Item 4E memoCITY OF SOUTHLAK-E MEMORANDUM February 22, 2022 To: City Council From: Ken Baker, AICP — Sr. Director of Planning & Development Services Subject: Item 4E — Approve a License Agreement with the Dallas Fort Worth (DFW) International Airport to allow the installation of noise monitoring equipment and fencing on City owned property located at 100 E. Dove Road (Southlake Fire Station #3 — North Park Vicinity). Purpose: Approve a license agreement with the Dallas Fort Worth International Airport to place noise monitoring equipment on the City's property located at 100 E. Dove Road in an area near the fence line located west of the North Park parking lot area and north of the Fire Station #3 parking area (Attachment A - -proposed location). Background Information: The DFW International Airport monitors sound from aircraft operations via a series of permanently mounted noise monitor sites strategically located in nine cities, and three counties which surround the airport. The measured noise data is correlated with FAA radar data to determine the source attributable to aircraft operations (arrivals and departures). The correlated noise data confirms compliance with federal stipulations from the 1992 Final Environmental Impact Statement (FEIS) and provides local communities and builders with baseline aircraft and community sound exposure levels for building design and planning. The DFW International Airport currently has a noise monitor located in the vicinity of Highland and Carroll intersection but was unable to reach an agreement with property owner to continue to utilize the property. As such, the airport is looking for a new location in the vicinity and proposes to locate a monitor on City's property located at 100 E. Dove Road in an area near the fence line located west of the North Park parking lot area and north of the Fire Station #3 parking area. Vicinity map and site photo (see Attachment A) The proposed location of the noise monitoring equipment is more than 450 feet from the nearest residential property and includes the following: a concrete base (approximately three -foot -by -three-foot), 20-foot above -ground tilt pole, microphone, windscreen, bird spike, lightning arrestor, noise level analyzer, weather station, spread -spectrum radio, transmitter antenna, sound card, solar panel, battery storage, cellular modem, and associated enclosure cases. A security fence surrounding the equipment and meeting the City's design standards will be installed. The noise monitor will be solar powered. The license agreement includes a provision that after 5 years the City can terminate the license agreement upon one year written notice. Also, the DFW airport agrees to relocate the noise monitor at its expense if the City determines the premises is needed for public works, public health and safety or expansion of park facilities. Because the noise monitoring equipment is a benefit to the City and its residents, the staff is recommending a nominal yearly payment of $10. (See Attachment D).
