school to allow a fitness studio, MADabolic, at this location on property located at 210 S. Nolen Drive, Suite 100, Southlake, Texas on approximately 3.7 acres. The current
zoning is “S-P-1” Detailed Site Plan District. SPIN Neighborhood #8. REQUEST
DETAILS: The property is located on the west side of S. Nolen Drive approximately 250 feet south of the intersection of E. Southlake Blvd. and S. Nolen Drive on approximately 3.7 acres. The development has 4 office buildings totaling 26,974 square feet with
136 parking spaces. The proposed tenant lease space is approximately 3,500 square feet of the 7,966 square foot building.
The applicant will have scheduled classes Monday – Friday with 7 classes during the day; Saturday with 3 classes in the morning; and Sunday with 2 classes in the morning There will be 1 to 25 maximum students per class. Based on 25 students at
peak time the school would require 9 spaces. Based on the current tenant mix for the development, the site has enough available parking for the 25 students at the peak time of day. ACTION: 1) Conduct a Public Hearing 2) Consider a Specific Use Permit Request

Nolen Drive, Southlake, Texas LEGAL DESCRIPTION: Lot 9, Block B, Commerce Business Park, an addition to the City of Southlake, Tarrant County, Texas, located at 2820 Market Loop, Southlake, Texas.
LAND USE CATEGORY: Mixed Use CURRENT ZONING: “S-P-1” Detailed Site Plan District HISTORY: The property was annexed into the Town of Southlake in 1956 as “AG” (Ord. No. 041).
The property is the undeveloped remainder of the original tract from which Nolen Center to the north was developed.
May 7, 2019; City Council approved a zoning change and site plan for a single lot office development with four single story buildings totaling approximately 26,974 square feet intended for mixed general and medical office use. (ZA18-
0061) CITIZEN INPUT: A SPIN Town Hall Forum was held on September 28, 2021.
TRANSPORTATION ASSESSMENT: Parking Analysis Four single story buildings totaling approximately 26,974 square feet intended for mixed general and medical office use. There are 136 parking spaces for
medical office use and general office use. The proposed fitness school is parked according to the ratio for requires 1
space per each 3 students in attendance at peak time of day. The applicant has indicated that there will be only 1 class at a time with a maximum of 25 students per class requiring 9 parking spaces. Based on the current tenant
mix, the site has enough available parking for the students at peak time of the day. STAFF COMMENTS: Staff Review may be found in the Specific Use Permit Summary No. 2 dated October 1, 2021.
45.19 IN CONSIDERING WHETHER TO GRANT A SPECIFIC USE PERMIT FOR COMMERCIAL SCHOOL, INCLUDING TRADE SCHOOL, THE CITY
COUNCIL SHALL CONSIDER THE FOLLOWING: 1) Safe access for the ingress and egress of students, pedestrian,
parking and vehicular traffic, including the identification of student drop-off areas.

2) Adequate illumination will be provided at night to protect the safety of those persons entering and exiting the site.

45.4 GENERAL REQUIREMENTS
Any use permitted hereunder shall meet the minimum requirements provided in the district in which it is located.
A specific use permit shall automatically expire if a building permit is not issued and construction begun within six (6) months of the granting of the specific use permit or if the use shall cease for a period of six (6) months.
45.5 FACTORS TO BE CONSIDERED - In granting or denying an application for a specific use permit, the City Council shall take into consideration the following factors:
a. Safety of the motoring public and of pedestrians using the facility and the area immediately
surrounding the site. b. Safety from fire hazard, and measures for fire control. c. Protection of adjacent property from flood or water damage.
d. Noise producing elements; and glare of vehicular and stationary lights and effect of such lights on established character of the neighborhood.
e. Location, lighting and type of signs; and relation of signs to traffic control and adverse effect on adjacent properties.
f. Street size and adequacy of pavement width for traffic and reasonably expected to be generated by the proposed use around the site and in the immediate neighborhood.
g. Adequacy of parking, as determined by requirements of this chapter for off-street parking facilities for similar uses; location of ingress and egress points for parking and off-street loading spaces; and protection of the public health by all weather surfacing on all parking areas to control dust. h. Such other measures as will secure and protect the public health, safety, morals and general
welfare.

RESOLUTION NO. 21-044
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR COMMERCIAL
SCHOOL, INCLUDING COMMERCIAL SCHOOL ON PROPERTY DESCRIBED AS LOT 1, BLOCK 2 OF THE NOLEN OFFICE PARK ADDITION, CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS, LOCATED AT 210 S. NOLEN DRIVE, SOUTHLAKE, TEXAS. MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT “A”, AND AS DEPICTED ON THE APPROVED PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT “B” AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for commercial school, including commercial school has been
requested by a person or corporation having a proprietary interest in the property zoned as “S-P-1” Detailed
Site Plan District; and,
WHEREAS, in accordance with the requirements of Sections 45.1(47) and 45.18 of the City’s
Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given
the requisite notices by publication and otherwise, and have afforded the persons interested and situated in
the affected area and in the vicinity thereof; and,
WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use
Permit is in the best interest of the public health, safety, morals and general welfare of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE,
TEXAS:
SECTION 1.
A Specific Use Permit is hereby granted to allow commercial school, including commercial school on
property within the City of Southlake, Texas, more fully and completely described in Exhibit “A”, and as
depicted on the approved plan attached hereto and incorporated herein as Exhibit “B” and providing an
effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions
set forth herein. The following specific requirements and special conditions shall be applicable to the
granting of this Specific Use Permit:
