SOUTHLAKE 2035 PLAN: Consolidated Land Use Plan The "Town Center" purpose and definition in the 2035 Land Use Plan is as follows: Case No. Attachment A ZA21-0068 Page 1 Purpose: The purpose of the Town Center land use district is to encourage the creation of a pedestrian -oriented, mixed -use urban environment that serves as Southlake's downtown and center of community life. Definition: The Town Center land use designation is intended to enhance and promote the development of the community's downtown. The goal is to create an attractive, pedestrian -oriented environment that becomes the center of community life in Southlake. It may include compatibly designed retail, office, cultural, civic, recreational, hotel and residential uses. All uses shall be developed with a great attention to design detail and will be integrated into one cohesive district or into distinct sub -districts, each with its own unique characteristics. PLANNING AND ZONING COMMISSION ACTION: September 9, 2021; Approved (7-0) subject to the staff report dated September 3, 2021 and Site Plan Review Summary No. 2, dated September 3, 2021 with the recommendation that staff evaluate the encroachment agreement to consider removal of the railing or fencing in the event the tenant vacates the space or the space becomes unused at some point. A Joint Use and Encroachment Agreement will be required for encroaching into the public right-of-way and the public utility easement. The encroachment agreement will be required to go to city council for approval, however, the required approvals from the franchise utilities will not be required prior to going to city council but will be required prior to final approval. There is an existing sewer manhole located within the proposed patio that is serviced monthly. In order for Public Works Wastewater division to approve the encroachment agreement it shall be noted that all patio furniture located above, or directly adjacent to the city sewer manhole shall not be bolted down and or permanently fixed.
