PROJECT: Site Plan for Central Market Generators
EXECUTIVE
SUMMARY: On behalf of Carroll/1709, Ltd., Landev Engineers, Inc. is requesting approval of a
Site Plan for Central Market Generators on property described as Lot 3R, Block 1,
Shops of Southlake, an addition to the City of Southlake, Tarrant County, Texas
and located at 1425 E. Southlake Blvd., Southlake, Texas. Current Zoning: "S-P-2"
Generalized Site Plan District. SPIN Neighborhood #8.
DETAILS: The applicant is requesting approval of a Site Plan to add three (3) backup
generators and a 15' screen wall behind the Central Market store. The purpose of
the generators is to provide a back-up emergency power service for the Central
Market store only. The generators will not sell power back to the grid.
The Planning and Zoning Commission included the following conditions in their
motion for approval of the item on August 5, 2021.

BACKGROUND INFORMATION

PROPERTY SITUATION: 1425 E. Southlake Blvd. behind the existing Central Market store.
LEGAL DESCRIPTION: Lot 3R, Block 1, Shops of Southlake
LAND USE CATEGORY: Town Center
CURRENT ZONING: "S-P-2" — Generalized Site Plan District
HISTORY: -A rezoning and concept plan for "S-P-2" zoning was approved in May of
1996.
-A revised concept plan was proposed in 1999 and deemed to be
inconsistent with the "S-P-2" zoning by the Southlake Zoning Board of
Adjustments.
-City Council approved a Zoning and Concept Plan (ZA05-022) to "S-P-2"
Generalized Site Plan District on May 17, 2005.
-A Preliminary Plat (ZA05-023) was also approved by City Council on May
17, 2005.
-A Final Plat (ZA05-096) was approved in September 2005.
-A Site Plan (ZA05-095) was approved October 4, 2005 for the majority of
the site.
- A Site Plan (ZA05-156) for building A3 was approved February, 21, 2006.
- A Site Plan (ZA08-079) for buildings Al, A2 and E was approved October
7, 2008.
- A Zoning Change and Concept/Site Plan (ZA18-0034) for Central Market
Curbside Pick Up to allow five (5) designated pickup spaces adjacent to
the expansion with no covered parking, an expansion into the space
currently occupied by The Toy Maven, and three (3) designated spaces
across the driveway from the expansion was approved by City Council on
January 15, 2019.
SOUTHLAKE 2035 PLAN: Consolidated Future Land Use Plan
The 2035 future land use designation is Town Center.
Town Center
Purpose: The purpose of the Town Center land use district is to encourage
the creation of a pedestrian -oriented, mixed -use urban environment that
serves as Southlake's downtown and center of community life.
Definition: The Town Center land use designation is intended to enhance
and promote the development of the community's downtown. The goal is to
create an attractive, pedestrian -oriented environment that becomes the
center of community life in Southlake. It may include compatibly designed
retail, office, cultural, civic, recreational, hotel and residential uses. All uses
shall be developed with a great attention to design detail and will be
integrated into one cohesive district or into distinct sub -districts, each with

its own unique characteristics. A mix of different uses is encouraged to
create a vibrant, lively, and unique environment.
TREE PRESERVATION: No trees are proposed to be removed with this request.

PLANNING AND ZONING
COMMISSION ACTION: August 5, 2021; Approved (5-0) subject to the staff report dated July 30,
2021 and Site Plan Review Summary No. 2, dated July 29, 2021, noting
the agreement from the applicant to provide the make and manufacturer of
the generators, as well as to clarify and better define the definition of
standby versus backup and to also include as you go to Council a definition
of exactly how and when you would exercise the generators to ensure that
in the event that you have to have the generator kick on, it in fact will kick
on and accomplish what you want to accomplish.
CITY COUNCIL ACTION: August 17, 2021; tabled to the September 7, 2021 meeting at the
applicant's request (6-0).

It was good seeing you two at the P&Z meeting last night even though I didn't get a chance to say "hello"
When you get the name of the generator manufacturer Central Market plans to use, along with the make and model
number, please forward it to me. I'd also like that information for the switching unit they plan to use along with the name,
address and phone number of the "third party" that will control the generators.
I'd also be interested in the address of the stores that have these generators now that are close to residential homes. The
Central Market rep said they had no complaints from the neighbors. I'd like to go talk with those home owners.
I know you guys are very busy and I appreciate any help you can give me on this issue.
That one guy let slip that when grid power usage goes up, commercial users get charged more for electricity. This is
apparently all about money. My guess is those generators may run every afternoon in the summer during the hottest part
of the day (and during high demand days in the winter also) to save Central Market money.
A note on the City being able to monitor noise. It's a concept that sounds good in theory but does not work at all in
practice. Here's why. During the day, if you call Code Compliance, you don't get a live person, you get their voice mail. Try
it. They will return your call in a few hours or maybe a few days. By that time, the noise situation has probably changed. If
you call the Police, an Officer will show up 3045 minutes later. But he will not be familiar with the noise ordinance, it's
Prima Facie violations of which the db table is just one of 12, he will not have a noise meter with him, won't know where it
is, won't know how it works, won't be able to use it until he's trained on it and won't know when it was last calibrated or
how do do a self -test (if it has one). That has been my experience and I've called several times.
If I recall correctly, there used to be 2 P&Z meetings before going to City Council and then 2 City Council meetings prior to
final approval or disapproval at the 2nd City Council Meeting. Is that still the process?
