Item 9ASOUTHLAK.E PLANNING &DEVELOPMENT SERVICES STAFF REPORT Novwember 9, 2021 CASE NO: SV21-0021 PROJECT: Sign Variance for Mody Southlake EXECUTIVE SUMMARY: On behalf of Southlake Commons Holdings, LLC, DeVleer Consulting Services is requesting approval of variances to Sign Ordinance No. 704, as amended, for their new building located at 2101 E. Southlake Blvd., Southlake, Texas. DETAILS: Case No. SV21-0021 The property is located at the southeast corner of the E. Southlake Blvd. and S. Village Center Drive. The applicant is requesting variances to Sign Ordinance No. 704, as amended, to allow upper story signs (up to two (2) on the north and east facades), two monument signs, and upper story white cove lighting on the east, north, and west elevations of the building. The upper story signs may not be congruent with the lease spaces as the tenants and the lease areas have not been determined at this time. Southlake Blvd. HISTORY: This is a building currently under construction — no sign history The following describes development history at this location: -A zoning change and concept plan for "0-1" Office District zoning for Gumm Professional Offices was approved for a portion of Lot 2 (the subject lot) and the two adjacent Tracts to the south April 17, 2001 (Lots 3 & 4) (ZA00-126). -A site plan for Bank One was approved for Lot 2 (the subject lot) September 4, 2001 (ZA01-068). -A sign variance for Modia Home Theatre Store was approved by City Council April 16, 2013 (SV13-005) October 15, 2013; City Council approved a zoning change and site plan from "0-1" Office District to "S-P-1" Detailed Site Plan District to allow limited "C- 2" Retail Commercial District uses to construct a two-story, 8,800 square foot addition on to the existing one-story, 4,100 square foot bank building on site now and currently occupied by Modia Home Theatre store; noting approval of the variance to the driveway ordinance; the clock depicted on the building renderings will be a working clock; green screening wall on the south elevation will be enhanced with a cross vine vegetation; applicant will extend the stone planter on the eastern side of the north elevation similar to what is depicted on the west side of the north elevation; and, the applicant will frame the doors on the north elevation complementary to the other doors noted on the renderings presented to Council.(ZA13-075) SIGN BOARD: October 21, 2021; Approved (6-0) subject to the Staff Report dated October 15, 2021; Approval of the cove lighting, not visible and to be white light; denying the second monument sign `B'; and limiting the upper story signage to one (1) upper story sign, not two as requested. STAFF COMMENTS: Since the Sign Board meeting, the applicant is requesting to proceed with the original sign variance requests for the two monument signs and upper story building signs for the City Council meeting. City Council approval of the proposed signs does not eliminate the requirement for appropriate sign application submittal prior to the installation of the sign. Variance Criteria: Case No. Attachment A SV21-0021 Page 1 9.6.2 VARIANCES Variance Authorized. The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. Approval Standards. In granting any variance, City Council shall consider the following criteria: (i) Special conditions exist which are peculiar to the land, structure or building involved and are not applicable to other lands, buildings or structures in the same zone. The City may attach such conditions to granting all or a portion of any variance necessary to achieve the purpose of this ordinance, and; (ii) The strict interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zone under the terms of the ordinance, and; (iii) The special conditions and circumstances do not result from the actions of the applicant and such conditions and circumstances do not merely constitute pecuniary hardship or inconveniences, and; (iv) Granting the variance will meet the objectives of the ordinance and not be injurious to the adjoining property owners or otherwise detrimental to the public welfare, and; (v) The request will be the minimum variance necessary to alleviate the special hardship or practical difficulties faced by the applicant in meeting the requirements of this ordinance; and; (vi) Granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. (vii) Granting of a variance shall be specific to the subject sign(s). Any modification of the signage approved by the variance or the installation of new or replacement signage that does not meet the specific requirements of the City Council variance approval is prohibited and will be deemed non -compliant. Application Process. Any request for a variance shall be made to the Administrative Official and be accompanied by a completed application and a non-refundable filing fee in the amount specified in the current fee schedule adopted by City Council. The sign variance will be considered by the City Council following a recommendation by the Sign Board. The Sign Board's recommendation will be forwarded to the City Council for their consideration.
