MEMBERS ABSENT: Daniel Kubiak. STAFF PRESENT: Sr. Director of Planning and Development Services Ken Baker; Deputy Director of Planning & Development Services Dennis Killough; and Commission Secretary Lydia Ruiz. WORK SESSION: 1. CALL TO ORDER: 2. Executive Session: Pursuant to the Open Meetings Act, Chapter 551, Texas Government Code, Sections 551.071. Refer to posted list attached hereto and incorporate herein. Executive Session may be held, under these exceptions, at the end of the Regular Session or at any time during the meeting that a need arises for the Planning and Zoning Commission to seek advice from the City Attorney as to the posted subject matter of this Planning and Zoning Commission meeting. Section 551.071: Consultation with attorney. No executive Session was held. 4. Recap of City Council’s action and discussion on Planning and Zoning recommended cases; questions were asked. 4. A motion was made to approve item 7, subject to the staff report dated October 1 5, 2021, the concept/site plan review summary #5 dated October 15, 2021; and acknowledging the agreement by the Developer to create an Owner’s Association to ensure proper maintenance of the buildings in the complex; and an agreement to construct the underground detention pond as originally presented at the last meeting; and approving the variances requested. Acting Chairman Forman closed the public hearing for item 8. Applicant John Terrell came forward to answer additional questions from Commission. A motion was made to approve item 8, subject to the staff report dated October 15, 2021, the development plan review summary #4 dated October 15, 2021; and further acknowledging the agreement of the Developer to ensure there is landscaping fronting Riviera Lane in the event the HOA does not approve the assimilation of this project into the existing Carillon HOA; acknowledging the Developer’s Agreement to continue to have discussions with the City and the Parks Board surrounding maintenance of the fountain itself and the water features; acknowledging the site infrastructure, the park and fountains, Planning & Zoning Commission Meeting Minutes – October 21, 2021 Page 5 of 6 are all part of Phase 1, and before those are completed and there is no release of the residential lots until such time they are completed and the infrastructure has been accepted by the City; and an agreement by the Developer to take forward to City Council additional renderings for the library screening as recommended and agreed to in discussions with the residents across from the library; and further approving the variances as requested by the Developer.
