SB Item 7Case No. SV21-0025 S T A F F R E P O R T November 12, 2021 CASE NO: SV21-0025 PROJECT: Sign Variance for Parkview Residences EXECUTIVE SUMMARY: 2016 Parkview Development, is requesting approval of a sign variance to Sign Ordinance No. 704, as amended, to allow the building white accent lighting and to allow the lights to change color for the holidays. The property is located at 350 Central Avenue, Southlake, Texas. REQUEST DETAILS: The Parkview Residences property is located on the southwest corner of Central Avenue and Federal Way. The building’s current accent lighting was installed during building construction but has been turned off awaiting processing of a variance. The applicant is requesting approval to allow the white accent lighting and to be allowed to change color for several holidays with specific dates for the color change. The proposed holiday schedule and colors are listed below: Holiday Dates Colors Valentine’s Day February 12th – 15th Red St. Patrick’s Day March 15th – 19th Green July 4th July 1st – 5th Red, White, and Blue Halloween October 28th – 31st Orange Christmas Holidays December 1st – 30th Red and Green Sparkle New Years’ Eve December 31st Simulates a ball dropping The illumination of the building is only at night and no lighting would be on during daylight hours. ACTION: Consider Approval of Requested Variance ATTACHMENTS: (A) Background Information (B) Vicinity Map PowerPoint Presentation Demonstration Narrative STAFF CONTACT: Dennis Killough (817)748-8072 Patty Moos (817)748-8269 Case No. Attachment A SV20-0025 Page 1 BACKGROUND INFORMATION APPLICANT: 2016 Parkview Development, LLC PROPERTY SITUATION: 350 Central Avenue, Southlake LEGAL DESCRIPTION: Lot 4, Block 4R1, Southlake Town Square Phase I HISTORY: June 5, 2018; City Council approved two off-site development signs (one V-shaped sign) located at the SE corner of Central Avenue and SH114 for period ending June 30, 2020 or such time as construction is completed, whichever comes first; allowing one wayfinding sign measuring up to 3’ x 5’ at the NW corner of Central Avenue and FM 1709 for period ending June 30, 2020 or such time as construction is completed, whichever comes first; and allowing three temporary construction signs placed on Parkview Residences construction fence along Central Avenue per the exhibit this evening for period ending December 31, 2019 or such time as construction is completed, whichever comes first. (SV18-0002) April 20, 2021; City Council approved a sign variance for one (1) existing off-site sign for the Parkview Residences located at E. SH 114 and Central Avenue for a 1-year period. STAFF COMMENTS: City Council approval of the proposed signs does not eliminate the requirement for appropriate sign application submittal prior to the installation of the sign. Variance Authorized. The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. b. Approval Standards. In granting any variance, City Council shall consider the following criteria: (i) Special conditions exist which are peculiar to the land, structure or building involved and are not applicable to other lands, buildings or structures in the same zone. The City may attach such conditions to granting all or a portion of any variance necessary to achieve the purpose of this ordinance, and; (ii) The strict interpretation of the provisions of the Case No. Attachment A SV20-0025 Page 2 ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zone under the terms of the ordinance, and; (iii) The special conditions and circumstances do not result from the actions of the applicant and such conditions and circumstances do not merely constitute pecuniary hardship or inconveniences, and; (iv) Granting the variance will meet the objectives of the ordinance and not be injurious to the adjoining property owners or otherwise detrimental to the public welfare, and; (v) The request will be the minimum variance necessary to alleviate the special hardship or practical difficulties faced by the applicant in meeting the requirements of this ordinance; and; (vi) Granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. (vii) Granting of a variance shall be specific to the subject sign(s). Any modification of the signage approved by the variance or the installation of new or replacement signage that does not meet the specific requirements of the City Council variance approval is prohibited and will be deemed non-compliant. Application Process. Any request for a variance shall be made to the Administrative Official and be accompanied by a completed application and a non-refundable filing fee in the amount specified in the current fee schedule adopted by City Council. The sign variance will be considered by the City Council following a recommendation by the Sign Board. The Sign Board’s recommendation will be forwarded to the City Council for their consideration.
