MEMBERS ABSENT: None. STAFF PRESENT: Sr. Director of Planning and Development Services Ken Baker; Deputy Director of Planning & Development Services Dennis Killough; and Commission Secretary Lydia Ruiz. WORK SESSION: 1. CALL TO ORDER: 2. Executive Session: Pursuant to the Open Meetings Act, Chapter 551, Texas Government Code, Sections 551.071. Refer to posted list attached hereto and incorporate herein. Executive Session may be held, under these exceptions, at the end of the Regular Session or at any time during the meeting that a need arises for the Planning and Zoning Commission to seek advice from the City Attorney as to the posted subject matter of this Planning and Zoning Commission meeting. Section 551.071: Consultation with attorney. No executive Session was held. 3. Recap of City Council’s action and discussion on Planning and Zoning recommended cases. 4. Sr. Director of Planning and Development Services, Ken Baker provided a recap of the City’s challenges during the winter storm. As well as, announced for the next 60 days, the Planning Department will be waiving permit fees if the repairs are storm related. The code allows in emergency situations to waive permit fees and encouraged residents and businesses to pull permits, so an inspection is conducted to ensure all work is completed safely and to code. Lastly, information is posted on the City’s website regarding registration of contractors and plumbers in the City , tips on hiring a contractor and best practices to turn on and off your water. Governor Abbott waived some regulations for out of state plumbers that can operate in the state of Texas but must carry a temporary license issued by the state. Sr. Director Ken Baker reminded the Commission there are no meetings in the month of March and meetings will resume on April 8, 2021. 4. CHAIRMAN KUBIAK COMMENTS Chairman Kubiak announced relocation of the Zoning Board Adjustment meeting, held on the Third Floor. In addition, thanked City staff for their involvement and work during the winter storm. REGULAR AGENDA: 5. CONSIDER: APPROVAL OF THE MINUTES FOR THE PLANNING AND ZONING COMMISSION MEETING HELD ON FEBRUARY 4, 2021. A motion was made to approve item 5, Planning and Zoning minutes from the February 4, 2021 meeting. RESOLUTION NO. 21-005, (ZA21-0004), SPECIFIC USE PERMIT WITH SITE PLAN FOR THE DRAGON HOUSE ON PROPERTY DESCRIBED AS LOT 1R3, BLOCK 1 OF THE GATEWAY PLAZA PHASE II ADDITION, CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS AND LOCATED AT 2640 E. SOUTHLAKE BLVD., SOUTHLAKE, TEXAS. CURRENT ZONING: “S-P-2” GENERALIZED SITE PLAN DISTRICT. SPIN NEIGHBORHOOD #8. CHIVERS NO. 350 ADDITION AND A CONCEPT PLAN TO ALSO INCLUDE ALL OF LOTS 1 AND 2, JOEL W. CHIVERS NO. 350 ADDITION, BOTH ADDITIONS BEING ADDITIONS TO THE CITY OF SOUTHALKE, TARRANT COUNTY, TEXAS, AND LOCATED AT 2465, 2525 AND 2535 N. WHITE CHAPEL BLVD., SOUTHLAKE, TEXAS. Jason Bengert, representative of Brookfield Properties, 2121 N. Pearl Street, Dallas, Texas. Both individuals came forward to speak and answer questions. Chairman Kubiak opened the public hearing and read comments cards from those wishing to speak: • Paul Hasselfeldt, 1220 Woodsey Court, spoke in opposition. • Kamil Worobirzc, 1255 Woodsey Court, spoke in opposition. • Mike McCann representative of Magellan, One Williams, Tulsa, Oklahoma, spoke in opposition and presented materials. • Ralph Wimp representative of NuStar Energy, 700 Mustang Court, spoke in opposition. • Stephen Arnowd, Supervisor for Magellan Operations, One Williams, Tulsa, Oklahoma, spoke in opposition. Chairman Kubiak closed the public hearing. Chairman Kubiak called the Applicants back for discussion. Applicant – Patrick Hogan requested their item be moved to table to the next meeting on April 8, 2021, so they may address some of the items and comments discussed. A motion was made to approve the Applicant’s request to table item 8 to the April 8th Planning and Zoning Commission meeting.
