Members Absent: Board members Michael Quinones — Place 1, Trey Verbick — Place 3, Heather King — Place 4, Britton Wells- Alternate 1, and Robert Kemins —Alternate 2. Staff Present: Dennis Killough, Deputy Director of Planning & Development Services, Richard Schell, Principal Planner, Andrea Parrott, Board Secretary and Carol Nemoto, Board Secretary REGULAR SESSION: Agenda Item No. 1 - Call to Order: Chairman Medici called the Regular Session to order at 6:32 P.M. Aaenda Item No. 2 - Executive Session: No Executive Session was held Agenda Item No. 3 - Approval of the Minutes: Chairman Medici opened the discussion of the minutes of the Zoning Board of Adjustment meeting held on September 30, 2021, A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on September 30, 2021. Motion: Treichler Second: Sexton Ayes: Medici, Treichler, Snead, Sexton Nays: None Abstain: None Vote: 4-0-0 Motion: Approved Agenda Item No. 4 -Administrative Comments: Richard Schell, Principal Planner, announced that next scheduled Board of Adjustments meeting is October 28'h and that there are three submittals for that meeting. Agenda Item No. 6 - ZBA21-0026, Special Exception Use per Ord. No. 480, as amended, Section 44.12(6) for a reduction in the required setback from property lines for a residential accessory structure on property described as Lot 13, Block 1, Whispering Dell Estates, an addition to the City of Southlake, Tarrant County, Texas, and located at 1216 Whispering Ln., Southlake, Texas. On behalf of the applicant, Justin and Ashley Pace, Robert Leeper, of Paragon Design, is requesting to seek approval of a Special Exception Use per Ord. No. 480, as amended, Section 44.12(2) for accessory buildings or structures of a size or aggregate size greater than that permitted to allow an approximately 1,098 square foot cabana to be constructed on a lot with SF-30 zoning, which allows a maximum of 750 square feet for the sum total of all accessory buildings and structures on the lot. Chairman Medici opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. Robert Leeper, 630 E Southlake Blvd., Southlake, TX 76092, the applicant, on behalf of the owner, Justin and Ashley Pace, once sworn in, presented testimony, and answered questions from the Board. Chairman Medici asked if there were those in the audience who wished to speak in support of the request. Justin Pace,1090 and 1100 Primrose Ln., Southlake, TX, the property owner, once sworn in, spoke in support of the request. Chairman Medici asked if there were those in the audience who wished to speak against the request. There being none, Chairman Medici called upon the applicant or the applicant's representative for a brief rebuttal. There being none, Chairman Medici closed the public hearing and opened the item for discussion from the Board. A motion was made to Approve case ZBA21-0026 Motion: Sexton Second: Snead Ayes: Medici, Treichler, Sexton, Snead Nays: None Abstain: None Vote: 4-0-0 Motion: Approved Agenda Item No. 6 - ZBA21-0027, Variance to Zoning Ordinance No. 480, as amended, Section 11.5.c requiring a side yard of note less than 20' on property described as Lot 16, Block B, Quail Creek Estates, an addition to the City of Southlake, Tarrant County, Texas, and located at 1005 Quail Run Rd., Southlake, Tarrant County, Texas. Current Zoning: "SF-1K Single Family Residential District. Planner Schell presented details of the case with a slide show presentation to the Board. On behalf Zoning Board of Adjustment Meeting Minutes — October 14, 2021 Page 2 of 3 of the applicant, Matthew McGregor, Black Door Renovations, located at 2106 E. S.H. 114, is requesting a Variance to Zoning Ordinance No. 480, Section 11.5.c, requiring a minimum 20' side yard setback, to allow an approximately 1,596 square foot porch and storage addition to the principal residence to be located approximately 15' from the side property line. The existing home was constructed in 1986 when the zoning at the time required a 15' side setback. The proposed porch addition is shown to be in line with the existing home setback. Chairman Medici opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. Chairman Medici asked if there were those in the audience who wished to speak in support of the request. Todd Harris, 1005 Quail Run Rd., Southlake, TX, the property owner, once sworn in, spoke in support of the request. Chairman Medici asked if there were those in the audience who wished to speak against the request. There being none, Chairman Medici called upon the applicant or the applicant's representative for a brief rebuttal. There being none, Chairman Medici closed the public hearing and opened the item for discussion from the Board.
