1987-06-02 CC Packet • I INTERLOCAL COOPERATION AGREEMENT 1 . Parties . This Agreement is by and among the following parties : City of Southlake 667 N. Carroll Ave . Southlake, Texas 76092 Town of Trophy Club P.O. Box 1110 Trophy Club, Texas 76262 Trophy Club Municipal Utility District Number 1 P .O. Box 130 Trophy Club, Texas 76262 2 . Purpose . This Agreement is to state the terms upon which the parties have agreed to work together to collectively improve the efficiency and effectiveness of emergency fire and medical protection of the parties . 3 . Interlocal Cooperation. Agreement. This Agreement is made pursuant to the Interlocal Cooperation Act, Article 4413 (32c) of the Texas Revised Civil Statutes. 4 . Term. this Agreement shall be effective for a term cf one (1) year; provided, however, that any party may terminate its participation in this Agreement before the expiration of the one (1) year term by giving thirty (30) days written notice to all other parties of the withdrawing party' s intent to withdraw from this Agreement. 5 . Requests for Assistance. Upon request by a party to this Agreement, the other parties shall provide fire and/or medical assistance to the party requesting such service. All requests for mutual assistance are to be made through the emergency dispatch facility of the City of Southlake. 6 . Geographical Area. The mutual assistance in this Agreement is to cover the geographical areas of responsibility of all parties , including but not limited to the Southlake fire and medical districts , the Trophy Club fire and medical districts, the IBM properties, and the City of Westlake. 7. Authorization. By execution of this Agreement, each party warrants and covenants that the fire and medical services provided for in this Agreement are services which each party is legally authorized to perform. Furthermore, each party warrants 11/ and covenants that this Agreement has been duly authorized by its governing body. 1 8 . Execution. This Agreement is executed in multiple • counterparts so that each party may retain a fully executed counterpart in its files . 9 . Effective Date. Dove Southlake , Texas 76092 Dear Johnny : We are continuing our work as the regular session draws to a close . Several nundred nor.2 5 1 � ''' C here out we remain in a stalemate over the budget . There is progress , but unfortunately it is occurring very slowly. 411 The House has proposed to cut our budget by almost a billion dollars ; the Senate has trimmed their version a bit and the Governor has increased his tolerance level , but we are still several hundred million dollars apart . We are getting closer to a solution but are likely to be back this summer in a special session . If you have a vaca- tion planned in this direction feel free to stop by . I have contacted the State Department of Highways and Public . Transportation regarding state funding of the curb and guttering of certain projects . According to the Department , Minute order #85615 was adopted on April 30 , 1987 . That order amends their current practices by allowing the state to fund the curb and guttering of certain future projects along state numbered routes . I inquired into the possibility of a project such as the proposed improvements to FM-1709 being eligible for curb and gutter funding from the state . Because of the effective date of the minute order (May 28 , 1987 ) , and the fact that the contract between Tarrant County, Southlake , Keller , and the state was agreed to in 1985 , it would not be possible for the state to assist with funding . 111 According to the Department , several entities throughout the state , i . e . , the city of Beaumont and Galveston County have made formal requests to the Commission for similar assist- P.O. BOX 2910 • AUSTIN,TEXAS 78769 • 512-463-1000 1 ance and were denied . The Department states that for obvious reasons they are unable to make the order retroactive . It is unfortunate that this is the case but it certainly was worth a try . In further visiting with the Department on FM-1709 , they informed me that provided all parties reach an early agreement on the alignment near near the cemetery in Southlake , we can expect a contract letting as early as the Spring of 1989 .
