Re: Variance Requests Narrative – Lot 1 John Childress Heirs No. 254 Addition
Dear Mayor and City Council,
We are writing this letter on behalf of our clients Richard and Morgan Grandy who purchased the lot in
January of this year. While they acknowledged and understood the issues and restrictions with the flowage
easement prior to purchasing, they did not become aware of the below subdivision ordinance issues until
after the lot was closed and they began working on architectural plans.
The following variances are requested within the Plat Showing for the referenced lot above:
1. Variance to the Subdivision Ordinance No. 483, as amended, Section 5.02(D) to allow the existing
30’ Right of Way to remain as is without further dedication from the property owner.
2. Variance to the Subdivision Ordinance No. 483, as amended, Section 5.06 to omit the adding of a
5’ sidewalk.
The basis for the variance request in item 1 is that it will at greatly restrict but more than likely make the
lot completely unbuildable for our clients. Even though this is narrower than current the current Ordinance
allows, the road dead ends at the end of lot, serves only three lots and thus has minimal traffic. If the Right
of Way is to be dedicated the following issues would arise:
• The 40’ front setback line would move east by the distance of the Right of Way dedication.
• There would not be room to build a driveway located within the Right of Way.
• There would be inadequate room to build a home between the revised 40’ front setback and the
flowage easement.
• There would be inadequate room to construct retaining walls near the front of the property within
the Right of Way to counteract the slope of the lot.
For variance request 2, our basis is that this is the last remaining parcel of land in the general vicinity that
has yet to have a house built or been developed. There are currently no sidewalks adjacent to the lot, across
the street or within the neighboring Harbor Oaks subdivision. Since everything around has been built and
developed in the past, no future sidewalks will be built to connect to our lot. We think this would diminish
the aesthetics of the area and ultimately a sidewalk would look out of place here.
