Item 7A City of Southlake, Texas MEMORANDUM May 3, 2002 TO: Billy Campbell, City Manager FROM: Ricky Black, Director of Public Safety(Ext. 2421) SUBJECT: Request for a variance to Lighting Ordinance No. 693-B for Thomas Soccer Fields located at 845 S. Kimball Avenue. Action Requested: City Council consideration of lighting ordinance variance for Thomas Soccer Fields. Background Information: Mr.Dalen Thomas has a pending request for zoning and concept plan approval(Case No. ZA 020-02) for the subject property. In order to develop it as he desires, he is also requesting a variance to the Lighting Ordinance. The request is specifically to vary three standards in the ordinance. First, section 4(b.)to allow Metal Halide (white) light fixtures instead of the high pressure sodium type specified. Second,to vary section 5 (b.) to exceed the maximum light permitted on site from 20 footcandles to an average of 51.88 on the playing fields with a maximum spot level to be 74.5 footcandles. Third to vary section 5 (a.)the lighting limit at the property line from the 5 footcandles permitted to 36.8 footcandles on the east and south property lines and 13 footcandles on the west property line (Kimball Ave. R. O.W.). There is no request for variance to the north. It should be noted there is not a request for variance to the glare issue as required by sections 4(d.) and 8 (c.) of the ordinance. The applicant has, at the request of Building Services, specifically committed that no fixtures will produce a hazardous glare to traffic on Kimball Avenue as determined by the Chief Building Official. Also, at the previous City Council meeting on April 16,2002, the applicant withdrew his request to illuminate the north field adjacent to residential property. Financial Considerations: Not Applicable 1 Billy Campbell May 3, 2002 Page 2 Citizen Input/ Board Review: Public Hearings have been held on the related zoning case by the Planning and Zoning Commission on March 27, 2002 and by the City Council on April 16, 2002. Letters have been received from the adjacent property owners to the south and east stating they have no objection to the proposed lighting plan. Legal Review: None requested. Alternatives: The council may approve the variances as requested, approve them subject to whatever changes or conditions they deem appropriate, or they may deny it. Supporting Documents: Lighting Ordinance 693-B, L Sections 4 (b.), (d.), 5 (a.), (b.), 8 (c.) and 10 Letter of application Site plan with lighting photometrics. Staff Recommendation: Place the lighting variance request on the May 7, 2002 City Council meeting agenda for consideration at the time of the second reading of ZA 020-02. RB/cb 2 L SECTION 4. LIGHTING DESIGN (b.) Luminaires on poles over 42 inches in height and exterior wall mounted light fixtures shall be high pressured sodium lights or other lights giving a similar soft lighting effect. The building official may approve alternate lighting if he finds that it: (1) provides at least approximate equivalence to the applicable specific requirements of this Ordinance; and (2) is otherwise satisfactory and complies with the intent of this Ordinance. (d) Luminaires causing glare at property line or in vehicle areas on streets or parking lots are prohibited. SECTION 5. ILLUMINATION (a) The intensity of illumination pr classification of the neighboring property and shall not exceed the following intensities, as measured from the property line of the neighboring property: Footcandles Footcandles Si Zoning of Neighboring Property Horizontal Vertical Agricultural, Single-family, and two-family residential districts 0.2 0.5 Multiple-family residential districts 0.5 0.5 Nonresidential districts, streets 3.0 3.0 Light industrial districts 5.0 5.0 (b) The maximum outdoor computed or measured illumination level on a property shall not exceed 20 foot candles outdoors at any point, except that lighting under canopies (such as service stations) shall not exceed 30 foot candles. SECTION 8. ENFORCEMENT. (c) Shielding. Luminaires shall be aimed in such a manner that the viewer's eye, five feet above ground at or beyond the property line, shall not be exposed to fixture luminance within the floodlight beam of the luminaire. If such luminaires cannot be aimed they shall be shielded such that the light source is effectively concealed from view from the neighboring property. Shielding may be accomplished by louvers, baffles, visors, or shields placed on the luminaires, or by plantings, fences, berms, elevation, or any other method such that the limitations of Section 7 hereof are met. 3 L, SECTION 10. APPEALS; VARIANCES; MODIFICATIONS (a) A person may request a modification or variance from the provisions of this Ordinance. The person shall submit an application for a variance to the building official on forms prescribed by the building official. (b) A person who is dissatisfied with the decision of the building official may file an appeal. The person may file an appeal not more than 10 days after the determination of the building official. The person shall submit an appeal to the building official on forms prescribed by the building official. (c) The city council, after receiving a recommendation from the planning and zoning commission, may grant a modification or variance from the provisions of this Ordinance in either of the following circumstances: (1) Upon fording that strict application of the Ordinance would not forward the purposes of this Ordinance, or that alternatives proposed by the applicant would satisfy the purposes of this Ordinance at least to an equivalent degree. (2) Upon finding that an outdoor light, or system of outdoor lights required for a particular use cannot reasonably comply with the standard and provide sufficient illumination for safety, as determined by recommended practices adopted by the Illuminating Engineering Society of North American for the particular use or other evidence submitted by a professional engineer. Three of these fields are adjacent to each other and run along the Southern border of our property. A fourth field is a stand alone field at the North end of our property. At the City Council Meeting on April 16th we agreed to withdraw our request to light the fourth field to the North. Thus,the following applies to the three fields to the South. Lighting Descriotiog The following description and the attached photometrics are based on a proposal submitted to us by Musco Sports Lighting. The Musco proposal is as follows: thy Three poles on each side of each field. The six poles around the center field would light the fields on either side in a back-to-back configuration. The poles are 60'in height. The position of the poles is as displayed on the attached concept plan. The average on field illumination is estimated to be 51.88 footcandles The range of on field illumination is estimated to be 37.3-74.5 footcandles The average spill illumination at the property lines to the East and the South is estimated to be 20.5 footcandles The range of spill illumination at the property lines to the East and the South is estimated to be 1.1-36.8 footcandles The average spill illumination at a distance of 50'from any of the three fields is estimated to be 4.9 footcandles The range of spill illumination at a distance of 50'from any of the three fields is estimated to be 0.8-6.7 footcandles (Note: Our neighbors to the East and the South, Southlake Schools and Mr.Ralph Segars respectively, have each provided us with a letter stating that they are agreeable to these levels of spill illumination.)
