SB Item 8Case No. SV21-0005 S T A F F R E P O R T April 1, 2021 CASE NO: SV21-0005 PROJECT: Sign Variance for Whistle Britches EXECUTIVE SUMMARY: Byrum Sign and Lighting, Inc., on behalf of Town Square Ventures LP, is requesting approval of sign variances to the Southlake Town Square Master Sign Plan for Whistle Britches located at 1230 Main Street, Southlake, Texas. DETAILS: Whistle Britches is located east of the intersection of Main Street and N. Carroll Avenue on the north side of Main Street. The applicant is requesting variances to the Southlake Town Square Master Sign Plan, Section 9, Specialty Signs, 3A, to allow a mural sign that is not located on the front façade entrance and Section 6, Materials, to allow a sign material type that is not listed in the Southlake Town Square Master Sign Plan. The applicant is proposing a mural sign on the west side of the building that is an exterior grade foil substrate applied directly to the brick wall. In the sign variance request sign package, additional signs are included for reference only. The only sign requesting a variance is the sign located on the west elevation. SPECIALTY SIGNS 1) The following sign types shall be allowed without a permit as long as set standards are met (see standards table); and where applicable, shall not be included in allowable maximum attached fascia sign area: h. Wall mural (commercial entrance) (Administrative Approval) 3) The following sign types shall be allowed by City Council / Sign Board consideration only: • Wall mural signs (visual art) Definition: Any graphic or artwork painted or applied on a wall, ceiling or other architectural surface where its background differentiates it from the general color or material of the wall or other surface. MATERIALS – Materials and finishes shall be a of a high-quality, unique and achieve harmony with others within the Downtown District. Acceptable materials for signing, wayfinding and related structures include: a. Metals: Stainless steel, brass or copper (including terne coated) in a polished, brushed or textured finish. Natural aluminum finishes are not permitted. All exposed aluminum will be of a quality applied electrostatic, colored, finish complementary to the storefront design. Use of cast iron shall be limited and is subject to review by the Landlord on a case-by- case basis. b. Composites. Glass fiber reinforced gypsum (GFRG), glass reinforced plastic (GRP) or glass fiber reinforced concrete (GFRC). c. Hardwoods. Hardwoods must have a natural or clear, quality painted or lacquered finish. d. Stone: Granite, marble limestone and slate. e. Tile: Ceramic and porcelain. f. Terrazzo, mosaics and colored stained concrete. g. Glass: Textured, art, colored, frosted and patterned. h. Acrylic: translucent, clear, colored and opaque. i. High Performance Adhesive Film. j. Gold Leaf or Professionally Painted Graphics. k. OWNER: Town Square Ventures LP PROPERTY SITUATION: 1230 Main Street HISTORY: November 1998 – Phase I Sign Regulations adopted March 1999 – Phase II Sign Regulations adopted November 2005 – Grand Avenue Sign Regulations adopted June 2020 - Master Sign Plan for Town Square adopted STAFF COMMENTS: City Council approval of the proposed sign does not eliminate the requirement for appropriate sign application submittal prior to the installation of the sign. Variance Authorized. The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. b. Approval Standards. In granting any variance, City Council shall consider the following criteria: (i) Special conditions exist which are peculiar to the land, structure or building involved and are not applicable to other lands, buildings or structures in the same zone. The City may attach such conditions to granting all or a portion of any variance necessary to achieve the purpose of this ordinance, and; (ii) The strict interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zone under the terms of the ordinance, and; (iii) The special conditions and circumstances do not result from the actions of the applicant and such conditions and circumstances do not merely constitute pecuniary hardship or inconveniences, and; (iv) Granting the variance will meet the objectives of the ordinance and not be injurious to the adjoining property owners or otherwise detrimental to the public welfare, and; (v) The request will be the minimum variance necessary to alleviate the special hardship or practical difficulties faced by the applicant in meeting the requirements of this ordinance; and; (vi) Granting of the variance will be in harmony with the spirit and Case No. Attachment A SV21-0005 Page 2 purpose of this sign ordinance. (vii) Granting of a variance shall be specific to the subject sign(s). Any modification of the signage approved by the variance or the installation of new or replacement signage that does not meet the specific requirements of the City Council variance approval is prohibited and will be deemed non-compliant. Application Process. Any request for a variance shall be made to the Administrative Official and be accompanied by a completed application and a non-refundable filing fee in the amount specified in the current fee schedule adopted by City Council. The sign variance will be considered by the City Council following a recommendation by the Sign Board. The Sign Board’s recommendation will be forwarded to the City Council for their consideration.
