EXECUTIVE
SUMMARY: Hart Gaugler and Associates is requesting approval of a Plat Revision for Lots
4R1 and 4R2, Legends at Southlake, being a revision of Lot 4R, Legends at
Southlake, an addition to the City of Southlake, Tarrant County, Texas, and
located at 2320 Dean Way, Southlake, Texas. Current Zoning: "S-P-2"
Generalized Site Plan District. SPIN Neighborhood #8.
DETAILS: On January 4, 2022, City Council approved a Zoning Change and Site Plan for a
multi -sport training facility on approximately 3.8663 acres. The approved Site
Plan shows the entry driveway from Dean Way to the site on a separate
approximately 0.1858 acre lot that is currently a portion of Lot 4R, Legends at
Southlake. The purpose of this request is to seek approval of a Plat Revision to
create the separate lot for the entrance to the multi -sport facility in conformance
with the approved Site Plan. A separate Plat Revision to create a 3.8663 acre
platted lot for the multi -sport facility is being processed as Case No. ZA22-0003.

HISTORY: - A final plat was approved by the City Council for the Green Meadow
subdivision on December 3, 1974.
- The "I-1" zoning was placed on the property with the approval of
Zoning Ordinance No. 480 on September 19, 1989 and the adoption
of the official zoning map.
- A change of zoning from "I-1" to "S-P-2" was approved by City Council
on May 7, 2002.
- A Zoning Change and Concept Plan for Image Business Park was
approved by City Council on April 3, 2007 under Planning Case ZA07-
004.
- A Zoning Change and Concept Plan for Legends of Southlake was
approved by City Council on December 19, 2013 under Planning
Case ZA13-108.
- A Site Plan for Lots 1 and 2 of Legends of Southlake was approved
by City Council on December 19, 2013 under Planning Case ZA13-
109.
- A Preliminary Plat for Legends of Southlake was approved by City
Council on December 19, 2013 under Planning case ZA13-110.
- A Zoning Change and Concept/Site Plan for Legends of Southlake
(Lot 3) was approved by City Council on August 19, 2014 under
Planning case ZA 14-069.
- A Zoning Change and Concept Plan for Legends of Southlake (Lots
3 and 5) was approved by City Council on June 2, 2015 under
Planning case ZA 15-025.
- A Site Plan for the Legends at Southlake, Lots 3-6 was approved June
2, 2015 (ZA15-026).
- A Plat Revision for the Legends at Southlake for the purpose of
abandoning and rededicating several easements to conform to the
approved Concept and Site Plans for the development was approved
November 17, 2015. The plat revision created Lot 5R (ZA15-113).
- A Site Plan for Lot 5R, Legends of Southlake at 2360 Dean Way was
approved December 6, 2016 (ZA16-091).
- A Zoning Change and Site Plan for the Multi -Sport Facility was
approved January 4, 2022. The Site Plan for the Multi -Sport Facility
showed a portion of Lot 4R, Legends at Southlake to be designated
as a separate lot for the entry driveway from Dean Way to the facility
(ZA21-0086).

PLANNING AND ZONING
COMMISSION ACTION: The February 3, 2022, Planning and Zoning Commission meeting was
canceled due to inclement weather. Per the Texas Local Government
Code, Chapter 212, Section 212.009(a), the plat was approved on
February 6, 2022, due to inaction by the Commission within 30 days after
filing the plat application for consideration by the City.
STAFF COMMENTS: Attached is Plat Review Summary No. 1, dated January 26, 2021. Per
Section 21.009(b), the governing body (the City Council) shall approve,
approve with conditions, or disapprove the plat within 30 days after the
date the plat is approved by the inaction of the commission.

Per Subdivision Ordinance No. 483, as amended, Section 3.06.C, move the
statement "This plat does not alter or remove existing deed restrictions or
covenants, if any, on this property" from the notes to the end of the owner's
dedication right before "There are no liens against this property."
7. Dedicate the proposed Lot 4R2 as a Common Access, Pedestrian Access, Drainage and Utility
Easement. Because Lot 4R2 is to provide common access to the adjoining lot, the existing
access easement stubbed into the north boundary should noted to be abandoned.

10. It appears that this property lies within the 65 LDN D/FW Regional Airport Overlay Zone. Please
provide the Avigation Easement and Release as shown in Appendix 3 (attached) on the face of
the plat. The Avigation Easement and Release should be executed on subsequent plats to be
filed in the County Plat Record. The approved multi -sport facility is compatible with the Airport
Compatible Land Use Zoning Ordinance No. 479 with no noise level reduction required.
Per Subdivision Ordinance No. 483, as amended, Section 5.06, a 5' sidewalk is required along
Dean Way and a 5' sidewalk currently exists. A 5' sidewalk connecting the approved multi -sport
facility lot to the existing sidewalk along Dean Way is shown on the approved site plan (see
ZA21-0086).

The following should be informational comments only
All plats filed must have an original signed and stamped Tax Certificate submitted with it from
each taxing unit with jurisdiction of the real property, indicating that no delinquent taxes are owed
and that taxes for the current year have been paid. After September 1st, a certificate showing
that the taxes for that year are paid, but that the taxes for the upcoming year have yet to be
calculated is required. (House Bills 1563 & 3101). A copy of this information may be obtained
from the Tarrant County Tax Assessor/Collector's Office located at 100 E. Weatherford St. in Ft.
Worth (across from the old red courthouse). There is a service charge of $10 per account for

In addition to the City of Southlake impact fees, please be aware that through the wholesale
water customer contract with the City of Fort Worth, all new water connections are required to
pay the City of Fort Worth impact fee. The City of Fort Worth impact fee assessment is based
on the final plat recordation date and building permit issuance. The applicant is encouraged to
review the City of Fort Worth's assessment and collection of Impact Fees Guide to determine
the fee amount.
For Tarrant County filing, original signatures and seals will be required on one blackline mylar
and one blackline paper copy prior to filing the plat. The mylar and paper copies will not be
accepted if any erasures or original ink, other than signatures or seals, appear on the plat.
A Developers Agreement is required prior to construction of any public infrastructure. The
Developer's Agreement for this addition should consider streets, drainage, park dedication
requirements and fees, off -site sewer extensions, off -site drainage and utility easements and
impact fees.
