Item 4I - MemoCITY OF SOUTH LAKE MEMORANDUM February 22, 2022 To: Shana Yelverton, City Manager From: Amy Shelley, City Secretary Item 41 Subject: Resolution No. 22-008, Certifying unopposed candidates for the May 7, 2022 General Election Action Requested: Approve Resolution No. 22-008, receiving the City Secretary's Certification of Unopposed Candidates for the May 7, 2022 General Election. Background Information: On February 1, 2022, the City Council approved Resolution No. 22- 004, ordering the May 7, 2022 General Election to determine the positions of City Council Place 3, Place 4, and Place 5. The filing period for the 2022 General Election began January 19, 2022 and ended February 18, 2022. The City Secretary received one application each for Council Place 3, Place 4, and Place 5. These actions result in an uncontested election. The Election Code provides for the authority of the Governing Body to cancel an election if the candidates in each race are unopposed. As the authority responsible for having the official ballot prepared, the City Secretary shall certify in writing that the candidates are unopposed for the election scheduled to be held on May 7, 2022. The certification has been incorporated into Resolution No. 22-008 (Item 41). The unopposed candidates are: The unopposed candidates are: City Council, Place 3 Shawn McCaskill City Council, Place 4 Ronell Smith City Council, Place 5 Amy Torres-Lepp Following receipt of certification and pursuant to Subchapter C of Chapter 2 of the Election Code, the Council may declare each unopposed candidate elected to office. A companion item, Item 4J, is the official order cancelling the May 7, 2022 General Election. Also pursuant to Subchapter C of Chapter 2 of the Election Code, the unopposed candidates will be issued their certificates of election and will be sworn into office on May 17, 2022. Financial Considerations: Funds for elections are included in the City Secretary's Office budget. WHEREAS, the City of Southlake, Texas ("City") is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and, WHEREAS, the City of Southlake Charter provides that City Elections shall be held in accordance with the laws of the State of Texas; and WHEREAS, Section 3.004(b) of the Texas Election Code provides that the governing body of a municipality shall be the authority to order a General Election for the purposes of electing members to the governing body; and WHEREAS, the Council approved Resolution No. 22-004, Calling the May 7, 2022 General Election; and WHEREAS, the authority responsible for having the official ballot prepared shall certify in writing that a candidate is unopposed for election to an office if, were the election held, only the votes cast for that candidate in the election for that office may be counted. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, THAT: Section 1. Certification of the City Secretary. As the authority responsible for having the official ballot prepared, the City Secretary hereby certifies that the following candidates are unopposed for election to office for the election that was scheduled to be held on May 7, 2022: Office Candidate Term City Council, Place 3 Shawn McCaskill Three years City Council, Place 4 Ronell Smith Three years City Council, Place 5 Amy Torres-Lepp Three years Section 2. Posting of Cancelled Election. Notice of the cancelled election shall be posted as required by Chapter 2 of the Election Code. Section 3. Necessary Actions. The Mayor and the City Secretary, in consultation with the City Attorney, are hereby authorized and directed to take any and all actions necessary to comply with the provisions of the Election Code in carrying out and conducting the election, whether or not expressly authorized herein. This document is filed with the presiding officer of the political subdivision. The governing body must meet, accept this certification, and issue an order or ordinance declaring the election cancelled and the unopposed candidates elected. To complete the cancellation process, a copy of the order or ordinance canceling the election must be posted on Election Day at each polling place that would have been used in the election. An election* may be cancelled if: 1) The election is one in which a declaration of write-in candidacy is required; and 2) No opposed at -large race is on the ballot* within that election;*and 3) Each candidate whose name is to appear on the ballot* is unopposed, with some exceptions; This means: • In an all at -large election* (with no single -member districts), if there is one or more opposed at -large races, then all the races go on the ballot within that election.* • In an election* in which any members of the governing body are elected from single - member districts, an election in a particular district may be cancelled if the candidate is unopposed and the election otherwise meets the above requirements (i.e., there is no at -large opposed race on the ballot). Note: A general election (for full terms) or a special election (to fill a vacancy in an unexpired term) is considered a separate election with a separate ballot for purposes of these tests, even if held on the same election date.
