Action Requested: Approve a Commercial Developer Agreement (CDA) with Marriage Today for the XO Marriage Center development in an amount of $78,911. Background Information: The proposed XO Marriage Center development’s site requires Kirkwood Boulevard to be extended to the eastern property boundary to allow for access onto Kirkwood Boulevard. Kirkwood Boulevard is identified as a 4D Arterial (4-lane divided) and is currently constructed as a 4-lane divided roadway (striped as a 2-lane divided roadway) up to approximately 170-feet east of Grace Lane and then transitions to a 2-lane roadway. The Developer has agreed to extend the 4-lane pavement half-street section up to the eastern property line with a transition to a 2-lane roadway, similar to existing conditions. The remainder of Kirkwood Boulevard, east of the property, will be completed with the remainder of the Gateway Church campus development. The Developer plans to construct approximately 370 linear feet of the half-street pavement section of Kirkwood Boulevard, to include curb, storm drain inlet, and a temporary transition lane. The existing 12-inch waterline within Kirkwood Boulevard ends just west of Grace Lane, and per City Code of Ordinances, must be extended to the edge of the proposed property for future connectivity to the east. The City also requires that all public water lines be a minimum of 8-inch in diameter. Since the existing water line within Kirkwood Boulevard is a 12-inch pipe, the Developer agreed to install a 12-inch pipe rather than the minimum 8-inch pipe up to their eastern property line. The pipe size for the waterline within Kirkwood is not identified on the Water Master Plan and is therefore defaulted to the minimum required pipe size of 8-inches. Item 4B Page 2 of 3 During the entitlement process, City Council stated that any offsite improvements to Kirkwood Boulevard be roughly proportional to the proposed development. Per this determination, the City has agreed to reimburse the Developer for the cost difference of oversizing the 8-inch waterline to a 12-inch waterline within Kirkwood Boulevard, as well as to reimburse the extension of Kirkwood Boulevard with the Roadway Impact Fees. Financial Considerations: Funding for the CDA for the XO Marriage Center development is budgeted as part of the approved Capital Improvement Program. It specifically relates to the City’s Corporate Objectives, C4: Attract & Keep Top- Tier Businesses to Drive a Dynamic & Sustainable Economic Environment, and B2: Collaborate With Select Partners to Implement Service Solutions. The Critical Business Outcomes are, CBO3: Engage in Thoughtful Planning to Ensure Continued High Quality Development That is Integrated Well Into The Current Built Environment, and CBO5: Improve Quality Of Life Through Progressive Implementation Of Southlake’s Comprehensive Plan Recommendations. Citizen Input/ Board Review: None. Legal Review: The proposed agreement is a standard agreement that the City Attorney has reviewed and approved. Alternatives: The City Council may approve or deny the agreement.
