Subject: Award of bid for the construction of concrete pavement replacement in the
Timberlake, Southview, and Myers Meadows Additions.
Action Requested: Award of bid to SRO General Contractors of Fort Worth, Texas for the
construction of concrete pavement replacement in the Timberlake,
Southview, and Myers Meadows Additions.
Background
Information: The Council approved pavement replacement project in the FY 2000/2001
CIP for various locations. Staff has identified areas in need of
replacement in the Timberlake, Southview, and Myers Meadows
subdivisions, and has entered into a professional services agreement with
Cheatham & Associates to prepare the contract documents. The exact
locations are identified in the attached project maps.
The contract time for completion of the work is 45 calendar days.
Bids were received on May 22, 2001. Seven bids were received, with
SRO General Contractors being the low bidder. The bids have been
reviewed by Cheatham & Associates and City Staff, and are tabulated as
follows:

Consideration: The bid amount is within the budget for this project when combined with

budget funds to add areas in need of replacement to this contract or for the
unanticipated project contingencies as the need arises. Therefore, the total

Background
Information: Funds were appropriated in FY 2000/2001 CIP for the purchase of
"10 solar powered flashing beacons" for school zones. Six will be
available for the two new schools opening this fall, two for the
Carroll Middle School and also one to replace the one that has
been damaged by accident.
Bids were received on May 8, 2001. Four bids were received, with

Subject: Award of bid to SRO General Contracting, Inc. for the construction of TMB
intersection improvements to South Carroll Avenue at FM 1709 and
Brumlow Avenue at SH 26.
Action Requested: Award of bid to SRO General Contracting, Inc. for the construction of
TMB intersection improvements to South Carroll Avenue at FM 1709 and
Brumlow Avenue at SH 26.
Background
Information: The two referenced intersection improvements were approved by voters as
part of the Traffic Management Bond Program (TMB) in May 1999.
Subsequently, HNTB Corporation has prepared construction plans and
specifications for the projects. These two intersections were selected to
become the next two TMB projects to complete based on the severity of
delay experienced by motorists. Staff decided to bid both intersections as
one project in an effort to make the project more attractive to contractors.
Bids were previously received for this project on April 17, 2001, and the
Council rejected the single bid submitted by AUI General Contractors in
the amount of $2,525,252.52. Since that time, staff and HNTB have made
a significant effort to make area contractors aware of the project, and
subsequently re -advertised.
The second time, five (5) bids were received, with SRO General
Contracting, Inc. being the low bidder. The bids have been reviewed by
HNTB and City Staff, and are tabulated as follows:

Subject: Approve the Professional Services agreement with Halff Associates for the
design of Johnson Road Rehabilitation project from Pearson Lane to Randol
Mill.
Action Requested: Approve the Professional Services Agreement with Halff Associates of
Fort Worth, Texas for the design of Johnson Road Rehabilitation project
from Pearson Lane to Randol Mill.
Background
Information: On February 20, 2001 the City Council approved the conceptual design of
Johnson Road from several alternatives that were researched and presented
by Halff Associates. The alternative selected involved the rehabilitation of
the existing two-lane roadway, and providing left turn lanes at the
intersections of Pearson Lane and Randol Mill. The original agreement
with Halff Associates was to provide a tree and right-of-way survey and a
schematic design of several alternatives from which the city could select
the most appropriate design. This preliminary work has been performed
because of the sensitive conditions surrounding the Johnson Road
corridor, primarily the presence of many trees located very close to the
existing pavement. The agreement is for the completion of the design and
preparation of plans and specifications, including street, drainage, water,
and sanitary sewer improvements. The time frame for completion of the
design allows for an estimated bid award of the construction project of
mid January 2002.
Financial
Consideration: Compensation for these services totals $153,500 and is funded from each
of the project line items in the FY 2000/2001 CIP.

residence.

in Bicentennial Park and approval of Change Order No. 1, reducing the size of
canopy for Fields #8 and #9
Action Requested: City Council approval for award of bid for construction of shade structures
for baseball fields in Bicentennial Park and approval of Change Order No. 1
Background
Information: As previously approved by SPDC through a matching funds request from
the Southlake Baseball Association, this project involves the design,
purchase, and installation of bleacher shade structures on Bicentennial Park
baseball fields #4, #5, #6, #7, #8, #9, and #10. The shade structures would
consist of a powder coated pole support structure covered with a UV shade
fabric. The fabric will be similar to that used on the existing shade
structures at the Bob Jones Park soccer fields and the Southlake Tennis
Center. The recommended fabric colors of burgundy and forest green will
match the existing dugout shade covers.
The proposed shade structures were estimated to cost $130,000 and would
provide much needed relief from the summer sun for numerous spectators,
players, coaches, and officials. The construction timeline, should the
project be approved, would provide for an estimated completion date of July
2001.
The City received and opened one bid on April 17, 2001, in accordance with
state bidding procedures. The bid on the project was submitted by Sun
Ports International in the amount of $133,735, slightly over the approved
budget of $130,000. Staff met with Sun Ports International and developed a
reduced scope of work that would bring the project within budget while
maintaining the integrity of the project. Essentially, with the
implementation of Change Order No. 1, the shade structures for fields #8
and #9 would be reduced in size. The shade structures would still cover all
of the seating area but would be reduced in size over the pedestrian plaza by
approximately 1,178 square feet. Staff reviewed these changes with the
Southlake Baseball Association and they concur with the proposed change
order.
Sun Ports International is a well-known shade structure installation firm with
a reputation for providing professional, quality workmanship. They have

completed work for such entities as the City of Southlake, City of Hurst,
City of Highland Village, the City of Houston, and the City of Fort Worth.
Financial
Considerations: Matching funds in the amount of $65,000 (total project budget $130,000)
have been approved as part of the FY2000/01 SPDC Matching Funds
Program. Change Order No. 1 would reduce the scope of the contract by
$12,000 from $133,735 to $121,735. In addition, project construction
contingency in the amount of $8,000 (6.5 % of the project) is requested to
cover unforeseen costs arising from the project, as well as the purchase and
installation of SPDC recognition plaques.
Citizen Input/
Board Review: Staff met on December 15, 2000, with members of the Southlake Baseball
Association to review the proposed shade structure project.
The Parks and Recreation Board recommended approval of SBA's Matching
Funds request at their January 8, 2001 meeting (5-0).
SPDC approved the matching funds request at their January 22, 2001
meeting (6-0) .
The Parks and Recreation Board approved the design of the shade structures
at their March 19, 2001 meeting (6-0).
City staff reviewed the proposed change order No. 1 with Bill Stroope,
President of the Southlake Baseball Association, on April 19, 2001. Mr.
Stroope was in agreement with the proposed changes.
SPDC approved the award of bid and Change Order No. 1 (6-0) at their
meeting of April 23, 2001.

1. Provide the following regarding the equipment building:

2. Location, type, and height of all walls, fences, and screening devices. Tower facilities shall be
enclosed by an eight (8) foot, solid screening fence or masonry wall or a wrought iron fence with
an eight (8) foot evergreen hedge. The facilities shall be landscaped with a buffer of plant
materials that effectively screens the view of the tower compound (Section 45.8(d)(8)(b)). The
Site Plan indicates an existing 7' high chain -link fence with 12" barbwire on top (8' total height)
with screening slats installed. The fence does not comply with the ordinance. A variance has
been requested. (See Attachment E, p. 3)
3. An opaque wood fence separates the business park from the agricultural land to the north
designated for residential use.
Other Conditions of Approval
a) Documentation of FAA approval shall be provided when towers are near public airports or
flight paths.
b) The applicant shall provide the city with a certificate of insurance, issued by an insurance
company licensed to do business in the state of Texas indicating that the applicant carries
comprehensive general liability insurance with limits of liability thereunder of not less than:

bodily injury: $500,000 for injury to any one person and $1,000,000 for all injuries sustained
by more than one person in any occurrence; property damage: $1,000,000 for damage as a
result of any one accident. The applicant shall provide the city with a renewal certificate
within then (10) business days of each renewal. Any insurance required to be provided by
the applicant herein may be provided by a blanket insurance policy covering this property
and other locations occupied by the applicant, provided such blanket insurance policy
complies with all of the other requirements as to the type and amount of insurance required.
The applicant may also fulfill the requirements under this section through a program of self-
insurance, subject to approval by the city, which approval shall not be unreasonably
withheld. If the applicant elects to self -insure, then the applicant shall furnish the city with
a letter stating that there is a self-insurance program in effect that provides for the same, or
greater, coverage than required of the applicant herein. The applicant agrees to furnish the
city with certificate of insurance certifying that the applicant has in force and effect the
above specified insurance. The certificate and renewal certificates shall provide that
insurance shall not be canceled or changed unless 30 days' prior written notice is just given
to the city.
c) Each backhaul provider shall be identified and have all necessary franchises, permits, and
certificates. The identity of other providers who co -locate to the site and their backhaul
providers shall be provided as well.
d) No lettering, symbols, images, or trademarks large enough to be legible to occupants of
vehicular traffic on any adjacent roadway shall be placed on, or affixed to, any part of a
telecommunications tower, platform, antenna or ancillary structure.
e) All construction shall comply with all ordinances of the city not in conflict with this section.
f) In addition to the usual application fees for rezoning or specific use permit requests, the
applicant shall reimburse the city the actual cost of professional services, provided by an
engineer or other professional, that may be required to review the application and provide
expertise.
g) If high voltage is necessary, signs shall be posted every 20' on any exterior fencing
which state, "Danger --High Voltage." The operator shall also post "No Trespassing" signs.

a) The owner of a tower and/or related telecommunications facilities shall notify the Building
Official when the tower or other structures have ceased operating as part of a
telecommunications system authorized by the FCC. Within six (6) months of the date the
tower ceases to operate as part of an authorized telecommunications system, the tower must
either be removed from the site, or a certificate of occupancy must be obtained to allow
another permitted use of the tower. If within six (6) months, the owner fails to remove the
tower or obtain proper authorization for the use of the tower, the Building Official shall
revoke the certificate of occupancy for the tower and notify the city attorney to pursue
enforcement remedies.
b) Tower owner(s) shall bear all demolition costs.
* Interference
Any signal interference complaints associated with telecommunications towers or related equipment
shall be addressed in accordance with FCC rules and procedures.

SPECIFIC USE PERMIT FOR CO -HABITATION ON EXISTING TOWER
Masonry Requirements Ordinance No. 557
Ordinance No. 557 requires that all buildings in an S-P-1 District and Industrial,
as the request is zoned to be constructed of a masonry material along any street
frontage. The request is further restricted by its location as contained in the
Residential Adjacency Standards in Section 43. This requirement includes the
use of masonry on all walls and prohibits the use concrete tilt wall construction.
The request site is located in a commercial/industrial area. The predominant
architecture in the area is tilt wall concrete and other masonry materials. The site
is presently developed with another small equipment building, which was placed
on the site at the time of the original tower construction. The proposed
equipment building is approximately 1/3 a floor area of the existing structure and
about two feet taller. The exterior material of each will be the same — concrete.
The building on the same site as the proposed expansion has an exterior
material of metal siding.
The requested variance to the Masonry Requirements as specified in both
Ordinance No. 557 and Section 43 should be granted because the building
material is compatible with the surrounding developed properties and is an
addition to an existing project which does not meet the requirements of the
ordinance. Furthermore, the requested variance will not be detrimental and is
compatible with the surrounding properties.

Variance to Section 43.13 b. Roof Design Standards
The proposed co -habitation includes the construction of a 10' x 12' concrete
equipment building. The proposed building will be approximately 11' in height.
The building will have a very slight pitched roof in order to facilitate the drainage
of water from the roof. This pitch will not meet the requirements specified in
Section 43.13 b for Roof Design Standards. The small size of the building and
the construction type — concrete tilt wall- severally limits the ability to provide a
pitched roof. There will be no equipment on the roof of the structure.
The proposed roof pitch complies with the harmony of the spirit of the ordinance
and the granting of a variance will not have a detrimental effect on the
surrounding properties.

Screening — Section 45.8(d)8b.
Section 45.8(d)8b requires that an eight solid screening fence or masonry wall
enclose tower facilities. The existing tower and equipment building are enclosed
within an area surrounded by a seven -foot high fence with slats. The fence was
constructed as per the previously approved Site Plan. The proposed building will
be approximately 110 feet from the right of way for Greenwood Drive to the north.
The proposed building is located approximately 220 feet from Greenwood Drive
to the west. The building is further hidden from the surrounding streets by the
existing larger building on the site and by the buildings located on adjacent lots.
Greenbriar Drive, south of the site, is approximately 200 feet away. The
proposed equipment would be screened from Greenbriar by the existing fence
and the change in elevation from Greenbriar and the site.
The existing seven foot fence in conjunction with the location of existing
structures both on and offsite more than adequately screen the proposed
equipment building from the surrounding streets. A variance to the screening
requirements in order to allow the previously approved fence at a height of seven
feet is compatible with the surrounding uses and is in harmony with the spirit and
purpose of Section 45.8(d)8b.

THOMAS M. HOOD SURVEY, ABSTRACT NO. 706, AND BEING 1.00
ACRE, AND MORE FULLY AND COMPLETELY DESCRIBED IN
EXHIBIT "A" FROM "AG" AGRICULTURAL DISTRICT TO "R-PUD"
RESIDENTIAL PLANNED UNIT DEVELOPMENT DISTRICT AS
DEPICTED ON THE APPROVED CONCEPT PLAN, INCLUDING PUD

WHEREAS, the City of Southlake, Texas is a home rule City acting under its Charter
adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter
9 of the Texas Local Government Code; and,
WHEREAS, pursuant to Chapter 211 of the Local Government Code, the City has the
authority to adopt a comprehensive zoning ordinance and map regulating the location and use of
buildings, other structures and land for business, industrial, residential and other purposes, and to
amend said ordinance and map for the purpose of promoting the public health, safety, morals and
general welfare, all in accordance with a comprehensive plan; and
WHEREAS, the hereinafter described property is currently zoned "AG" Agricultural
District under the City's Comprehensive Zoning Ordinance; and
WHEREAS, a change in the zoning classification of said property was requested by a

person or corporation having a proprietary interest in said property; and
WHEREAS, the City Council of the City of Southlake, Texas, at a public hearing called by
the City Council did consider the following factors in making a determination as to whether these
changes should be granted or denied: safety of the motoring public and the pedestrians using the
facilities in the area immediately surrounding the sites; safety from fire hazards and damages; noise
producing elements and glare of the vehicular and stationary lights and effect of such lights on
established character of the neighborhood; location, lighting and types of signs and relation of signs
to traffic control and adjacent property; street size and adequacy of width for traffic reasonably
expected to be generated by the proposed use around the site and in the immediate neighborhood;
adequacy of parking as determined by requirements of this ordinance for off-street parking facilities;
location of ingress and egress points for parking and off-street loading spaces, and protection of
public health by surfacing on all parking areas to control dust; effect on the promotion of health ad
the general welfare; effect on light and air; effect on the over -crowding of the land; effect on the
concentration of population, and effect on transportation, water, sewerage, schools, parks and other
public facilities; and,
WHEREAS, the City Council of the City of Southlake, Texas, further considered among
other things the character of the districts and their peculiar suitability for particular uses and the
view to conserve the value of the buildings, and encourage the most appropriate use of the land
throughout this City; and,
WHEREAS, the City Council of the City of Southlake, Texas, does find that there is a
public necessity for the zoning changes, that the public demands them, that the public interest clearly
requires the amendments, and that the zoning changes do not unreasonably invade the rights of those
who bought or improved property with reference to the classification which existed at the time their

original investment was made; and,
WHEREAS, the City Council of the City of Southlake, Texas, does find that the changes
in zoning lessen the congestion in the streets, helps secure safety from fire, panic, and other dangers,
promotes the health and the general welfare, provides adequate light and air, prevents the over-
crowding of land, avoids undue concentration of population, and facilitates the adequate provision
of transportation, water, sewerage, schools, parks and other public requirements; and,
WHEREAS, the City Council of the City of Southlake, Texas, has determined that there is
a necessity and need for the changes in zoning and has also found and determined that there has been
a change in the conditions of the property surrounding and in close proximity to the tract or tracts
of land requested for a change since the tract or tracts of land were originally classified and therefore
feels that the respective changes in zoning classification for the tract or tracts of land are needed,
are called for, and are in the best interest of the public at large, the citizens of the city of Southlake,
Texas, and helps promote the general health, safety and welfare of the community.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SOUTHLAKE, TEXAS:
SECTION 1.
That Ordinance No. 480, the Comprehensive Zoning Ordinance of the City of Southlake,
Texas, passed on the 19th day of September, 1989, as originally adopted and amended, is hereby
amended so that the permitted uses in the hereinafter described areas be altered, changed and
amended as shown and described below:
Being Tract 2C1A in the Thomas M. Hood Survey, Abstract No. 706, and being 1.00
acre, and more fully and completely described in Exhibit "A" from "AG"
Agricultural District to "R-PUD" Residential Planned Unit Development District as
depicted on the approved Concept Plan, including PUD development standards,
attached hereto and incorporated herein as Exhibit `B", and subject to the specific
conditions established in the motion of the City Council and attached hereto and

incorporated herein as Exhibit "C."
SECTION 2.
That the City Manager is hereby directed to correct the Official Zoning map of the City of
Southlake, Texas, to reflect the herein changes in zoning.
SECTION 3.
That in all other respects the use of the tract or tracts of land herein above described shall
be subject to all the applicable regulations contained in said Zoning Ordinance and all other
applicable and pertinent ordinances for the City of Southlake, Texas. All existing sections,
subsections, paragraphs, sentences, words, phrases and definitions of said Zoning Ordinance are not
amended hereby, but remain intact and are hereby ratified, verified, and affirmed.
SECTION 4.
That the zoning regulations and districts as herein established have been made in accordance
with the comprehensive plan for the purpose of promoting the health, safety, morals and the general
welfare of the community. They have been designed, with respect to both present conditions and
the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the
streets; to provide adequate light and air; to prevent over -crowding of land; to avoid undue
concentration of population; and to facilitate the adequate provision of transportation, water,
sewerage, drainage and surface water, parks and other commercial needs and development of the
community. They have been made after a full and complete hearing with reasonable consideration
among other things of the character of the district and its peculiar suitability for the particular uses
and with a view of conserving the value of buildings and encouraging the most appropriate use of
land throughout the community.

That this ordinance shall be cumulative of all other ordinances of the City of Southlake,
Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those
instances where provisions of those ordinances are in direct conflict with the provisions of this
ordinance.
SECTION 6.
That the terms and provisions of this ordinance shall be deemed to be severable and that if
the validity of the zoning affecting any portion of the tract or tracts of land described herein shall
be declared to be invalid, the same shall not affect the validity of the zoning of the balance of said
tract or tracts of land described herein.
SECTION 7.
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply
with or who resists the enforcement of any of the provisions of this ordinance shall be fined not
more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation is
permitted to exist shall constitute a separate offense.
SECTION 8.
All rights and remedies of the City of Southlake are expressly saved as to any and all
violations of the provisions of Ordinance No. 480, as amended, or any other ordinances affecting
zoning which have accrued at the time of the effective date of this ordinance; and, as to such accrued
violations and all pending litigation, both civil and criminal, whether pending in court or not, under
such ordinances, same shall not be affected by this ordinance but may be prosecuted until final
disposition by the courts.
SECTION 9.
The City Secretary of the City of Southlake is hereby directed to publish the proposed

(W ordinance or its caption and penalty together with a notice setting out the time and place for a public
hearing thereon at least ten (10) days before the second reading of this ordinance, and if this
ordinance provides for the imposition of any penalty, fine or forfeiture for any violation of any of
its provisions, then the City Secretary shall additionally publish this ordinance in the official City
newspaper one time within ten (10) days after passage of this ordinance, as required by Section 3.13
of the Charter of the City of Southlake.
SECTION 10.
This ordinance shall be in full force and effect from and after its passage and publication as
required by law, and it is so ordained.

amended hereby, but remain intact and are hereby ratified, verified, and affirmed.
SECTION 4.
That the zoning regulations -and districts as herein established have been made in accordance
with the comprehensive plan for the purpose of promoting the health, safety, morals and the general
welfare of the community. They have been designed, with respect to both present conditions and
the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the
streets; to provide adequate light and air; to prevent over -crowding of land; to avoid undue
concentration of population; and to facilitate the adequate provision of transportation, water,
sewerage, drainage and surface water, parks and other commercial needs and development of the
community. They have been made after a full and complete hearing with reasonable consideration
among other things of the character of the district and its peculiar suitability for the particular uses
and with a view of conserving the value of buildings and encouraging the most appropriate use of
land throughout the community.

That this ordinance shall be cumulative of all other ordinances of the City of Southlake,
Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those
instances where provisions of those ordinances are in direct conflict with the provisions of this
ordinance.
SECTION 6.
That the terms and provisions of this ordinance shall be deemed to be severable and that if
the validity of the zoning affecting any portion of the tract or tracts of land described herein shall
be declared to be invalid, the same shall not affect the validity of the zoning of the balance of said
tract or tracts of land described herein.
SECTION 7.
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply
with or who resists the enforcement of any of the provisions of this ordinance shall be fined not
more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation is
permitted to exist shall constitute a separate offense.
SECTION 8.
All rights and remedies of the City of Southlake are expressly saved as to any and all
violations of the provisions of Ordinance No. 480, as amended, or any other ordinances affecting
zoning which have accrued at the time of the effective date of this ordinance; and, as to such accrued
violations and all pending litigation, both civil and criminal, whether pending in court or not, under
such ordinances, same shall not be affected by this ordinance but may be prosecuted until final
disposition by the courts.

The City Secretary of the City of Southlake is hereby directed to publish the proposed
ordinance or its caption and penalty together with a notice setting out the time and place for a public
hearing thereon at least ten (10) days before the second reading of this ordinance, and if this

its provisions, then the City Secretary shall additionally publish this ordinance in the official City
newspaper one time within ten (10) days after passage of this ordinance, as required by Section 3.13

TRANSPORTATION
ASSESSMENT: Master Thoroughfare Plan
The Master Thoroughfare Plan recommends Randol Mill Avenue to
be a 5-lane, undivided arterial with 94' of right-of-way. Adequate
right-of-way is being dedicated for the future expansion of this road.
Existing Area Road Network and Conditions
The proposed site will have one (1) access directly onto the east -west
portion of Randol Mill Avenue. This drive is existing. Currently, a
residential driveway exists with access onto the north -south portion
of Randol Mill Avenue. This drive will be removed prior to
Certificate of Occupancy.
Randol Mill Avenue is a two-lane, undivided roadway that generally
runs north to south. It turns 90 degrees at the northwest corner of this
site.

following variances need council action:
• The storage length (stacking) required by the Driveway Ordinance. The
stacking required for the north drive is 28 feet (Ord. 634, Section 5.2(d)).
The stacking depth measured is 25'.
• Commercial driveway on a local or collector street. The Driveway
Ordinance (Ord. 634, Section 5.2(c)) states that commercial, multi-
family, and service driveways shall not be permitted on collector or local
streets unless the tract or lot has no other public access.
Under the "S-P-l" Site Plan District zoning the applicant proposes the
following:
• This site shall permit "O-l" Office District uses according to Zoning
Ordinance No. 480, Section 18 with the exception of the following
deleted uses: Banking; Bill Paying services; Chiropractors; Dentists;
Duplication and mailing services; Optometrists; Physicians; Podiatrists;

I.. DEVELOPMENT REGULATIONS
4. The applicant is requesting "S-P-1" zoning. The proposed development regulations for Secure
Source, Inc. differ from regulations found in the Zoning Ordinance No. 480 on the following: (as
compared to the "O-l" Office District)
a. Pavements and internal driveways cannot encroach into a bufferyard (Section 42.10). The
parking located in the north part of the property is encroaching the 5' Type `A' bufferyard
adjacent to Randol Mill Ave. The proposed development regulation will allow the existing
parking area on the North side of the property to remain and encroach into the required
bufferyard as shown on the Site Plan.
b. Compliance with the articulation regulations, found in the residential adjacency overlay, is
required for all zoning change requests (Section 43.13(d)). The South side of the larger
building and all sides of the smaller building do not comply with the horizontal or vertical
articulation requirements. The proposed "S-P-1" Development Regulations allow the
articulation as shown on the elevations and the site plan. (All structures are existing.)
The following are with regards to building lines:
i) No building may encroach into the building line setback. Development regulations
have been proposed to allow the existing smaller structure to encroach into the
West set back as shown on the Site Plan.

square feet (Section 18.5(f)). Proposed "S-P-l" regulations allow for a minimum floor

GENERAL COMMENTS
5. Residential adjacency regulations state that no non -single family residential building may
encroach in the area above a line having a slope of 4:1 from any single-family residential property.
However, a structure may be built up to within 40 feet of the residential property line, provided
that the structure is no greater than one story or 20 feet in height.
6. Where parking is provided between the building setback line and public R.O.W., shrubs obtaining
a mature height of three feet (3') or greater must be planted at a maximum spacing of thirty inches
(30") on center continuous along all paved edges of the parking or drive areas. This may require
additional shrubs over and above those required within the adjacent bufferyard.

INFORMATIONAL COMMENTS
A percolation test for each lot not served by City sewer is required during the platting process.
* No review of proposed signs is intended with this site plan. A separate building permit is required
prior to construction of any signs.
The applicant should be aware that prior to issuance of a building permit a Plat must be processed
and filed in the County Plat Records, a fully corrected site plan, landscape plan, irrigation plan,
and building plans, must be submitted for approval and all required fees must be paid. This may
include but not be limited to the following fees: Park Fee, Roadway Impact Fees, Water & Sewer
Impact and Tap Fees, and related Permit Fees.
Please be aware that any change of tenant/owners with a request for a new C.O. will require that
all parking areas meet the "all weather surface" requirement in the zoning ordinance and all fire
lanes shall be per the Fire Department's requirements.

I am very much opposed to the referenced zoning action for the following reasons:
• This area is totally dominated by single family homes on large, acreage size lots.
• The traffic generated by a commercial enterprise is incompatible with homes.
• The noise generated by a commercial enterprise is incompatible with homes.
• Commercial enterprises invariably install "security lighting" that lights up adjacent
residential property as brightly as their own.
• Low density, residential, property owners and commercial enterprise property owners
have vastly different and conflicting interests and priorities.
• The existence of homes around commercial property is not detrimental to commercial
property. The existence of commercial property around homes is always detrimental
to the homes.
• One intrusion of a commercial enterprise into a residential area is always used as an
excuse for another --- and another --- and another commercial enterprise.
• Since commercial property owners do not live next to the problems they create they
have little incentive to be good neighbors; often doing only what is required by law
or lawsuits.
This is a beautiful area of trees, woodlands, small creeks, natural springs and HOMES on
acreage size lots. There is nothing commercial interests can bring to the area that will
make it better. They can only, step by step, dismantle it and once dismantled it would be
lost for many lifetimes.

WHEREAS, the City Council of the City of Southlake, Texas, at a public hearing called by
the City Council did consider the following factors in making a determination as to whether these
changes should be granted or denied: safety of the motoring public and the pedestrians using the
facilities in the area immediately surrounding the sites; safety from fire hazards and damages; noise
producing elements and glare of the vehicular and stationary lights and effect of such lights on
established character of the neighborhood; location, lighting and types of signs and relation of signs
to traffic control and adjacent property; street size and adequacy of width for traffic reasonably
expected to be generated by the proposed use around the site and in the immediate neighborhood;
adequacy of parking as determined by requirements of this ordinance for off-street parking facilities;
location of ingress and egress points for parking and off-street loading spaces, and protection of
public health by surfacing on all parking areas to control dust; effect on the promotion of health ad
the general welfare; effect on light and air; effect on the over -crowding of the land; effect on the
concentration of population, and effect on transportation, water, sewerage, schools, parks and other
public facilities; and,
WHEREAS, the City Council of the City of Southlake, Texas, further considered among
other things the character of the districts and their peculiar suitability for particular uses and the
view to conserve the value of the buildings, and encourage the most appropriate use of the land
throughout this City; and,
WHEREAS, the City Council of the City of Southlake, Texas, does find that there is a

public necessity for the zoning changes, that the public demands them, that the public interest clearly
requires the amendments, and that the zoning changes do not unreasonably invade the rights of those
who bought or improved property with reference to the classification which existed at the time their
original investment was made; and,
WHEREAS, the City Council of the City of Southlake, Texas, does find that the changes
in zoning lessen the congestion in the streets, helps secure safety from fire, panic, and other dangers,
promotes the health and the general welfare, provides adequate light and air, prevents the over-
crowding of land, avoids undue concentration of population, and facilitates the adequate provision
of transportation, water, sewerage, schools, parks and other public requirements; and,
WHEREAS, the City Council of the City of Southlake, Texas, has determined that there is
a necessity and need for the changes in zoning and has also found and determined that there has been
a change in the conditions of the property surrounding and in close proximity to the tract or tracts
of land requested for a change since the tract or tracts of land were originally classified and therefore
feels that the respective changes in zoning classification for the tract or tracts of land are needed,
are called for, and are in the best interest of the public at large, the citizens of the city of Southlake,
Texas, and helps promote the general health, safety and welfare of the community.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SOUTHLAKE, TEXAS:
SECTION 1.
That Ordinance No. 480, the Comprehensive Zoning Ordinance of the City of Southlake,
Texas, passed on the 19th day of September, 1989, as originally adopted and amended, is hereby
amended so that the permitted uses in the hereinafter described areas be altered, changed and

amended as shown and described below:
Being Tract IEl and 1E2A in the John Childress Survey Abstract No. 253, and being
approximately 2.9571 acres, and more fully and completely described in Exhibit "A"
from "S-P-1" Detailed Site Plan District with "CS" Community Service District uses
to "S-P-l" Detailed Site Plan District with "O-1" Office District uses with the
exception of the following deleted uses: Banking; Bill Paying services;
Chiropractors; Dentists; Duplication and mailing services; Optometrists; Physicians;
Podiatrists; Title companies; and Utility offices as depicted on the approved Site Plan
attached hereto and incorporated herein as Exhibit `B", and subject to the specific
conditions established in the motion of the City Council and attached hereto and
incorporated herein as Exhibit "C."
SECTION 2.
That the City Manager is hereby directed to correct the Official Zoning map of the City of
Southlake, Texas, to reflect the herein changes in zoning.
SECTION 3.
That in all other respects the use of the tract or tracts of land herein above described shall
be subject to all the applicable regulations contained in said Zoning Ordinance and all other
applicable and pertinent ordinances for the City of Southlake, Texas. All existing sections,
subsections, paragraphs, sentences, words, phrases and definitions of said Zoning Ordinance are not
amended hereby, but remain intact and are hereby ratified, verified, and affirmed.
SECTION 4.
That the zoning regulations and districts as herein established have been made in accordance
with the comprehensive plan for the purpose of promoting the health, safety, morals and the general
welfare of the community. They have been designed, with respect to both present conditions and
the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the
streets; to provide adequate light and air; to prevent over -crowding of land; to avoid undue
concentration of population; and to facilitate the adequate provision of transportation, water,
sewerage, drainage and surface water, parks and other commercial needs and development of the

community. They have been made after a full and complete hearing with reasonable consideration
among other things of the character of the district and its peculiar suitability for the particular uses
and with a view of conserving the value of buildings and encouraging the most appropriate use of
land throughout the community.
SECTION 5.
That this ordinance shall be cumulative of all other ordinances of the City of Southlake,
Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those
instances where provisions of those ordinances are in direct conflict with the provisions of this
ordinance.
SECTION 6.
That the terms and provisions of this ordinance shall be deemed to be severable and that if
the validity of the zoning affecting any portion of the tract or tracts of land described herein shall
be declared to be invalid, the same shall not affect the validity of the zoning of the balance of said
tract or tracts of land described herein.
SECTION 7.
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply
with or who resists the enforcement of any of the provisions of this ordinance shall be fined not
more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation is
permitted to exist shall constitute a separate offense.
SECTION 8.
All rights and remedies of the City of Southlake are expressly saved as to any and all
violations of the provisions of Ordinance No. 480, as amended, or any other ordinances affecting
zoning which have accrued at the time of the effective date of this ordinance; and, as to such accrued

violations and all pending litigation, both civil and criminal, whether pending in court or not, under

such ordinances, same shall not be affected by this ordinance but may be prosecuted until final
disposition by the courts.
SECTION 9.
The City Secretary of the City of Southlake is hereby directed to publish the proposed
ordinance or its caption and penalty together with a notice setting out the time and place for a public
hearing thereon at least ten (10) days before the second reading of this ordinance, and if this
ordinance provides for the imposition of any penalty, fine or forfeiture for any violation of any of
its provisions, then the City Secretary shall additionally publish this ordinance in the official City
newspaper one time within ten (10) days after passage of this ordinance, as required by Section 3.13
of the Charter of the City of Southlake.
SECTION 10.
This ordinance shall be in full force and effect from and after its passage and publication as
required by law, and it is so ordained.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SOUTHLAKE, TEXAS, APPOINTING THE
MUNICIPAL COURT JUDGE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the 1999 Texas Legislature adopted changes to various
provisions of Chapter 30 of the Government Code relating to municipal courts of
record, making it appropriate to revise Article II of Chapter 8 of the Code of
Ordinances, in order to comply with the changes adopted by the 1999 Texas
Legislature; and,
WHEREAS, the Municipal Court Judge shall supervise and control the
operation and clerical functions of the administrative department of the municipal
court, including the court's personnel, during the proceedings or docket of the
court; and,
WHEREAS, the municipal judge of the municipal court of record in the
City of Southlake must be a resident of the state; be a citizen of the United States;
be a licensed attorney in good standing; and have two or more years of experience
in the practice of law in this state; and,
WHEREAS, the term of an appointed municipal court judge in the City of
Southlake is two (2) years from the date of appointment and the City Council
shall set the salary which may not be diminished during the judge's term of office
and may not be based directly or indirectly on fines, fees, or costs collected from
the court; and,
THEREFORE, IT BE RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SOUTHLAKE, TEXAS, THAT:

and the City Council hereby incorporates said findings into the

The purpose in returning to my hometown area to practice law after graduating from law
school was to serve the community that had given so much to me growing up and shaped the
adult I have become. I believe the role of a judge in a community is not only to act as a role
model, as I have attempted to do for teens through my six years on the bench with the Metroport
Teen Court Program, but also to help define the law and give the citizens a better understanding
of where they stand in the grand scheme of the multitude of codes, statutes, and ordinances.
Statistics show that for most people, their only interaction with the judicial system in an
entire lifetime is traffic court. In fact, most people who knew the Hon. Joe Drago III, the recently
retired senior district criminal court judge in Fort Worth, remembered him not for his many years
on the district court bench and presiding over the "cadet murders," but for the time that he spent
presiding over one of the municipal courts in Fort Worth dealing with defendants representing
themselves over transportation code and city ordinance violations. Judge Drago was known for
being firm, but fair, which is the model that I have made for myself in the role that I have served
the City of Southlake as the Associate Municipal Judge since February 1998.
Because first impressions are quite important, as the Municipal Judge, you are quite
possibly the one and only contact many citizens may have with the City of Southlake. I believe
that I can serve that position with the utmost fairness and impartiality, so that people leave our
court knowing that they have been treated fairly, but with a new respect for the law and our city.
Qualifications and experience that would assist you in serving in this position:
I hold a Bachelor of Arts degree in Communications from the University of Texas at
Arlington and a Juris Doctor Degree in Law from the School of Law at Baylor University. Since
becoming licensed to practice law in Texas in December 1991, I have continuously litigated in
the justice, county and district courts of Tarrant, Dallas, Collin, Denton and Parker counties. In
addition, I have served the City of Southlake as the Associate Municipal Judge since February

Brad Bradley as Judge of the Southlake Municipal Court.
Our community (and our youth in particular) need a Judge with the character,
integrity and experience of Mr. Bradley. We have been residents of Soutlake for
seven years and we have never heard a single negative remark about Judge
Bradley. We have had to face Judge Bradley in court to deal with traffic citations
and we found him to be fair minded and personable. We have had the opportunity
to observe Judge Bradley preside and find him to be firm but fair.
It is unusual for a small community like Southlake to have a Judge with such
outstanding academic and professional credentials. Furthermore, Soutlake has a
very high (per -capita) youth population. We need a Judge that has been deeply
involved with the youth in our community. Judge Bradley has been involved
(with kids) as a father, coach, counselor, mediator and more. As our city grows it
becomes increasingly imperative that we preserve the talent that has served us so

the Municipal Judge for the City of Southlake. Judge Bradley has served our city
with honor and dignity for many years and has sacrificed professionally and
personally to serve our city. He has initiated numerous programs to benefit the
city, the school district and the NETC area. Judge Bradley is known statewide
for his programs benefiting the youth of our area. We are truly bless to have a

ago. He has served the community well in a variety of ways by virtue of his

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SOUTHLAKE, TEXAS, APPOINTING
PERSONS TO SERVE AS THE BOARD OF
DIRECTORS FOR THE SOUTHLAKE CRIME
CONTROL AND PREVENTION DISTRICT; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Texas Local Government Code, Chapter 363.051 (The
"Act") authorizes a municipality that is partially or wholly located in a county
with a population of more than one million to create a crime control district within
its jurisdiction; and,
WHEREAS, on November 4, 1997, Southlake voters approved a
proposition to create the Southlake Crime Control and Prevention District,
dedicated to formulating crime reduction programs and the administration of the
one-half cent sales and use tax collected for the support of crime reduction
programs authorized by the city; and
WHEREAS, Section 363.101(a)(b) of the Local Government Code states
that the District is governed by a board of seven (7) directors who serve staggered
two-year terms that expire September 1; and
WHEREAS, a vacancy exists which was held by Peter Gaal with three (3 )
months remaining on his term. The term will expire September 1, 2001; now,
THEREFORE, IT BE RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SOUTHLAKE, TEXAS, THAT:
Section 1. All of the findings in the preamble are found to be true and correct
and the City Council hereby incorporates said findings into the
body of this resolution as if copied in their entirety.
Section 2. The unexpired term of Peter Gaal is open for reappointment with
three (3) months remaining. Under this resolution, the following
person is appointed to serve as Director for the Southlake Crime
Control and Prevention District for a three (3) month term to
expire on September 1, 2001:
Section 3. This resolution is effective upon passage by the City Council.

SUBJECT: Reconsider contract for professional services with Brinkley Sargent Architects
for the Recreation Center.
Action Requested: City Council reconsideration of contract for professional services with
Brinkley Sargent Architects for architectural design services for the proposed
recreation center.
Background
Information: In consideration that a new Parks and Recreation Board has been named and in
order to provide them an opportunity to review and comment on the plans for
the proposed recreation center, the Mayor has requested that an item be placed
on the City Council agenda to reconsider the professional services agreement
with Brinkley Sargent Architects.

SUBJECT: Consider revising trail width for Traffic Management Bond Package 2B, being
the hike and bike trail along north side of FM 1709, from Southridge Lakes
Parkway to Bicentennial Park.
Action Requested: City Council consideration of reduction of trail width from eight feet (8') to six
feet (6') for trail package 213, being the multi -purpose trail along the north side
of Southlake Boulevard from Southridge Lakes Parkway to Bicentennial Park.
Background
Information: In August 1995, the first Trail System Master Plan was approved by City
Council, which called for six foot trails throughout the City with the exception
of White Chapel, which was to be eight feet. The approved plan did not
delineate which side of the road the trail was to be constructed, and as
development occurred, this became an issue. In July, 1998, a clarification to
the Plan was adopted, which delineated the side of the road that the multi-
purpose, off -road trails were to be constructed. In the area of Southlake
Boulevard, between Peytonville and Carroll, staff recommended the trail along
the south side of FM 1709. The Planning and Zoning Commission
recommended approval of the Plan, but also recommended that at least a
sidewalk be constructed along the north side between Southridge Lakes
Parkway and Bicentennial Park. City Council approved the clarification, with
P&Z recommendations, on July 7, 1998.
In May 1999, voters approved three propositions related to traffic management
in a special bond election. Proposition No. 3 was for "the issuance of
$4,730,000 general obligation bonds for park improvements (hike and bike
trails)." The initial cost estimates for this proposal were based on a trail
width of eight feet in keeping with general design guidelines for multi -purpose
trails, and the desire to qualify for state trail grant funding. (American
Association of State Highway and Transportation Officials — AASHTO —
guidelines recommend minimum 10' width for multi -purpose trails, allowing
8' under certain conditions. Hike and bike trails are considered "multi-
purpose.") Bond election informational materials distributed to the public
referenced the trails as being eight feet in width.
HNTB Architects Engineers Planners were contracted as the City's consultant
to manage the design and construction of the improvements in the TMB,
including the design and construction of the hike and bike trails. TMB Package
#213 is the first trail package to have been let for construction, and is the trail
segment from Southridge Lakes Parkway to Bicentennial Park, on the north
side of FM 1709.

Concerns have arisen concerning the width of the trails and whether six foot
sidewalks should be constructed instead of eight foot trails. Issues have
centered on:
• expanse of concrete and resulting aesthetics or visual impact of eight foot
versus six foot trails,
• construction cost differential of eight foot versus six foot trails,
• ability to construct eight foot trails within existing or required right of way,
and
• any restrictions on ability to meander trails within this right of way.
This segment of Southlake Boulevard will also be served by the planned multi-
purpose trail on the south side of FM 1709. Therefore a sidewalk, although not
signed as usable for pedestrians and bicyclists, can still serve to enhance non -
motorized mobility of citizens.
Financial
Considerations: A reduction in width from 8' to 6' would result in an estimated cost savings of
approximately $18,000 in concrete costs.
