The meeting was called to order by
Charles Curry, Mayor Pro Tem. Curry
announced that the reason for the
Emergency meeting was to consider
agreements in regards to County Road
Repair , as drawn up by the Legal
Department of Tarrant County for
Bob Hampton, County Commissioner
of Precinct No . 3 .
Curry stated that the urgency exists
because the County Commissioners
meet on Monday mornings . If the
City wishes the County to continue
work on Dove Road we must have the
signed agreements in their office by
Thursday in order to get on their
agenda . If we do not get on the
agenda for their Monday morning
meeting , they will pull off work in
Southlake for an undetermined length
of time .
Council went into closed session
as per V.T .A. S . Article 6252-17g.
Motion was made to approve the COUNTY
Curry x agreements for county road repair ROAD
McMahan x x as submitted. (The agreements are REPAIR
Springer x attached to the minutes) . AGREEMENT

Dear Mr. LeGrand:
Enclosed are eight copies of the two interlocal agreements
between Tarrant County and the City of Southlake for the
reconstruction of Dove Road from Shadow Creek Road East to White
Chapel Road and the reconstruction of South Peytonville Road
from 1709 South to Continental Boulevard. Please have all the
copies signed and forward all the copies to our office . We will
present the agreement to Commissioners ' Court for action on the
Monday following our receipt of them from you.
Our office will send you a copy of the executed agreement for
your records .

Tarrant County, State of Texas , witnesseth:

WHEREAS, this Agreement is made pursuant to and in strict
compliance with the provisions and dictates of Article 4413 (32c) ?. !

WHEREAS, the party or parties paying for the performance of
governmental functions or services shall make payments therefor

from current revenues available to the paying party; and
WHEREAS , there exists a need for a necessary public project,

and the construction and improvement thereof and is in the common
interest of both parties hereto; said project being more
particularly described as:
o Reconstruct Dove Road from Shadow Creek Road
East to White Chapel Road.
WHEREAS, the parties hereto, in order to facilitate the

to share the costs of having said work to be done have agreed to

3. Tarrant County further agrees to pay one-third of the
cost for the materials to complete the construction

4. The City of Southlake agrees to pay for two-thirds of
the cost to complete the construction work.
• By entering into this Agreement the parties do not create any
obligations express or implied other than those set forth herein
and this Contract shall not create any rights in parties not
signatories hereto.
This Agreement shall terminate automatically one year from
the execution of this agreement or upon the completion of the
improvement provided for herein.

III WHEREAS, the parties hereto, in order to facilitate the
financing and construction of the needed facility, and in order
to share the costs of having said work to be done have agreed to
share in the financing of said construction as hereinafter stated
in detail.

2. Tarrant County agrees to provide the labor and
equipment necessary to accomplish the said construction.
3. Tarrant County further agrees to pay its proportionate
share (estimated at 58% of the total cost) for the
materials to complete the construction.
4 . The City of Southlake agrees to pay its proportionate
• share (estimated at 42% of the total cost) to complete
the construction.
5. The City further agrees to provide traffic control
including flagmen and placement of barriers for rerouting
of traffic from the roadway during construction.
By entering into this Agreement the parties do not create
any obligations express or implied other than those set forth
herein and this Contract shall not create any rights in parties
not signatories hereto.
This Agreement shall terminate automatically one year from
the execution of this agreement or upon the completion of the
improvement provided for herein.
