2021-11-11 ZBA MinutesCITY OF SOUTHLAKE TEXAS ZONING BOARD OF ADJUSTMENT MEETING: November 11, 2021 LOCATION: 1400 Main Street, Southlake, Texas Regular Session -Council Chambers in Town Hall Members Present: Chairman Jeff Medici, Board Members Michael Quinones - Place 1, Trey Verbick - Place 3, Heather King - Place 4, and Robert Kemins — Alternate 4. Members Absent: Vice Chairman David Treichler, Board Members Britton Wells — Alternate 1, Clinton Snead — Alternate 3 and Alex Sexton — Alternate 4. Staff Present: Dennis Killough, Deputy Director of Planning and Development Services Richard Schell, Principal Planner, and Andrea Parrott, Board Secretary REGULAR SESSION: 1. Call to Order: Chairman Medici called the Regular Session to order at 6:33 P.M. 2. Executive Session: No executive session was held. 3. Approval of the Minutes: Chairman Medici opened the discussion of the minutes of the Zoning Board of Adjustment meeting held on October 14, 2021. A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on October 14, 2021. Motion: Kemins Second: Quinones Ayes: Medici, Quinones, Verbick, King, and Kemins Nays: None Abstain: None Vote: 5-0-0 Motion: Approved 4. Administrative Comments: Richard Schell, Principal Planner, announced that the Zoning Board of Adjustment meeting that is normally scheduled as the 2"d meeting in November will fall on Thanksgiving, so that meeting is not scheduled. The next scheduled meeting for the Zoning Board of Adjustment is December 16, 2021 and one item has been received for that meeting so far. The December 16, 2021 meeting is the last scheduled meeting in this calendar year. 5. Consider: ZBA21-0015, Special Exception Use per Ord. No. 480, as amended, Section 44.12(6) for a reduction in the required setback from property lines for a residential accessory structure on property described as Lot 6, Block 3, Emerald Estates, an addition to the City of Southlake, Tarrant County, Texas, and located at 2404 Taylor St., Southlake, Texas. Current Zoning: "SF-1 A" Single Family Residential District. The applicant has requested to table this item to the February 24, 2022 Zoning Board of Adjustment meeting. There being no objections, Chairman Medici called Item No. 6 on the agenda, Case No. ZBA21- 0028. 6. ZBA21-0028, Special Exception Use per Ord. No. 480, as amended, Section 44.12(7) for accessory buildings located forward of the principal building on the lot on property described as Tracts 5C1G2, 5C1H, 5S1 and 5T, Samuel Freeman Survey, Abstract No. 525, City of Southlake, Tarrant County, Texas, and located at 2750 Raintree Dr., Southlake, Texas. Current Zoning: "SF-1A" Single Family Residential District. Planner Schell presented details of the case with a slide show presentation to the Board. On behalf of Rachel M. Rosenthal and Brian S. Jetty, Eduardo Dimas of Edge Construction, LLC is requesting approval of a Special Exception Use per Ord. No. 480, as amended, Section 44.12(7) for accessory buildings located forward of the principal building on the lot to allow an approximately 2,537 square foot garage including a 646 square foot conditioned space and outdoor living area to be located forward of the principal residence. Staff has determined that the conditioned portion of the garage does not meet the definition of a separate dwelling unit since the kitchen is an outdoor kitchen. The only request being considered by the Zoning Board of Adjustment is for the building to be located forward of the principal building on the lot. Chairman Medici opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. The applicant, Eduardo Dimas of Edge Construction, LLC, 2814 Dogwood Park Dr., Richland Hills, TX, and the property owner, Brian Jetty, 2750 Raintree Dr. Southlake, TX, once sworn in, presented testimony and answered questions from the Board. Chairman Medici asked if there were those in the audience who wished to speak in support of the request. There being none, Chairman Medici asked if there were those in the audience who wished to speak in opposition to the request. Consider: ZBA21-0030, Special Exception Use per Ord. No. 480, as amended, Section 44.12(6) for a reduction in the required setback from property lines for a residential accessory building on property described as Lot 46, Block 3, Timber Lake Addition, Phase 1, an addition to the City of Southlake, Tarrant County, Texas, and located at 808 Timbercrest Ct., Southlake, Texas. Current Zoning: "R-PUD" Residential Planned Unit Development District. Planner Schell presented details of the case with a slide show presentation to the Board. The applicant and owner, Benjamin Levine, is requesting approval of a Special Exception Use per Ord. No. 480, as amended, Section 44.12(6) for a reduction in the required setback from property lines for a residential accessory building to allow an approximately 450 square foot outdoor kitchen to be located approximately 11' from the front property line (or side lot line adjacent to a street). The required setback is 30' per the "R-PUD" zoning and the plat. Chairman Medici opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. The applicant and owner, Benjamin Levine, 808 Timbercrest Ct., Southlake, TX, once sworn in, presented testimony and answered questions from the Board. Chairman Medici asked if there were those in the audience who wished to speak in support of the request. There being none, Chairman Medici asked if there were those in the audience who wished to speak in opposition to the request. There being non, Chairman Medici closed the public hearing and opened the item for discussion from the Board. A motion was made to approve case ZBA21-0030. Consider: ZBA21-0029, Variance to Zoning Ordinance No. 480, as amended, Section 14.5.d requiring a rear yard of not less than 40' on property described as Lot 32, T.M. Hood No. 706 Addition, an addition to the City of Southlake, Tarrant County, Texas, and located at 1100 Shady Oaks Dr., Southlake, Texas. Current Zoning: "SF-20A" Single Family Residential District. Planner Schell presented details of the case with a slide show presentation to the Board. On behalf of Jagadeeshwar Aileni, Amr Elborai, Elborai Group, LLC, is requesting approval of a Variance to Zoning Ordinance No. 480, as amended, Section 14.5.d requiring a rear yard of not less than 40' to allow a rear setback of approximately 30'9" for the principal residence. Chairman Medici opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. The applicant, Amr Elborai, Elborai Group, LLC, 720 S. Kimball Ave., Southlake, TX, once sworn in, presented testimony and answered questions from the Board. Chairman Medici asked if there were those in the audience who wished to speak in support of the request. There being none, Chairman Medici asked if there were those in the audience who wished to speak in opposition to the request. There being none, Chairman Medici closed the public hearing and opened the item for discussion from the Board. A motion was made to approve case ZBA21-0029.
