welfare of the citizens of Southlake to adopt this ordinance regulating and prohibiting the discharge of guns, pistols, b6, firearms and other similar weapons as provided herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLARE, TEXAS: SECTION 1 It shall be unlawful for any person to discharge any gun, Ev5s"W pistol, rifle, firearm, or any other weapon designed as an air projectile, or an air rifle or air pistol of any description by whatever name known, that by means of compressed air, compressed gas, springs, or any other means is capable of discharging shots, pellets, or any solid object at a velocity in excess of three hundred (300) feet per second, within or across the city limits of Southlake. SECTION 2 This ordinance shall not prohibit the discharge of a firearm by a police officer in the discharge of his official duties. slake\ord.310 2590) -1- �3-a SECTION 3 This ordinance shall not prevent the reasonable discharge of a weapon for the necessary and lawful protection of one's person, premises or property, unless such discharge be done in a reckless or negligent manner. SECTION 4 This ordinance shall not prohibit the discharge of a weapon at a range or other similar location specifically designed and operated by a governmental entity, a branch of the armed services or a responsible organization existing for the purpose of operating and maintaining the range, provided that such governmental entity, branch of the armed services or responsible organization shall have first obtained a permit from the City Council to do so. SECTION 5 This ordinance shall be cumulative of all provisions of ordinances of the City of Southlake, Texas, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 6 It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted slake\ord.31(12590) -2- /3-3 0 by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 7 Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Five Hundred Dollars ($500.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 8 All rights and remedies of the City of Southlake are expressly saved as to any and all violations of the provisions of any ordinances affecting the prohibition of the discharge of any gun, pistol, or any other weapons designed as air projectiles which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 9 The City Secretary of the City of Southlake is hereby directed to publish the proposed ordinance or its caption and penalty together with a notice setting out the time and place for a public hearing thereon at least ten (10) days before the second reading of this ordinance, and if this ordinance provides for the imposition of any penalty, fine or forfeiture for any violation of slake\ord.31(12590) .3- /3 -`1 any of its provisions, then the City Secretary shall additionally publish this ordinance in the official City newspaper one time within ten days after passage of this ordinance, as required by Section 3.13 of the Charter of the City of Southlake. Barnes, Public Works Director SUBJECT: AWARD OF SEWER CONTRACT FOR EXISTING HIGH SCHOOL One of the reasons that the N-3 sewer line was added to the S-6 sewer line contract was to provide sewer service for the existing high school. To provide this service a lift station, force main and gravity line was required to be built from the high school to the proposed N-3 lift station located at Dove Creek and Carroll Avenue. The school district and City has entered into an agreement whereby the school district will fund the sewer facilities for the existing high school if the City would manage the project. Cheatham & Associates has entered into a contract with the City of Southlake to design the lift station, force main and gravity line. Cheatham & Associates has completed the design of these facilities and on Wednesday, December 12, 1990, at 10:00 a.m. bids were opened and read aloud for these sewer facilities. The bids ranged from a low bid of $107,853.50 to a high bid of $227,652.80. In order to serve the area to the north and east of the existing high school with gravity sewer, it was necessary to increase the size of the lift station and force main. The minimum design of the lift station to meet the high school needs was 2-100 gpm pumps and the minimum design for the force main was a 4" line. The lift station design was upgraded to add a third 100 gpm pump when required and the force main was upgraded to a 6" line. The contract stipulates that the design of all three culverts will be on an hourly rate and that the total cost of engineering will not exceed $15,000.00, which is within the budgeted amount. ABSTRACT "A Limited Analysis of the Adequacy of the Strategic Planning in the United States Wood Products Industry" The research had three purposes: (1) to develop a general strategic planning model and the criteria for adequacy, (2) to derive an adequate strategic plan- ning model for an organization in the wood products industry, and (3) to analyze the current strategic planning in the industry using the derived model as the standard. Adequacy is defined as that minimal level of planning for the future that will make an organization socially and economically appropriate for the present environment and for the future. The general model was developed around the systems concept of the hierarchy of planning. The major modules in the model are philosophical position, strategic profile, strategic design, strategic programs, strategic controls, strategic comparisons, derivative decisions and programs, and derivative controls and comparisons. Significant components of the model are crucial variables, economics, technology, social trends, political trends, and the adjustment mechanism. The four major adequacy criteria are: (1) was strategic planning done, (2) how well was the strategic planning done, (3) were the strategic planning results implemented, and (4) how frequently was strategic planning done. From the general model, a strategic planning model for an organization in the United States wood products industry was derived. The United States wood products industry was defined as public and private organiza- tions which are involved, associated, or concerned with wood products in the United States. The analysis of the current strategic planning in the wood pro- ducts industry was done for the United States Forest Service, a private, non - trade organization, and three commercial firms. Using the one-shot case study research design with the derived model as the standard, it was the conclusion of the research that none of the organizations reviewed had adequate strategic planning. Therefore, the goal of the P&Z should be to ensure that all parties adhere to the established zoning plan. The duties of the P&Z Commission are: (1) To analyze all request for zoning changes to make sure that they comply with existing zoning ordances, like P.U.D. (2) To make recommendations to zoning applicants that would be beneficial both to them and to the City of Southlake. This would be done to assist the City Council. Barnes, Public Works Director SUBJECT: AWARD OF SEWER CONTRACT FOR EXISTING HIGH SCHOOL One of the reasons that the N-3 sewer line was added to the S-6 sewer line contract was to provide sewer service for the existing high school. To provide this service a lift station, force main and gravity line was required to be built from the high school to the proposed N-3 lift station located at Dove Creek and Carroll Avenue. The school district and City has entered into an agreement whereby the school district will fund the sewer facilities for the existing high school if the City would manage the project. Cheatham & Associates has entered into a contract with the City of Southlake to design the lift station, force main and gravity line. Cheatham & Associates has completed the design of these facilities and on Wednesday, December 12, 1990, at 10:00 a.m. bids were opened and read aloud for these sewer facilities. The bids ranged from a low bid of $107,853.50 to a high bid of $227,652.80. In order to serve the area to the north and east of the existing high school with gravity sewer, it was necessary to increase the size of the lift station and force main. The minimum design of the lift station to meet the high school fQ needs was 2-100 gpm pumps and the minimum design for the force main was a 4" line. The lift station design was upgraded to add a third 100 gpm pump when required and the force main was upgraded to a 6" line.
