I believe Sean is correct in his second paragraph, but I think he may be playing games in the third something, paragraph. Perhaps you may need to clarify g, but the motion itself does not address the dollar contribtuion. This more correctly should be done as an amendment to their existing developer agreements, or a new separate developers agreement. This should be made clear to them as to what you expect. I believe the quote in the minutes may not be verbatim, or if it is, may be a POGO statement, i .e. , "I know you think you uthatswhat I what said is said, notbut whatI 'm I meant. Note the letter from Mr. and Mrs . Thomas concerning their easement. A�_pointment of Municipal Court Clerk. Section 6 of �I Ordinance No. 522, the ordinance establishing our j Municipal Court of Record, provides that the Court Clerk be appointed by the City Council and be under the supervision of the City Manager. This provision ovision ins the included in the ordinance because of a p which State law (Section 30.488 of the Government Code) enabled the City of Southlake to create the Court of Record. In keeping with the provisions of the City Charter, I have selected Ms . Laura K. Denman for your consideration as appointment to the position of Municipal Court Clerk. Ms . Denman will replace Julie Honorable Mayor and Members of City Council Agenda Item Comments and Other Items of Interest June 28, 1991 Page 2 Hinkle, who resigned in order to spend more time with her child. Ms . Denman has been employed with the City of White Settlement since 1984, where she has been the Municipal Court Clerk for the last four years . She is a native of the State of Massachusetts . She is 27 years old. She is a member of the Texas Court Clerks Association and has been active in municipal court continuing education. While in White Settlement, Ms . Denman worked for our Finance Director, Lou Ann Heath, who then held a like position with the City of White Settlement. Ms . Denman was selected from a field of seventeen applicants . Lou Ann and I narrowed the list to three candidates based upon their background and experience. We then conducted interviews with the top three and ranked them according to a number of factors, including, among other things, -communication skills -continuing education and maintenance -file organization and maintenance -ability to interface court records with general ledger -supervisory capability. We then invited Municipal Court Judge Brad Bradley and Betsy Elam, the prosecutor in our Municipal Court (with our attorneys, Fielding Barrett, and Taylor) , to interview the top two. They concurred with our choice. Ms . Denman will start July 15. Her salary will be $23,000 . OTHER ITEMS OF INTEREST 4 . FM1709 Road Improvement Project. Last week, Mike Barnes, Director of Public Works, had attempted to arrange a meeting for this week with State, County, and City representatives involved with the FM1709 project to enable us to have a better understanding of the project status. Everything was set with the SDHPT, the Commissioner' s Office, and the County R.O.W. Supervisor's Office. The D.A. ' s office refused to participate, which negated any benefit to be had from meeting. Mike was told by the attorney working on the project for the D.A. ' s Office that she has been instructed by her supervisor to refuse to meet. 5. Complaint Regarding Speed Zones on SH114 . Some of you may have received a complaint from Claire B. Shahzad, 1794 Kingswood, concerning what she considers Honorable Mayor and Members of City Council Agenda Item Comments and Other Items of Interest ` June 28, 1991 Page 3 a "speed trap" on SH114 . She wants us to raise the 45 mph limit to 55 mph. Ms . Shahzad received a speeding citation for going 61 mph in the 45 mph zone on Monday, June 17, 8 :40 a.m. She talked to Sandy, who passed the complaint to Director of Public Safety Billy Campbell, who was serving as Acting City Manager that day during my absence from the City. Campbell spoke to her, but had the feeling following their conversation that she would be contacting Councilmembers . She has contacted the Mayor. Police Captain Malcolm Jackson has compiled a statistical summary of speeding citations issued on SH114 . (See attached. ) We began keeping these records on computer in March 1990 . Since we began these statistical records, we have issued 1,627 speeding citations on SH114 . Of these, 725 (44 . 6%) were issued in the 45 mph zone, and 902 (55 .4%) in the 55 mph zone. The percentage closely approximates the distance of 45 mph (44 .2%) and 55 mph (55.8%) speed zone lengths . It is interesting to note that the average speed of the citations issued in the 45 mph zone during the last 90 days is somewhat higher than the average speed of the citations issued in the 55 mph zone. The numbers indicate that the speed limit is anything but a speed trap. During the last City Council meeting, I reported to you that we had contacted the SDHPT concerning the speed on SH114 following the installation of the traffic lights at Dove and White Chapel and that the SDHPT believed the speed limit should remain the same. (Copy of our letter to SDHPT and the response letter attached. ) We remain concerned about the traffic speed on SH114 . Note the reminder in the SDHPT response letter that "proper speed limit enforcement" is a recommended traffic safety enforcement tool . This is the reason we established our Selected Traffic Enforcement Program. Realistically, we could add two other traffic officers to the program, they would probably pay for themselves, and we would still have a traffic safety problem due to excess speed. 6 . Complaint of Police harassment. Wednesday afternoon, I received a telephone call from a Mr. Kenneth Scruggs complaining about our police procedures and several of our staff . The complaint revolved around a major automobile accident worked by our Police Officers, and the release of the damaged automobile to the owner. I became aware of the accident at the time Police and EMS were dispatched by the Public Safety Communications Center early Tuesday evening. ( I was in my automobile when the call came over the radio. ) First thing Honorable Mayor and Members of City Council Agenda Item Comments and Other Items of Interest ' June 28, 1991 Page 4 Wednesday morning, I was briefed by Police Officer Sanders concerning the accident. When I received the call from Mr. Scruggs he asked if I was familiar with the accident that had occurred on Davis Blvd. the previous day. I told him I was aware an accident had occurred at Davis near Michael Drive. He told me this was the accident, that his wife was injured seriously, and that he had a complaint against the city and our procedures, which he said were a very serious problem. At the time, I thought he was calling to complain about the time it took our EMS personnel to remove his spouse from the wrecked vehicle using the Hurst tool (the "Jaws of Life" ) . Our Hurst tool, which is several years old, stopped working and we had to request assistance from Keller. This took approximately eight minutes, which can seem like a long time to anyone observing on the scene. I had not yet seen the accident reports, since they were not completed at the time I spoke to Officer Sanders Wednesday morning. The ostensible complaint concerned our vehicle release procedure. Mr. Scruggs told me he was unable to claim his wife's car from the Police and was thus very angry. We talked for approximately ten minutes concerning the situation. During this time, he led me to believe that he had not been able to claim his wife ' s car, so I told him I would take his telephone number and call him back as soon as possible to see what we needed to do to allow him to pick up the car. Only then did he tell me that he had finally taken possession of the car. I became genuinely confused at this point, and asked him ( 1) what was the nature of his complaint, and (2) what could I do to resolve the situation. Mr. Scruggs told me I knew what his complaint was . I tried to assure him I did not, and asked would he mind telling me specifically. He said I knew that we were harassing him because he was black, and because he was not a resident of Southlake. He said his brother had been stopped without cause by our Police, and said everyone at IBM knows that Southlake Police stop more blacks than others . I tried to explain to him that I did not know he is black until he told me, and that if his wife is black, I did not know. He pshawed, said I was covering for my QW people, asked who I worked for, and told me you would be hearing from him. Captain Jackson was in my office discussing budget items when Mr. Scruggs called (as were several Honorable Mayor and Members of City Council Agenda Item Comments and Other Items of Interest ' June 28, 1991 Page 5 others) . I asked him for a detailed written report on the incident with Mr. Scruggs . It is enclosed for your review. Captain Jackson' s memo explains why there was a delay in getting the automobile released to Mr. Scruggs . Note in Captain Jackson's memo that over the past 14 months, only 3 .2% of the speeding citations issued went to blacks. The total elapsed time it took to get the car released was approximately 15-20 minutes. Our vehicle release procedure is necessary to protect the City and the vehicle owner. While we perhaps could have done something differently, the procedure should not be changed. The real problem appears to be the attitude of Mr. Scruggs . Let me know if you want additional information. I think we can expect Mr. Scruggs to come to a Council meeting. Mrs . Scruggs is recovering from a broken leg. 7 . Fort Worth Water Break. Attached for your review is a memo from Michael Barnes, Director of Public Works, and a letter from Richard Sawey, Director of the Fort Worth Water Department, concerning the water break. 8 . Carroll Avenue Southlake, TX 76092 Dear Mike: I am writing with regard to the revised Preliminary Plat of SouthRidge Lakes which was approved by the City Council on Tuesday, June 18, 1991. Essentially, the City Council approved that future phases of SouthRidge Lakes Parkway would be a road width of 31' in a 60' right-of-way constructed in a curvilinear manner as generally depicted in the attached Preliminary Plat Alternate E revised June 15, 1991. In conjunction, Arvida committed to providing off-Street parking for any house which would face on the Parkway via private drives or direct access from the lot to another city dedicated street such as Brazos, Pecos, Crockett, etc. We obviously have some concerns regarding the attached Plat Review Summary dated March 27, 1991. Specifically, in item #2, none of the plats which were presented to or discussed by Council did Arvida show any additional street connections to Shady Oaks or Peytonville Road. We have no intentions to submit any final plats depicting any additional street connections. Item #5 addresses a 30,000 square foot lot requirement. The lots along Travis Court were originally shown on the Preliminary Plat Alternate A featuring a 125' minimum width adjacent to SF-1 zoning. Although we have modified Travis Court our intention is to maintain the 125' minimum width as approved by the City Council. Our understanding is the 30,000 square foot minimum should not apply since the lots had already received preliminary plat approval. In addition, we will need to review any request for funding the improvements to Peytonville Road from Southlake Boulevard to Raven Bend. To fulfill Arvida's Perimeter Road requirements to the City as a result of changing SouthRidge lakes Parkway from a four lane road to a two lane, Arvida committed to fund the City of Southlake's portion of the improvement of that section of Peytonville Road to a 24' wide road. In no event would Arvida fund more that $100,000 and the estimates we received calculated the city's cost to Mr. Mike Barnes June 21, 1991 Page Two be approximately $90,000. On Tuesday night Mayor Fickes stated that he would look to Arvida to fund "one-half the cost" of improving that section of Peytonville Road and wanted the issue addressed in the Developer's Agreement. We interpret that to mean-that the City will look to Arvida to fund half of the City's cost or approximately $45,000. I believe this covers the main issues we felt needed further clarification. For purposes of this study, Hwy 114 was divided into three sections. Section one consists of eastbound and westbound traffic between the east city limits (3400 block E. ) and the speed zone change just east of FM1709 (2300 block E. ) , which is all a 55 m.p.h. zone. Section two consists of eastbound and westbound traffic between the speed zone change east of FM1709 (2200 block E. ) and the speed zone change just west of Highland (800 block E. ) , which is all a 45 m.p.h. zone. Section three consists of eastbound and westbound traffic between the speed zone change west of Highland (700 block E. ) to the west city limits (900 block W. ) , which is all a 55 m.p.h. zone. Two different time spans were used to verify information. The first time frame addresses all speeding citations issued on Hwy 114 from March 1990 to Date. The second time frame addresses all speeding citations issued for the past 90 days. The records reflect that more citations are issued in the 55 m.p.h. zones than were issued in the 45 m.p.h. zones. They also reflect little change in the average speed for which citations are issued. Curtis E Hawk 114 and Dove Road, and at the intersection of S.H. City secretary: 114 and White Chapel. Preceding this time, the first Sandra L LeGrand traffic light controlled intersection for eastbound traffic entering the City of Southlake on S.H. 114 was located at S.H. 114 and Carroll Road. Prior to December, the established speed limit changed on S.H. 114 approximately 3/10 of a mile west of the intersection of S.H. 114 and Carroll. The speed limit reduced from 55 mph to 45 mph for eastbound traffic approaching the intersection. The speed limit increased for westbound traffic having cleared the intersection. After installation of the traffic control signals at Dove and at White Chapel, I was notified by our traffic enforcement/accident investigation units that consideration should be given to re-addressing the speed limit along this area of S.H. 114. The concern being that for eastbound and westbound traffic, which includes a great many truck-tractor rigs, a 55 mph speed approach to an intersection may tend to reduce the ability of a vehicle to stop or evade an accident. Based upon my telephone conversation with you last week, I did the research work requested and discovered the following statistical information: 1. Thirty-five (35) accidents occurred at White Chapel: 15 major and 20 minor. 5. Fifteen ( 15) accidents occurred at Dove: 7 major and 8 minor. 6 . Of the accidents that occurred at each of the three intersections, the percentage of accidents resulting in injury (major accidents) increased from Carroll (38% major accidents) to White Chapel (43% major accidents) to Dove (47% major accidents) . Several items have been enclosed for your use and information. First, a complete printout of the date and location of all accidents within the City of Southlake from January 1, 1989 to April 30, 1991. Secondly, a photocopy of each of the 71 accidents that occurred on S.H. 114 from Carroll to Dove. Finally, a sketch to help identify the area and proposed speed zone configuration. As I understand, once this information is received by your office, a traffic control engineer or associate will be sent to these locations to identify the "average speed" and assist in determining the appropriate course of action to be taken regarding this matter. Hawk, City Manager FROM: Malcolm Jackson, Police Captain SUBJECT: Complaint by Kenneth Scruggs on Vehicle Release --------------------------------------------------------------- On June 25, 1991, our Department worked a major accident at 600 Davis Boulevard. The summary of the accident is as follows: A pickup truck with a trailer had become disabled and was stopped on the right shoulder of northbound Davis Boulevard. Another northbound vehicle was stopped in the northbound traffic lane waiting to make a left turn. A third vehicle was northbound. This third vehicle driver observed only the vehicle waiting to make the left turn and elected to pass on the right. As the third vehicle was making the passing maneuver, the driver observed the vehicle parked on the shoulder, but was unable to avoid making contact. The impact caused the third vehicle to travel into the southbound lane where it struck a southbound vehicle, 1988 red Hyundai, bearing Texas license 935TGZ . The southbound vehicle was occupied by three persons and is the vehicle about which the complaint generated by Mr. Scruggs . At the time of the accident, responding Officer Randy Robinson, requested the communications dispatcher submit a registration inquiry via computer records with Austin. Those records identified the vehicle as being registered to Carolyn Cooper of 6613 Ridgetop, Watauga, Texas . The driver of the vehicle, initially believed to be Carolyn Cooper, sustained serious injuries and was transported away by Careflite. Detailed information could not be obtained from the driver by Officer Robinson on the scene due to the driver's injuries and rapid transport to a medical facility. Following standard procedure, the vehicle was towed away from the scene by police authorized wrecker service. The name Carolyn Cooper was inserted on the vehicle tow records as being the registered owner and operator of the vehicle. These records were then forwarded to the Communication Records Center. On June 26 , 1991, a subject came to the Police Communications Center and requested a release on the Hyundai. The subject advised that he was the spouse of the victim. Following established procedures, the communications dispatcher requested some type of identification and some proof of ownership. The subject produced a driver's license identifying himself as Kenneth Scruggs of 1534 Barbara, Lewisville, Texas . The dispatcher checked the registration on the vehicle and found no Curtis E. Hawk, City Manager Complaint by Kenneth Scruggs on Vehicle Release June 27, 1991 Page 2 indication that Scruggs had any right to possession of the vehicle. The dispatcher noted that the last name of the person attempting to obtain the vehicle release was different from the name of the registered owner, (Scruggs and not Cooper) , and that the address on the driver's license was different from the address on the vehicle registration records shown on the computer. The dispatcher attempted to obtain some proof of Mr. Scruggs ' right to possess the vehicle, providing suggestions including: insurance papers with his name attached, title or license registration receipts with his name or address, anything with his name and the address of Carolyn Cooper which would support his claim that they live together, a signed release, a marriage license, or any other documentation to indicate some relationship to Carolyn Cooper. Mr. Scruggs became irate and insisted on his being Carolyn Cooper's husband and insisted he had a right to possession, but continued to provide no such proof . The Communication's Supervisor, Daisy Mae Neathery, intervened and attempted to explain the reasoning for the Department's requirement for proof of lawful possessory rights . Mr. Scruggs continued to be irate, raised his voice on numerous occasions and demanded to see another supervisor. At this time I was contacted to review the situation and determine any authorization for release of the vehicle outside of standard procedures . Upon my contact with Mr. Scruggs, I attempted to explain the basis for the procedure requirements and reiterated the need for anything that would support Mr. Scruggs ' claim that he was the husband of Carolyn Cooper, or that he lived at the same address as Carolyn Cooper, or that he had a possessory right to the vehicle. Mr. Scruggs continued to be irate and continued to refuse to provide any such documentation. During the course of my conversation, Officer Robinson, who had worked the initial accident, requested to speak to me about this matter. In private, Officer Robinson advised that he had observed Mr. Scruggs at the scene the night of the accident and had obtained documentation since the time of the initial accident investigation which indicated a driver's license in the name of Carolyn Scruggs with the maiden name of Cooper. This documentation was a computer return from Austin which indicated that Carolyn Cooper had a driver's license in the name of Carolyn Scruggs . Since the accident report was not yet complete, the report had not been forwarded to the Curtis E. Hawk, City Manager Complaint by Kenneth Scruggs on Vehicle Release June 27 , 1991 Page 3 Communication Records Center. Therefore, the communications dispatcher had no way of knowing this information at the time Mr. Scruggs requested the release. Upon my review of this "new found" documentation, I returned to Mr. Scruggs and advised him of the documentation and our subsequent intent to immediately release the vehicle to him. I then instructed the dispatcher to provide Mr. Scruggs with the necessary paperwork to permit him to retrieve the vehicle from the wrecker service. Mr. Scruggs continued to be irate, requested the name of the Mayor, which I immediately provided him, and indicated that he was dissatisfied with the procedures and precautions taken by the Department. I advised Mr. Scruggs that the vehicle was being released based upon the confirmation documentation. Mr. Scruggs thanked Officer Robinson for his assistance, obtained his vehicle release and departed. During my review of our procedures and the circumstances surrounding this incident, I contacted Officer Buddy Sanders . Officer Sanders had been called to the scene to assist in the accident investigation, due to his specialized training in accident investigation and reconstruction. Officer Sanders advised that on the morning of June 26 he spoke with a subject by telephone. This person identified himself to Officer Sanders as being Kenneth Scruggs . Mr. Scruggs asked about the location of the vehicle and the procedures necessary to obtain a release. Officer Sanders asked Mr. Scruggs if he was the owner of the vehicle. Mr. Scruggs advised he was the owner. Officer Sanders advised Mr. Scruggs that all he needed was some proof of ownership and identification, and suggested use of a title or license registration receipt . Mr. Scruggs advised Officer Sanders that the registration paperwork was located in the vehicle. Officer Sanders advised that if he was the registered owner of the vehicle the Communications Center could verify the registration by computer inquiry and release the vehicle with Mr. Scruggs ' positive identification. Consequently, Mr. Scruggs had knowledge, prior to his arrival at the Police Department, that a comparison would be made between the registration information and Mr. Scruggs ' identification. Yesterday, June 26, 1991, I was in your office when Mr. Scruggs called your office regarding a complaint on our release procedure. You indicated that Mr. Scruggs felt he had been harassed because he is black and because he is not a resident of Southlake. Curtis E. A review of all citations issued for the past 141months was conducted. Of 9 ,517 citations issued, only 309 or ( 3 . 2%) were issued to blacks . Of those same 9 ,517 citations ( 14 . 6%) or 1, 398 were issued to Southlake residents . These numbers alone speak for themselves . Additional documentation related to the accident involving the Scruggs ' vehicle, as well as some general information documentation, is also attached and provided to you for your review. The criminal history information and extensive driving history is CONFIDENTIAL and cannot be released, but is attached separately for your review purposes . The procedures the Department undertakes to ensure that only those individuals which have a possessory interest right to the vehicle have protected the Department and the City in the past from potential civil litigation arising from any inappropriate or unlawful release. On several occasions, repossession companies and other unauthorized persons have attempted to obtain releases on vehicles towed by the Department. Had our procedures not been established or had they not been followed and the vehicles been released to those unauthorized persons, the Department and the City could have been liable to the owner of those vehicles . Therefore, we continue our practice of requiring proof of ownership or proof of right to possession before releasing any vehicle towed by the Department. Barnes , P.E . , Director of Public Works SUBJECT: FORT WORTH WATER BREAK REPORT ------------------------------------------------------------- On Monday, June 17 , 1991 , at approximately 1 : 30 p.m. the Fort Worth Water Department notified us that we needed to reduce the volume of water that was pumped to Southlake and Keller over the weekend by 50% because of a water leak in the 48" water main that feeds Southlake and Keller. Fort Worth indicated if we reduced consumption by 50% or 3 MGD, they would be able to repair the leak and continue supplying us with water. They predicted that the leak would be repaired by Tuesday midnight. As a precaution, we pumped water from the ground storage tank ( 300, 000 gallon tank) at White ' s Chapel into the distribution system so that the wells (Trinity and Puluxy) could start refilling the tank. It takes approximately 10 hours to fill the ground storage tank from the two wells and approximately 3 hours to pump into the system. (During the crisis period--6 : 00 p.m. Monday to 12 : 00 midnight Wednesday--we continued to pump from the two wells, for a total of approximately 900 , 000 gallons . ) At approximately 2 : 00 a.m. Tuesday, June 18th, Ron Morain received a call from Fort Worth informing him that the leak was worse than expected and that immediate rationing was to be put into effect. Usage was to be reduced to sanitary and drinking purposes only. Fort Worth predicted that it would be sometime Thursday before full pumping would be restored. Tuesday afternoon the Mayor issued an emergency mandate for water rationing. A letter was hand delivered to the residents Tuesday afternoon informing them of the mandatory rationing for sanitary and drinking purposes only. Tuesday night the Council enacted the emergency ordinance, which effectively gave us enforcement capabilities . During the crisis period, we had "sprinkler patrols" out insuring that residents complied with the rationing. Only one citation was issued for violating the mandate. Express Concrete was issued a citation for using 1, 000 gallons of water in a 4-hour period on Wednesday, June 19 , after they were instructed to comply with the emergency ordinance. Express Concrete was issued the citation only after they Curtis E. The meter was read at the time they were warned, and read prior to being issued a citation. They claimed that they had a leak, but it did not check out . / During the crisis period, Fort Worth was able to pump some water to the North Beach Pump Station (approximately 300, 000 to 500, 000 gallons ) , but we allowed all of that water to be pumped to Keller because they were out of water. On Monday, June 17 , our two 1 . 5 million gallon tanks had approximately 2 , 500 , 000 gallons and on Wednesday at midnight the capacity had reduced to 600 , 000 gallons . Fort Worth had the leak repaired late Wednesday afternoon and had their system charged so Southlake could start pumping water into the system by midnight Wednesday. We waited until Thursday to declare the emergency over because of the time lag between when the Fort Worth 48" line began transporting water, to the time our system began receiving water, to the time our normal capacity was restored. We were concerned that too many people would perceive the crisis over once the media announced the repairs would be made Wednesday night . Indeed, the tanks were lowered significantly Wednesday night . Thursday morning the City tanks had approximately 1 , 500, 000 gallons . We notified the news media Thursday afternoon that customers could resume normal use. Since the media had covered the crisis closely, we though this would be sufficient to get notice to the community. Enough people called us Friday morning to convince us that some were not aware that the water crisis was over. Any person, firm or corporation who violates , iisobeys , omits , neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ( $2 , 000 . 00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. Section 8 . I am a general and vascular surgeon and currently practice in northeast Tarrant County including offices in Baylor Medical Center at Grapevine, North Hills Medical Center in North Richland Hills and Harris Methodist HEB in Euless. I recently purchased some land in the city of Southlake and closed on this purchase on March 27, 1991. This land is located in the B.J. Foster survey, abstract No. 519 and includes lots 1B1, 1B2, and 1B3 and totals approximately ten acres. My wife and I have chosen Southlake as our permanent residence and plan to live here for the rest of our lives. This was done because of its proximity to my three main places of workw In addition, when I initially evaluated this land purchase I spent considerable time in the planning and zoning office with Karen Gandy and was under the understanding that the proposed land around me would be planned for either low or medium density land use. My land is currently zoned agricultural. I have not applied for change in zoning or replatting because I have up until this point not felt it necessary to proceed with this as yet. However, I do have an architect under contract and am currently producing plans that will lead to the building of a single family dwelling on the proposed property. In a recent planning and zoning meeting the rezoning of the land involved in Myers Meadow was discussed. Prior to this meeting all property owners with land adjacent to this proposed development were notified-but for reasons I am unclear of I was not notified. I believe this is because the ownership of this land has not changed on the Tarrant County district list. I attended that meeting and during this meeting certain concessions were made to the owners of property in the Cross Timbers residential development in order to create a transition zone between their one acre lots and the proposed development. I am sure you are aware of the exact details of these concessions as Greg Last has assured me they are included in your packet. However, during this meeting-although I did plead my case before the planning and zoning commission-no action was taken specifically regarding my property boundaries. The impression I received from the commission is that my property did not qualify for such concessions because of its current zoning. I would like to plead my case before the council to receive at least the same concessions that may be granted to residents of Cross Timbers. It is by no fault of my own that I was not notified of the proposed planning and zoning meeting until it was too late to apply myself for a change in zoning and replatting of my property. I am currently in the process of applying for replatting and zoning to correct this d6ficiency. I hope the council will take into the consideration the above mentioned events when ruling on what the final lot restrictions will be for properties that will border my property as well as that of the Cross Timber residents. WHEREAS, the City of ake, Texas . is a homerule City acting under its Charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Texas Local Government Code; and, WHEREAS, pursuant to Chapter 11 of the Local Government Code, the City has the authority to adopt a comprehensive zoning ordinance and map regulating the location and use of buildings, other structures and land for business, industrial, residential and other purposes, and to amend said ordinance and map for the purpose of promoting the public health, safety, morals and general welfare, all in accordance with a comprehensive plan; and WHEREAS, the hereinafter described property is currently zoned as 11C-2" Commercial-2 under the City' s Comprehensive Zoning Ordinance; and WHEREAS, a change in the zoning classification of said property was requested by a person or corporation having a proprietary interest in said property; and WHEREAS, the City Council of the City of Southlake, Texas, at a public hearing called by the City Council did consider the following factors in making a determination as to whether these changes should be granted or denied: safety of the motoring public and the pedestrians using the facilities in the area immediately (aw surrounding the sites; safety from fire hazards and damages; noise V-0- '- t producing elements and glare of the vehicular and stationary lights and effect of such lights on established character of the neighborhood; location, lighting and types of signs and relation of signs to traffic control and adjacent property; street size and adequacy of width for traffic reasonably expected to be generated by the proposed use around the site and in the immediate neighborhood; adequacy of parking as determined by requirements of this ordinance for off-street parking facilities; location of ingress and egress points for parking and off-street loading spaces, and protection of public health by surfacing on all parking areas to control dust; effect on the promotion of health and the general welfare; effect on light and air; effect on the over-crowding of the land; effect on the concentration of population; and effect on transportation, water, sewerage, schools, parks and other public facilities; and, WHEREAS, the City Council of the City of Southlake, Texas, further considered among other things the character of the districts and their peculiar suitability for particular uses and the view to conserve the value of the buildings, and encourage the most appropriate use of the land throughout this City; and, WHEREAS, the City Council of the City of Southlake, Texas, does find that there is a public necessity for the zoning changes, that the public demands them, that the public interest clearly requires the amendments, and that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and, WHEREAS, the City Council of the City of Southlake, Texas, does find that the changes in zoning lessen the congestion in the streets, helps secure safety from fire, panic, and other dangers, promotes the health and the general welfare, provides adequate light and air, prevents the over-crowding of land, avoids undue concentration of population, and facilitates thedequate and otherovision of transportation, water, sewerage, schools, parks ic requirements; and, WHEREAS, the City Council of the City of Southlake, Texas, has determined that there is a necessity and need for the changes in zoning and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the tract or tracts of land requested for a change since the tract or tracts of land were originally classified and therefore feels that the respective changes in zoning classification for the tract or tracts of land are needed, are called for, and are in the best interest of the public at large, the citizens of the City of Southlake, Texas, and helps promote the general health, safety and welfare of the community. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: 8D- -2- Section 1 . That Ordinance No. 480, the Comprehensive Zoning Ordinance of the City of Southlake, Texas, passed on the 19th day of September, 1989 , as originally adopted and amended, is hereby amended so that the permitted uses in the hereinafter described areas be altered, changed and amended as shown and described below: Being approximately a 0 .48 acre tract of land out of the Francis Throop Survey, Abstract No. 1511, Tract 4B1, and more fully and completely described in Exhibit "A, " attached hereto and incorporated herein. From "C-2" Commercial-2 District to "SF-20B" Single Family-20B Residential Zoning District. Section 2 . That the City Manager is hereby directed to correct the Official Zoning Map of the City of Southlake, Texas, to reflect the herein changes in zoning. Section 3 . That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said Zoning Ordinance and all other applicable and pertinent ordinances for the City i yf Southlake, Texas . All existing sections, subsections, paragraphs, sentences, words, phrases and definitions of said Zoning Ordinance are not amended hereby, but remain intact and are hereby ratified, verified and affirmed. Section 4 . That the zoning regulations and districts as herein established have been made in accordance with the r comprehensive plan for the purpose of promoting the health, safety, morals and the general welfare of the community. They have been designed, with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets; to provide adequate light and air; to prevent over-crowding of land; to avoid undue concentration of population; and to facilitate the adequate provision of transportation, water, sewerage, drainage and surface water, parks and other commercial needs and development of the community. They have been made after a full and complete hearing with reasonable consideration among other things of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. Section 5 . That this ordinance shall be cumulative of all other ordinances of the City of Southlake, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. Section 6 . That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land (aw described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of said tract or tracts of land described herein. yr,>-7 -3- Section 7 . Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ( $2, 000 . 00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. Section 8 . All rights and remedies of the City of Southlake are expressly saved as to any and all violations of the provisions of Ordinance No. 480, as amended, or any other ordinances affecting zoning which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts . Section 9 . The City Secretary of the City of Southlake is hereby directed to publish the proposed ordinance or its caption and penalty together with a notice setting out the time and place for a public hearing thereon at least ten ( 10) days before the second reading of this ordinance, and if this ordinance provides for the imposition of any penalty, fine or forfeiture for any violation of any of its provisions, then the City Secretary shall additionally publish this ordinance in the official City newspaper one time within ten ( 10) days after passage of this ordinance, as required by Section 3 . 13 of the Charter of the City of Southlake. Section 10 . This ordinance shall be in full force and effect form and after its passage and publication as required by law, and it is so ordained.
