4 MEMORANDUM L May 3, 2002 TO: Billy Campbell, City Manager FROM: Bruce Payne, Planning Director CASE NO: ZA 99-100 SUBJECT: Variance to the Subdivision Ordinance No. 483, Section 4.01(I)2 (Plat Expiration), as amended, Extending the Validity of Case No. ZA 99-100, Plat Revision -Lot 1R2R, W.W. Hall No. 695 Addition (Crestwood Offices Ph. 2) On March 21, 2000 the City Council approved the above referenced plat. This plat has not been filed in the County Plat Records. The last extension expired on March 21, 2002. An additional extension is needed because of delays with the completion and filing of City right-of-way quit claim, a land swap and an amended plat affecting one of the lots being incorporated into this plat. The owner, Greenway Investment Company, has requested that the validity of this plat be extended until September 21, 2002 to allow more time to complete the noted issues. Because this plat has expired, a variance to Section 4.01(I)2 of Subdivision Ordinance No. 483, as amended, (shown below) will tow be required if the extension is to be granted. "2. All other plats: A Final Plat, Plat Revision, Amended Plat or a Plat Showing which has not been recorded in the County Plat Records within one year of the date of approval shall expire. " A letter from Greenway Investment Company, a location map and a reduced copy of the plat is attached for your convenience. Due to time required for the City to complete the quitclaim of the Old North Carroll Avenue prescriptive right-of-way and the time required to record the Amended Plat for Lots I &2,Block 9 of Southlake Town Square. some information pertaining to this plat revision has yet to be obtained. Consequently, it is premature to file the referenced plat revision at this time. Furthermore. the owners of this property are currently finalizing an exchange agreement that involves certain considerations associated with this plat revision and do not wish to tile the plat prior to the current filing deadline. The Southlake City Council approved the plat revision on March 21, 2000. The City has extended the filing deadline to March 21,2002. We request that the deadline he extended by six months to September 21,2002 to allow for deed and plat recording information to be obtained and reflected on this document and for all necessary agreements to he finalized.
