Bob Jones Good Morning Mr. Killough. Mr. Killough, I am writing this memo requesting to be put on the docket for the January 4th, 2022 City Council meeting, requesting a Variance for 500 E. Bob Jones. The reason for the variance request is regarding a sidewalk requirement, that has ju st come to light 12/14/21. If I may, I am the registered builder (TRS Custom Homes) building the new residence at the referenced address. When the permit was authorized for the residential new building # NRES20 - 0044 by the City of Southlake, back on 9/23/2020. There was NO notation regarding a side walk requirement. Additionally, I applied for a separate Residential Accessory Building permit and it was granted on #RACB 20-0061, dated 9/23/2020 that also did NOT have any notation regarding a side walk requirement. On 12/13/21, I requested through proper channels a final inspection, only regarding the residence # 0044. I have received the final inspection report and it was determined that I failed the inspection. I was told at the end of the inspection that I had passed with three (3) small exceptions and to have them taken care and reported back to the inspector with pictures completed. #1 Add combo smoke and carbon inside of mud room. (Smoke only had been installed). #2 Mixing valve needed to master bathroom for tub. #3 Top step on bottom stair case needs to be adjusted out of level 1/4 inch. There was now an additional item added to the list. #4 "The lot is required to install a sidewalk across the frontage of the property" First three (3) items have already been called in for correction and scheduled for Thursday the latest. This being the first time that I was told about this requirement has created some real issue's. As a point of information before I explain the issues, its important to note that 500 E. Bob Jones is an Eight (8) + acre Estate and has a frontage of 524 feet. With Corps p roperty to the east and north to the lake. As I have been attending the property for almost two years, I can say that there is not a sidewalk to be seen from White Chapel for approximately a mile or so to the property (on either side). I have also driven connecting streets adjacent to Bob Jones and none of them have side walks. Issues regarding installation of side walk; #1 I have tied in with the neighbor to the West fence post, to install a very expensive four (4) rail metal coated black fence that runs the full length of the property 524 feet This will have to be completely removed and redone. Who covers that cost when we were not told about the side walk ? #2 We have already poured the entry way and now building two (2) column s 30" X 30" X 72" to maintain the double custom gate along with underground electric for the opener and column lights. Also we have poured adjacent pad site to the entry for the matching rock mail box, that I have already discussed with the mail folks to be sure we have matched there requirements. During the inspection, no one said anything about a side walk. It passed inspection and nothing was mentioned regarding a side walk. Any and all adjustments for pulling in the side walks, again who covers that cost? #3 There are two massive trees located right where the side walk will go through. We spent a great deal of money preserving, trimming and protecting the trees. I can say for a fact that we will loose both trees, as the side walk will go right through them. Who will cover the cost to replace them? #4 Atmos gas riser will have to be moved, as the side walk will go right through it. It passed city inspection, prior to meter set. Again who covers that cost? #5 Excluding the cost of the concrete there will be a need for, a few days worth of excavation, as we have already completed our drainage excavation. Another cost on top of the concrete material and labor. Mr. Killough, as you can see, with regards to the permit department leaving out a critical piece of information, it has in fact, created major issues and cost considerations.
