2021-04-15 ABA MinutesCITY OF SOUTHLAKE TEXAS AIRPORT ZONING BOARD OF ADJUSTMENT MEETING: April 15, 2021 LOCATION: 1400 Main Street, Southlake, Texas Regular Session -Council Chambers in Town Hall Members Present: Board members: Chair -Jeff Medici, Vice Chair -David Treichler, Trey Verbick- Place 3, Heather King- Place 4, Britton Wells -Alternate 1, Clinton Snead- Alternate 3, and Alex Sexton- Alternate 4 Members Absent: Board Member Quinones -Place 1 and Board Member Kemins-Alternate-2 Staff Present: Dennis Killough, Deputy Director of Planning and Development Services Richard Schell, Principal Planner, and Andrea Parrott, Board Secretary WORK SESSION: 1. Call to Order: Acting Chairman Treichler called the Work Session to order at 6:01 P.M. 2. Executive Session: No executive session was held. 3. Orientation for Airport Zoning Board of Adjustment: Planner Schell and Deputy Director Killough presented an orientation to the Board and answered questions. Chairman Medici arrived at 6:32 P.M. 4. Adjourn work session: Chairman Medici adjourned the work session AT 6:34 P.M. REGULAR SESSION: 5. Call to Order: Chairman Medici call the Regular Session to order at 6:35 P.M. 6. Executive Session: No executive session was held. 7. Administrative Comments: There were no administrative comments. 8. Consider: ABA21-0001, Variance to Ordinance No. 479, Table A, which prohibits residential land uses on properties in the 75 Ldn noise contour, for property described as Tract 11 D01, Thomas Easter Survey, Abstract No. 474, City of Southlake, Tarrant County, Texas and located at 710 Whispering Woods Circle, Southlake, Texas. Current Zoning: "SF -1A" Single Family Residential District Planner Schell presented details of the case with a slide show presentation to the Board. The applicant, Ricardo Goldschmidt, is requesting approval of a Variance to Zoning Ordinance No. 479, Table A, which prohibits single family residential development in the 75 Ldn airport noise contour. The existing home is a nonconforming structure, which is currently allowed to remain as is. Ordinance No. 479, Section 6.1 states that no new construction, alteration or enlargement of any structure or use shall take place except in conformance with this ordinance. Chairman Medici opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. Ricardo and Janet Goldschmidt, 710 Whispering Woods Circle, Southlake, TX 76092, the applicant and owners, once sworn in, presented testimony and answered questions from the Board. Chairman Medici asked if there were those in the audience who wished to speak in support of the request. There being none, Chairman Medici asked if there were those in the audience who wished to speak against the request. Darlene and Bobby Struempler, 700 Whispering Woods Circle, Southlake, Texas, once sworn in, spoke in opposition to the request. Chairman Medici called upon the applicant or the applicant's representative for a brief rebuttal. Ricardo and Janet Goldschmidt, the applicant and owners, provided a brief rebuttal. Chair Medici closed the public hearing and opened the item for discussion from the Board. A motion was made to Deny case ABA21-0001. Motion: Treichler Second: Sexton Ayes: None Nays: Medici, Treichler, Wells, Verbick, and King Abstain: None Vote: 5-0-0 Motion to deny was approved. 9.
