City Council Meeting, March 16, 1993
1 . Agenda Item No. 1C. Executive Session. Two items will be
discussed under the Personnel exemption in the Open Meetings
Act : appointment of Municipal Court Clerk and appointment of
Director of Public Works . •
Attached hereto is a memo from Lou Ann Heath, Director of
Finance, recommending that the current Deputy Court Clerk,
Renni Burt, be promoted to the position at a salary of
$23 , 500, the appointment to be effective March 18 . Municipal
Court Judge Bradley and Betsy Elam, the prosecutor in our
Municipal Court (with Fielding Barrett and Taylor) concur with
the recommendation. I also believe Renni has demonstrated the
knowledge and ability to perform the duties of the position.
Section 6 of Ordinance No. 522 establishing our Municipal
Court of Record, in keeping with requirements of Section
30 . 488 of the Government Code (which enabled the City to
create the Court of Record) , provides that the Court Clerk be
appointed by the City Council under the supervision of the
City Manager.
The City Charter provides that all department heads be
appointed by the City Manager subject to the approval of the
City-Council . We received 27 applications for the position of
Public Works Director. After reviewing the applications, it
was apparent that Robert R. "Bob" Whitehead was far above any
other applicant in education, training, and experience .

submitted by Bob Whitehead. Two weeks ago I interviewed Bob,
and he spent the day with (at various times) Billy Campbell,
Lou Ann Heath, Greg Last, and Chris Terry. After careful
consideration, I have extended an offer to Bob for the
position contingent upon approval by the City Council . He has
accepted with the contingency.
As indicated by the cover letter Bob submitted, he has worked
with me. previously. I was responsible for recruiting the
Public Works Director in Abilene in 1980 . Following a
national search, I recommended hiring Bob to the Abilene City
Manager and City Council . I worked with Bob approximately
four (4) years in Abilene . He worked for the City of Abilene
for almost 6 years after I left the organization. I
remembered Bob as being a very professional engineer and
manager, with good organizational skills and the ability to
work well with citizen groups . After checking his background
and references since I worked with Bob, I strongly recommend
your approval of the appointment .
My offer to Bob includes an annual salary of $54 , 000
(approximately the same as Mike Barnes) , a monthly car
allowance of $400 (same as Mike Barnes) , plus moving expenses
up to $2, 000 .
2 . Agenda Item No. 4 . City Manager' s Report . The departmental
reports are in your packet . Please let me or the appropriate
Director know if you have any questions .
Note that single family permits issued are holding at about
the same pace of approximately 32 permits per month for the
fiscal year. The 164 permits issued this year-to-date is
approximately 5896 greater than the same period last year.

Note that the number of water customers this month is 2880, up
approximately 1896 from this month last year' s total of 2442 .
These numbers reflect a growth substantially higher than most
estimates for Southlake . Consider the following:

The population estimated by NCTCOG for Southlake as of January
1992 is 7983 . It is my understanding that NCTCOG uses a 2 . 79
per unit population count .
The SEDC used 3 . 02 in its latest estimates, the CISD used
3 . 03 , and the 1990 U.S. Census used a 3 . 05 per unit
population. Applying the NCTCOG figure of 2 . 79 to the 2, 909
residential customer count as of 2/93 , our estimated
population would be 8 , 116 ; the 3 . 05 per unit figure would
place our estimated population at 8 , 872 . In any case,
applying the two per unit counts (2 . 79 and 3 . 05) , our 413
customer increase added somewhere between 1, 152 and 1, 260
residents between 2/92 and 2/93 . The same rate of increase
over the next year would increase our estimated population to
somewhere between 9, 463 and 10, 346 .
During my report I will update City Council on our trip
Tuesday to Austin to discuss the SH114 project with the
Highway Commission.
3 . Agenda Item No. 5A-5D are Consent Agenda items . Concerning
Item 5A, bids for the exterior stucco of the Bicentennial Park
Community Building, we did receive a bid of $16 , 000 but it was
too late to be considered. However, we know it can be done
near the budgeted amount . We will contact all the bidders and

inform them of our intent to rebid. We will also reexamine
our specs to see what we need to do (if anything) to separate
costs by units of work.
Agenda Item No. 5B . Resolution 93-24, provides for our
participation in the Tarrant County Housing Rehabilitation
Program discussed last City Council meeting. The resolution
is the standard used by Tarrant County in other cities .
Agenda Item No. 5C and 5D, are succinctly explained by the
staff memos.
4 . Agenda Item No. 7A. 2nd reading, Ordinance. No. 581,
confirming our official boundaries, is routine but cannot be
placed on Consent Agenda due to restrictions in our City
Charter.
5 . Agenda Item No. 8A. The applicant has requested the item be
tabled until April 6 . The item is on the Agenda due to notice
requirements .
6 . Agenda Item 9A. Resolution 93-18, concerns the appointment of
members of the Capital Improvements Advisory Committee to
consider updating our C. I . P. for the adoption of water and
sewer impact fees . As noted in the memo from City Secretary,
Sandy LeGrand, she has contacted the remaining members of the
previous Advisory Committee. All but one is willing to serve
if reappointed. The continuity would be helpful .
7 . Agenda Item No. 11A. A presentation of the independent audit
will be made by the firm of Weaver and Tidwell . The audit
reflects the sound financial policy practices of the City as
directed by the City Council . It also reflects the excellent
work performed by Lou Ann Heath, Director of Finance .

June Retreat .

Tuesday night . My mother will undergo major surgery in Fort

Additionally, the hearing on the D/FW Bill before the House
committee is tentatively scheduled for Tuesday night in
Austin. If my mother has no complications, I may attend the
meeting in Austin.

12 . As a reminder, the Mid-Year Review. is scheduled for the 1st

Dear Sandy:
Per our telephone conference Tuesday, I am requesting that the city council consider an amendment to the city
ordinance for building codes that would require all homes that are located in a residential area be required to
have either a concrete or asphalt driveway to the street. For the homes that were built prior to the city requiring
this code, the homeowner should have no more than three years to adhere to the amendment.
My concern over this is due to the rising taxes in Southlake and the resale value of our homes here. I would
like to maintain if not improve the value of my home, but it is very hard to justify improving my home or even
trying to sell it with two houses on our block that do not have paved driveways. The little gravel they have
always washes out onto the street and into the neighbors culverts causing more problems. I feel this is a minor
7oblem to resolve in order to meet the standards that the City of Southlake is trying to project to the public
id to lessen the impact of yearly rising property taxes.
Also, I would like to request that the city council provide a more detailed definition of what constitutes an
approved compost pile per the city code. I have had a problem with a neighbor on this for two years and
apparently the fire marshall said we can not do anything about it. I feel the compost pile should have to be
contained in some short of container in a limited defined area so the wind will not blow the compost contents
in other yards.
Another question I have, does the city require the homeowner to maintain their culverts in order to provide
proper drainage? If so, then how does the city enforce it? Everytime we have a hard rain, the culvert on the
end of the block plugs up causing the street to flood.
I have lived here since January 1985 and I really enjoy this area, but due to its rapid expansion, we need to
focus some attention to the areas that were here before the city added stronger building codes. I greatly
appreciate your attention to this matter. If you would like to discuss any of this, please call me at (214) 902-

Subject: Park Dedication Section of Subdivision Ordinance
#483 and Request for Joint Worksession
Based on recommendations, (attached) , of the Parks & Recreation
Board subcommittee which reviewed the Park Dedication section of
Subdivision Ordinance #483 in January and February of this year, I
believe a joint work session involving the City Council, City
staff, and the Parks & Recreation Board would be mutually
beneficial. It will give all of us the opportunity to express our
concerns regarding Section VII of Ordinance #483 as it is currently
written. The board hopes to use the occasion of a joint work
session to receive direction for revision of Ordinance #483 as has
been suggested by the City Council. '
Attached is a memorandum from the Parks & Recreation Board
subcommittee which has been reviewing Ordinance #483, Sec. VII .

Concerns with Current Policies :
1 . Park Dedication Fees have not achieved their fundemental purpose.
It is deficit financing.
2 . Our Ordinance is a subsection of the P & Z 's Subdivision
Ordinance. These two areas are essentially unrelated. The Park and
Recreation Board can better accomplish it's mission of carrying out
the Master Plan through the establishment of an independent ordinance
where primary issues are parks and recreation.
3 . PUD requirements are met but then duplicated to meet the
developer' s park dedication fees . There is duplicity in meeting PUD
' requirements and satisfaction of park dedication requirements . ! A
division of P & Z requirements from that of Park and Recreation
requirements would remedy this tendency.
Recommendations :
1. Establish Park Dediacation Requirements that result in furtherence
of goals stated in Park and Recreation Master Plan.
2 . Adopt free standing ordinance that governs park dedication
requirements .
3 . Use developed cost of land rather than raw land cost to determine
fees.
4 . The formula for credit to the developers for private facilities
should be revised to accurately reflect whether or not these
facilities fit in with what is called for in that particular zone in
the Park and Recreation Master Plan for primary use by the immediate
neighborhood residents .

Subject: Rejection of Bids for Exterior Synthetic Stucco
System for the Community Building at Bicentennial
Park and Permission to Readvertise for Bids
The City went to bid for the stuccoing of the Community Building at
Bicentennial Park on 12/29/92 . No bids were received at the first
bid opening. Staff then revised the bid specifications following
the initial bid process to address flashing, roofing, and finishing
work to be conducted. At the second bid opening the City received
a total of four (4) bids for the exterior synthetic stuccoing work.
These bids were opened before the public at 10 : 00 a.m. on 3/10/93 .
The lowest bid received as of 10: 00 a.m. on 3/10/93 was $23,989 .00
from Wilson Construction, Inc . of Hewitt, Texas .
Staff recommends rejection of the bids and requests permission to
readvertise for the exterior resurfacing of the Community Building.
Staff does not feel that the finished product resulting from the
proposed synthetic stuccoing warrants expenditures that so
substantially exceed the budgeted amount. of $15,000 .
Staff will explore exterior resurfacing options in addition to the
synthetic stuccoing procedure prior to the acceptance of. other
bids .

SUBJECT: Resolution No. 93-24, Participation in the
Tarrant County Housing Rehabilitation Program
During the work session of the City Council Meeting held on March
2, 1993, Mr. Jim Stewart, from the Tarrant County Housing
Rehabilitation Program was present to answer questions for Council
in regard to the. program.
As outlined in Resolution No. 93-24, Council agrees to waive all
building permit fees, bonding and licensing requirements, provided
that each approved contractor holds a valid bond and license from
any other city in Tarrant County in accordance with State bonding
and licensing requirements for electrical and plumbing work to be
performed under this program.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SOUTHLAKE, TEXAS, PARTICIPATING IN THE
TARRANT COUNTY HOUSING REHABILITATION PROGRAM;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Southlake participates in the Tarrant
County Community Development Block Grant Program; and,
WHEREAS, the City of Southlake shares in a cooperative
agreement with Tarrant County for the purpose of recognizing
Community Development Block Grant funds to aid low and moderate
income families; and,
WHEREAS, the City of Southlake has been chosen to receive a
grant to repair eligible low and moderate income, owner-occupied
homes;
NOW, THEREFORE BE IT RESOLVED, that the City of Southlake hereby
agrees to allow the Tarrant County Housing Rehabilitation Program
to operate within the City; and,
BE IT FURTHER RESOLVED, that the City of Southlake agrees to waive
all building permit fees, bonding and licensing requirements,
provided that each approved contractor holds a valid bond and
license from any other city in Tarrant County in accordance with
State bonding and licensing requirements for electrical and
plumbing work to be performed under this program; and further, that
it shall be the responsibility of the Tarrant County Housing
Rehabilitation Program to assure that such bonding and licensing
requirements are satisfied by contractors working under the
program, and;
BE IT FURTHER RESOLVED, that the City of Southlake agrees to
perform the necessary electrical, plumbing, and mechanical
inspections for said program.

SUBJECT: Resolution No. 92-25, Amending the Resolution
Calling the General Election for May 1, 1993
An amendment to Resolution No. 93-13 , Calling the General Election
for May 1, 1993 , is being presented in regard to Section 14, by
amending the Early Voting hours and Section 15, amending the Pre-
Clearance Letter to the Justice Department as requested in Title
15.
The Tarrant County Election Administer has requested the use of
City Hall for Early Voting for the U.S. Senate Election, also to
be held on May 1, 1993 . After talking with Curtis Hawk and Mayor
Fickes, we have agreed to let them use the area near the front door
for Early Voting. The amendment to our in person Early Voting
hours is being requested because of their extended hours. We all
• feel it will make the city look bad to our citizens if the County
were open for voting and we are not, at our city hall.
The City is not required to extend the Early Voting hours beyond
the 5 days per week, while the Office of City Secretary is open for
business, however, through the years I have extended the hours to
be open for four (4) hours'on the last Saturday of Early Voting, in
order to give the citizens who are working, a chance to vote.
Tarrant County has extended hours beyond that.
I feel we should be open for Early Voting, in person, the same
times that Tarrant County is open for voting, therefore, I am
requesting an amendment to the resolution to include the extra
hours. The schedule will consist of:
April 12 , 1993 through April 23 , 1993 8 : 00 a.m. to 5: 00 p.m.
April 24 , 1993 7 : 00 a.m. to 7 : 00 p.m. Saturday
April 25, 1993 11: 00 a.m. to 4 : 00 p.m. Sunday
April 26, 1993 7 : 00 a.m. to 7: 00 p.m. Monday
April 27, 1993 7 : 00 a.m. to 7 : 00 p.m. Tuesday

WHEREAS, Resolution No. 93-13 , adopted by the Southlake City
Council on February 2, 1993 , called for a General Election to be
held on May 1, 1993 ; and,
WHEREAS, the City Council of the City of Southlake now
desires to extend the hours for voting during the early voting
period; and,
WHEREAS, this change from prior practices may require pre-
clearance under the Federal Voting Rights Act; now,
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, THAT:
1. Section 14 of Resolution No. 93-13 , is hereby amended as
follows:
SECTION 14 . Early Voting. Early voting by personal appearance
shall be conducted between the hours of 8: 00 a.m. to 5:00 p.m. on
each day which is not a Saturday, Sunday or an official State
holiday, beginning on April 12 , and continuing through April 27,
1993 . Additional voting hours shall be as follows:
Day 7 April 24, 1993 7 : 00 a.m. to 7: 00 p.m. Saturday
Day 6 April 25, 1993 11: 00 a.m. to 4 : 00 p.m. Sunday
Day 5 April 26, 1993 7 : 00 a.m. to 7 : 00 p.m. Monday
Day 4 April 27, 1993 7 : 00 a.m. to 7 : 00 p.m. Tuesday
Early Voting by personal appearance shall be at the Office of the
City Secretary, 667 North Carroll Avenue, Southlake, Texas.
Applications for early voting by mail shall be delivered to the
City Secretary at the same address not earlier than March 2 , 1993 ,
and not later than the close of business on April 23 , 1993 .
Early Voting, both by personal appearance and by mail, shall be by
paper ballots and shall be canvassed by the Absentee Ballot Board,
which is hereby created. The Presiding Election Judge and the
Alternate Presiding Election Judge appointed herein shall serve as
the presiding officer and the alternate presiding officer,
respectively, of the Early Voting Board. The other election
officers serving at the election shall serve as the other members
of the Early Voting Ballot Board for the election.

2 . SECTION 15 , Submissions to the , United States Justice
Department. The City Secretary of the City of Southlake is
directed to make such submissions as are necessary to the U.S.
Justice Department to seek pre-clearance approval for the

SUBJECT: Sanitary Sewer Easement Dedication - Timber Lake Addition
The purpose of this easement is to allow the extension of the
sanitary sewer for the second phase of the Timber Lake Addition.
The extension goes through a future phase and will be a part of the
street R.O.W. with the final plat of the future phase.
Attached is a copy of the proposed easement dedication with
appropriate descriptions and exhibits . City staff has also reviewed
the request and has no problem with the dedication of the easement .
Please place this item on the council' s agenda for approval of the
sanitary sewer easement dedication and authorization for staff to
take relevant action to facilitate the abandonment . Staff will
obtain signatures upon approval .

AN ORDINANCE CONFIRMING AND ADOPTING THE OFFICIAL
BOUNDARIES OF THE CITY OF SOUTHLAKE; PROVIDING FOR THE
FILING OF THE OFFICIAL BOUNDARY MAP; PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES;
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Southlake, Texas is a home rule city acting under its charter
adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and
Chapter 9 of the Local Government Code; and
WHEREAS, the City Council of the City of Southlake, Texas, has heretofore
requested the City Engineer to determine the official boundaries of the city limits of the
City of Southlake; and
WHEREAS, the City Council now desires to adopt this ordinance confirming and
adopting the boundaries and map attached hereto as the official boundaries of the city
limits of the City of Southlake, Texas.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY

That the map and boundaries attached hereto as Exhibit "A" are hereby declared
to be the official city limit boundaries of the City of Southlake, Texas, as of the effective
date of this ordinance. The official boundary map of the City of Southlake shall be
updated periodically at such time as additional annexations or other changes and
boundaries are officially adopted by the City of Southlake.

SECTION 2
The City Secretary is directed to maintain a copy of said map and boundary
description, as amended from time to time, as a part of the official records of the City of
Southlake, Texas.
SECTION 3
The adoption of this ordinance shall not affect any ordinance, act or proceeding
heretofore made applicable to any territory or land treated as being within the City of
Southlake at the time said ordinance, act or proceeding was effective, notwithstanding the
fact that such land or territory may not be included within the official boundaries of the
City of Southlake as adopted herein.
SECTION 4
This ordinance shall be cumulative of all provisions of ordinances of the City of
Southlake, Texas, except where the provisions of this ordinance are in direct conflict with
the provisions of such ordinances, in which event the conflicting provisions of such
ordinances are hereby repealed.
SECTION 5
It is hereby declared to be the intention of the City Council that the phrases,
clauses, sentences, paragraphs and sections of this ordinance are severable, and if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted by the
City Council without the incorporation in this ordinance of any such unconstitutional
phrase, clause, sentence, paragraph or section.

Paul McCallum, Bob Hopkins and Ernest Johnson indicated they would
be willing to serve. Kurt Miller is currently working out of state
and is unable to participate at this time.
The four (4) members appointed to the group are: Joe Wright, Lanny
Tate, David McMahan and Bruce McCombs.
Again, I have attached the new applications received as the result

SOUTHLAKE, TEXAS APPOINTING MEMBERS TO A CAPITAL
IMPROVEMENTS COMMITTEE . PROVIDING AN EFFECTIVE DATE.
Whereas, the City Council of the City of Southlake, Texas
formed a Capital Improvements Committee to work with the City staff
in developing and implementing land use perimeters for water and
sewer impact fees; and,
Whereas, it has been established that the committee is to
consist of at least five (5 ) members, with two (2) of the members
being developers; now,

APPOINTMENT OF MEMBERS TO A CAPITAL IMPROVEMENTS COMMITTEE
RELATED TO IMPACT FEES
The City Council of the City of Southlake, Texas, is currently
accepting applications for positions on the Capital Improvements
Committee Related to Impact Fees. The Texas Local Government Code,
Chapter 395, sets forth the requirements for adopting impact fees.
Southlake adopted water and wastewater impact fees in 1990. The
law requires an update to the impact fee ordinance be completed
within three (3) years of initial adoption.
The City Council must appoint members to an advisory committee of
not less than five (5) persons. Not less than 40% of the
membership of the advisory committee must be representatives of the
real estate, development, or building industries who are not
employees or officials of a political subdivision or governmental
entity.
The Advisory Committee serves in an advisory capacity and is
established to advise and assist the City in adopting land use
assumptions, review the capital improvements plan and file written
comments, monitor and evaluate implementation of the capital
improvements plan, file reports as to the progress of the capital
improvements plan, and advise the city of the need to
update or revise the land use assumptions, capital improvements
r - plan, and impact fee.

SUBJECT: AUDIT - FISCAL YEAR ENDING SEPTEMBER 30, 1992
The independent audit for the fiscal year ending September 30, 1992
has been completed and delivered by the City' s independent auditor,
Weaver and Tidwell . The audit report is comprised of three major
sections : Introductory, beginning on page 1; Financial, page 15;
and Statistical, page 87 . The Introductory Section includes the
transmittal letter, a narrative of notable financial and other
information for the year.
The Independent Auditors Report on page 15 reflects an unqualified
opinion on the financial statements . This means that the financial
statements present fairly, in all material respects, the financial
position of the City. Pages 18 through 43 contain the Combined
Financial Statements . The Combined Balance Sheet, page 18,
includes all fund types and account groups . The Combined Statement
of Revenues, Expenditures and Changes in Fund Balances on page 22
represents only the Governmental Fund Types : the General, Special
Revenue, Debt Service and Capital Project Funds . The Statement of
Revenues, Expenses and Changes in Retained Earnings-Proprietary
Fund Types, page 24, reflects the results of operation of the
City' s Utility Fund.
GENERAL FUND
Beginning .on page 45 are the Individual Fund and Account Group
Financial Statements and Schedules . The first fund presented is
the General Fund. The General Fund accounts for most of the
operations of the City. Included for financial statement purposes
within the General Fund is financial activity relating to recycling
proceeds . Also reflected within the General Fund are the donations
received and expenditures made by the City for library books,
pursuant to an agreement with the City of Grapevine Library.
Revenues
The actual revenues within the General Fund are $3 , 907, 393 , which
exceeds the amount budgeted by. $170, 728 . The majority of the
excess ($165, 183) is from building permit revenue. Actual
permit/fee revenue is $791, 983 , or almost double the adopted 1991-
92 budget of $404, 500 . The 1991-92 budget revision for this
category was $622, 150 .

GENERAL FUND
Expenditures
Total expenditures for the year are $3 , 836, 342, exceeding the
budgeted amount by 1 . 3%, or $49, 837 . During the last quarter of
the fiscal year, the City Council assisted in road and drainage
improvement projects adjacent to the new high school which were
estimated for revised 1991-92 budget purposes . These projects
exceeded the budget estimates by $28, 380 . For the year,
engineering services exceeded budget by $22, 200 . At the end of
fiscal year 1991, General Fund Balance was reserved for a contract
to M. A. Vinson for the Raintree Box Culvert totaling $23 , 700 .
This amount is charged to the 1991-92 budget, yet it is not
reflected within the revised 1991-92 budget .
Fund Balance
During the 1992-93 budget preparation, it was estimated that the
ending Fund Balance for the Fiscal Year 1991-92 would be
$1, 013 , 480 . The actual ending balance is $1, 136, 448, or an
increase of $122, 965 over the estimate. The net increase over the
previous year' s balance of $875, 223 is $261, 225 . This is a very
strong Fund Balance, since it represents 25 .3% of the 1992-93
adopted budget .
UTILITY FUND
Results of operations within the Utility Fund were positive. The
primary criteria of the operation of the Fund is the revenue bond
coverage . This is defined as the net revenue available to pay for
the year' s debt service requirements on revenue bonds. Operating
expenses (excluding depreciation) are deducted from gross revenues
to determine the net revenues available. Usually revenue bond
covenants will require that these net revenues must be at least 1.5
times the annual debt service . On page 106 in the Statistical
Section, there is a schedule of ten years data on revenue bond
coverage. Fiscal year 1991-92 resulted in a coverage of 2 .28 times
the debt service requirements . The annual review and update of the
City' s utility rate structure will ensure that this requirement is
maintained.
CAPITAL PROJECTS FUND
The City expended $1, 758, 574 on capital projects during the year.
One million dollars of this total was the City' s participation in
the Texas Department of Transportation' s FM1709 road project .

relocation of the Community Center, partial funding of Post Oak
Trail, Cypress and Peytonville Road reconstruction.
CONCLUSION
The Statistical Section of the audit beginning on page 87 contains
several tables that list ten years of financial information
regarding the City. This history provides an excellent source of
information and trends about Southlake, highlighting financially
• the growth the City has experienced.
Fiscal year 1991-92 places the City of Southlake in a solid
financial position. Continued conservative budgeting and
monitoring of revenues and expenditures in the General Fund will
enhance this .

SUBJECT: Status of Land Use Plan Update
The Planning and Zoning Commission has been reviewing the Land Use
Plan during public hearings over the past several months and they
anticipate completion of the map revisions at their March 18th
meeting. The emphasis has been on the graphic plan rather than the
accompanying narrative, so there will still be some discussion on
the narrative portion of the document .
The schedule for the Impact Fee Update requires that staff
determine land use assumptions by April 14, 1993 . Since these
assumptions will be based on the Land Use Plan, the staff would
like to use the updated version of the plan. This would require an
initial City Council approval on April 6, 1993 . The Commissioner' s
feel comfortable that they can recommend the graphic plan for City
Council action on that date .
It would be unreasonable to think that the City Council will be
completely comfortable with the recommended Land Use Plan with only
one review. We anticipate a more extensive review with the City
Council upon completion of the narrative by the Commission. Our
purpose for the preview is to see if the City Council is
comfortable enough with the plan to allow ,staff to begin
projections needed for the impact fee update .
Attached, you will find a reduced map of the City showing eight (8)
planning districts throughout the City. These were determined
based on similarity of demographics, development characteristics
and anticipated future uses and were established to allow a
segmented approach to the land use update .
Also attached is Planning District Three (3) as recommended by the
Commission. I have provided this at this time to allow the City
Council time to understand the graphic legend used during the
update . Although, you may feel this beyond comprehension at first
(as some Commissioner' s did also) , the format seemed to work very
well throughout the process . Most of the graphics are described in
the text but feel free to call should you need further
clarification.

Staff has been presented a request for a building permit on a lot
within Spring Oaks Addition, a Gift-of-Love plat which was filed of
record on June 26, 1984 . The difficulty is that these lots were
approved without frontage on a public street and the Zoning
Ordinance No. .480 (Section 7 . 5) requires that every building to be
erected shall be on a lot adjacent to an approved public or private
street .

Attached you will find an opinion dated 2/19/93 on this topic from
Wayne Olson of Fielding, Barrett & Taylor. Please note on page 5,
paragraph three, that he recommends two options, to provide
exception for single lots of record platted in accordance with
prior subdivision ordinances, or to specifically provide for the
granting of a special exception by ZBA.
Our reason for bringing this item to you is to receive your
direction to deny the building permit request or proceed with an
ordinance amendment which will provide an appropriate process .

Re: Issuance of Building Permit for Spring Oaks Addition
Dear Greg:
By memorandum dated February 5, 1993, as updated by a couple of telephone
conversations since then, you have asked for an opinion as to whether•a building permit
may be issued on a platted lot without public street frontage in the Spring Oaks; Addition
in the City of Southlake. This plat was filed of record June 26, 1984, and is located several
hundred feet east of the closest right-of-way, which is Ridgecrest Drive. You questioned
whether the city could issue a building permit for the construction of a single family
residence on this lot, even though it does not have frontage upon an approved public
street. You specifically noted that section 7.5 of .the Zoning Ordinance provides:
"LOTS TO HAVE ACCESS--Every building or structure hereafter erected,
reconstructed, altered, enlarged or moved onto a lot shall be on a lot
adjacent to an approved public or private street and shall be so located so
as to provide safe and convenient access for servicing, fire protection, and
required off street parking."
You also cited the following sections of the Subdivision Ordinance:
Section 8.01 Lotting Requirements:
"A. Every lot shall abut on a Public street or a private street."

Section 9.01 Modifications and Variations:
A. Compliance: Where the Council finds that compliance with these
regulations would cause unusual hardship or extraordinary difficulties
because of exceptional and unique conditions of access, location,
shape, size, drainage, or other physical features of the site, the
requirements may be modified to mitigate the hardship, provided that
the public interest is protected and the development is in keeping with
the general,spirit and intent of this ordinance.
1. This section shall not be interpreted to permit the development
of land which is inherently unsuitable for the use proposed.
2. Any modification will not have the effect of preventing the
orderly subdivision of other land in the area in accordance with
the provisions of this ordinance.

� I would also note that section 3.3 of the Zoning Ordinance provides as follows:
"BUILDING PERMITS REQUIRED -- No building or other structure shall
be erected, moved, added to or structurally altered without a permit therefor
issued by the Administrative Official. No building permit shall be issued by
the Administrative Official except in conformity with the provisions of this
ordinance or other ordinances of the City unless approved by the Zoning
Board of Adjustment in the form of an administrative review, special
exception or variance, as provided by this ordinance."
Section 9.02 of the Subdivision Ordinance provides, in part, as follows:
Section 9.02 Violations:

C. Permit Denial: No building, plumbing, electrical, mechanical,
excavation, permits, zoning actions, certificates of occupancy 'or
authorizations for utility service connection shall be made for any
construction, activity or occupancy occurring on a lot, tract or parcel
in an unrecorded subdivision or development until the subdivision;or
development is brought into compliance with the terms and conditions
of this Ordinance.

As you can see from these paragraphs, there is an attempt to achieve consistency
between the Zoning Ordinance and the Subdivision Ordinance.
Based upon the above cited provisions, it is clear that no building permit may be
issued unless the lot meets the requirements of all city ordinances. It is my understanding
that this lot in the Spring Oaks Addition was platted in conformity with the City's
Subdivision Ordinance that was in existence at the time — either the prior Subdivision
Ordinance did not have a requirement of public street frontage or an appropriate variance
was obtained from the City. Council at the time of platting. Therefore, the Subdivision
Ordinance is not applicable to the issuance of a building permit on this lot. If we have
facts showing that this is untrue, please let me know so that we can review any changes
in circumstances accordingly.
It is also my understanding.that the lot has appropriate zoning for construction and
occupancy of a single family residential structure, and otherwise meets all the requirements
of the Subdivision and Zoning Ordinances as far as lot size and similar development
regulations. However, the lot does not meet the requirements of section 7.5 of the Zoning
Ordinance, which specifically requires that buildings may not be constructed on' lots that
do not have frontage on approved public or private streets. As you are aware, section
44.3(b) of the Zoning Ordinance gives the Board of Adjustment the following variance
powers:
44.3 POWERS AND DUTIES

b. Variances - To authorize in specific cases variances from the terms of
this ordinance as will not be contrary to the public interest, where due
to special conditions, a literal enforcement of the provisions of this
ordinance would result in unnecessary hardship and where the spirit
of the ordinance is observed and substantial justice is done. A
variance shall not be granted by the Board of Adjustment except in
accordance with the following:
(1) A written application for a variance shall be submitted
demonstrating:
(a) That special conditions and circumstances exist which are
peculiar to the land, structure, or building involved and
which are not applicable to other lands, structures, or
buildings in the same district;
(b) That literal interpretation of the provisions of this
ordinance would deprive the applicant of rights

commonly enjoyed by other properties in the same
district under the terms of this ordinance;
(c) That the special conditions and circumstances do not
result from the actions of the applicant;
(d) That granting of the variance requested will not confer
on the applicant any special privilege that is denied by
this ordinance to other lands, structures, or buildings in
the same district.
(2) No nonconforming use of neighboring lands, structures, or
buildings in the same district, and no permitted use of lands,
structures, or buildings in other districts shall be considered
grounds for the issuance of a variance.
(3) A public hearing shall be held on all applications for variances.
Any party may appear in person, or by agent or attorney.
(4) Fifteen (15) days notice of the public hearing shall be given,in
accordance with the procedures used in zoning cases.
(5) The Board of Adjustment shall make findings that the
requirements of this section have been met by the applicant for
a variance.
(6) The Board of Adjustment shall further make a finding that the
reasons set forth in the application justify the granting of the
variance and that the variance is the minimum variance that
will make possible the reasonable use of the land, building or
structure.
(7) The Board of Adjustment shall further make a finding that the
granting of the variance will be in harmony with the general
purpose and intent of this ordinance and will not be injurious
to the neighborhood or otherwise detrimental to the public
welfare.
You questioned whether the granting of a variance to the access requirement of
section 7.5 would constitute an unauthorized "waiver" of a legal requirement in the Zoning
Ordinance. Although the Board's variance powers are limited as cited above, there is no
clear cut delineation of where the Board's variance powers end. The Board has no
authority to vary the purpose and intent of the Zoning Ordinance, but rather is limited to
granting ordinances to the application of development regulations to specific properties.

Although this is a gray area, it is my opinion that the Board would be authorized to grant
a variance under the fact circumstances you outlined as long as the Board finds that the
lot is located so as to provide safe and convenient access for servicing, fire protection and
required off street parking and that the other requisites for a variance are met.
You have indicated that there may be other similarly situated lots in the city which
do not have appropriate frontage. I would submit that each of these could be looked at
by the Board of Adjustment on a case by case basis.
Because the exact authority of the Board is somewhat ambiguous, a better
alternative may be to amend section 7.5 of the Zoning Ordinance to provide exemptions
for single lots of record that were platted in accordance with prior subdivision ordinances,
or to specifically provide for the granting of a special exception by the Board of
Adjustment under specific circumstances. This is a matter that could be taken to the City
Council for review and approval if that is felt to be in the public interest.
You have also asked whether the same conclusions can be made for lots that are
currently unplatted. I would point out that section 2.02 of the Subdivision Ordinance
provides as follows:
Section 2.02 Single Tracts Prior to Construction:
A. Every owner of a single tract of land, within the corporate limits of
the City or within its extraterritorial jurisdiction, shall be required to
submit a "Plat Showing" of said tract and obtain approval of said plat
prior to the commencement of construction upon said tract, and no
building permit shall be issued for the construction of any building,
nor shall any construction commence upon said tract prior to the
filing of a plat of said property in the County Plat Records. However,
nothing herein shall.require a plat to be approved and filed as a
prerequisite to construction where such construction occurs on land
which is within the municipal city limits and is zoned Residential or
Agricultural, or is not within the Municipal City Limits and therefore
is not zoned, and such construction is for any of the following
purposes:
1. Adding to an existing building or structure;
2. Altering an existing building or structure;
3. Adding an accessory building or structure;
4. Restoring any building or structure previously destroyed by fire,
explosion, or any other casualty or act of God, where the extent

of the destruction is not more than fifty percent (50%) of its
reasonable market value.
Additionally, section 1.03 provides in part as follows:
Section 1.03 Enforcement:

B. "Except as provided in section 2.02, no permits for building, repair or
plumbing or electrical work on any tract shall be issued by the city
until the approval and filing of a plat in the County Plat Records..."
Under the above quoted regulations, no building permit may be issued until a plat
is approved and filed, and at the platting stage there will be a requirement under the
current Subdivision Ordinance that all lots front upon an approved public or private street.
Therefore, it is my opinion that under the language in the current Zoning and Subdivision
Ordinances, any unplatted lots in the City would be required to front upon an approved
street.
You and I discussed over the phone some of the practical ramifications of other
interpretations of the Zoning and Subdivision Ordinance. If you would like for me to

During the 1992 June retreat, at the request of Councilmember
O'Brien, staff prepared a memo outlining potential ordinance
revisions which would reduce the City Council agenda items as well
as the work load of staff . Although we have been unable to submit
this to the City Council earlier, we still feel these changes would
be very beneficial to the overall productivity of the staff, reduce
the City Council agenda items and still provide a high level of
service to the citizens and the development community.
We have submitted this to Council under two separate agenda items,
the first addressing platting changes in the Subdivision Ordinance
and the second dealing with changes in the Zoning Ordinance .
The following is a summary of the recommended changes in the
subdivision ordinance :
1 . Final approval of Final Plats and Plat Revisions would be the
authority of the Planning and Zoning Commission rather than
the City Council .
2 . Single-lot Plat Showings would be approved administratively by
staff . These plats are typical of someone who must plat prior
to issuance of a building permit .
3 . Other Plat Showings would be approved only by the Planning and
Zoning Commission at a public hearing and would not go to City
Council . This would include all plat showings where there was
a proposed subdivision of the lot .

The following is a summary of recommended changes to the Zoning
Ordinance which should streamline certain review processes for
the applicant, the City Council, the Planning and Zoning
Commission, and the Staff:
1 . Authorize the Zoning Board of Adjustment (via a Special
Exception Use Permit) to review portable building
applications per the existing criteria described in Section
45 . 7 . Require a plot plan for the exhibit instead of a
concept plan.
2 . Permit noncommercial satellite dishes and noncommercial
radio and television receiving antennae as accessory uses
in all residential districts via administrative approval of
a plot plan meeting certain criteria.
3 : Permit noncommercial radio and television transmitting
antennae in all residential districts as accessory uses

a plot plan meeting certain criteria.
4 . Authorize the Zoning Board of Adjustment (via a Special
Exception Use Permit) to review satellite dishes, radio
and television receiving and transmitting antennae, and
telecommunication towers exceeding the maximum height
regulations established in Section 34 , "Accessory Uses . "
5 . Delete Section 34 . 1 (u) and create Section 34 . 1 (cc) for
antennae and towers and Section 34 . 1 (dd) for commercial
satellite dishes to permit them in the 0-1 and C-1 zoning
districts in addition to those districts shown.
6 . Require only a plot plan be reviewed for Specific Use
Permit No. 25, "temporary concrete batching or transient
mix plant exceeding 90-day approval plus ( 1) 30-day
extension.

Portable buildings approved as a specific use shall be subject to the
following requirements (as amended by Ordinance No. 480 A) :
a. Approval of a portable building shall be on a temporary basis
only. Any permit granted hereunder shall be for a maximum
period of three (3) years subject to renewal for additional one
(1) year periods .
b. All portable buildings shall be constructed in accordance with
• the appropriate state or federal code which regulates their
construction or shall meet all requirements of the City' s
building codes .
c . Portable buildings shall be placed upon a permanent foundation
and shall have a masonry facade meeting the requirements of the
City' s Masonry Ordinance . In addition, hard surfaced parking
shall be provided for portable buildings . The City Council
