Throop No. 1511 Addition, on property described as Tracts 4A5, 3A and 5D1A, Francis Throop Survey, Abstract No. 1511, City of Southlake, Tarrant County, Texas, and located at 1507 and 1515 E. Dove Rd., Southlake, Texas. Current Zoning: “SF-1A” Single Family Residential District. SPIN Neighborhood #4. DETAILS: On January 5, 2021, City Council approved a Zoning Change and Concept Plan (ZA20-0056) from “AG” Agricultural District to “SF-1A” Single Family Residential District for the property located at 1507 E. Dove Rd. so that it can be combined into one lot with portions of two tracts located at 1515 E. Dove Rd. that are zoned “SF-1A” Single Family Residential District. The purpose of the Plat Showing is to create two lots in conformance with the approved Concept Plan. The new lot line will follow the existing creek between 1507 and 1515 E. Dove Rd. PROPERTY SITUATION: 1507 and 1515 E. Dove Rd. LEGAL DESCRIPTION: Tracts 4A5, 3A and 5D1A, Francis Throop Survey, Abstract No. 1511, LAND USE CATEGORY: Low Density Residential CURRENT ZONING: “SF-1A” Single Family Residential District HISTORY: - The property was annexed into the City in 1957. - “AG” Agricultural District zoning was placed on the property with the adoption of Ordinance No. 161 and the Official Zoning Map in 1969. - The existing home on the property was built in 1984 (Source: TAD). - A Zoning Change and Concept Plan (ZA20-0056) from “AG” Agricultural District to “SF-1A” Single Family Residential District for the property located at 1507 E. Dove Rd. was approved by City Council on January 5, 2021. TREE PRESERVATION: There is approximately 66% existing tree cover on the site and 40% is required to be preserved. No development is proposed on the property and 100% of the existing tree cover is proposed to be preserved. Any future construction will be required to comply with the regulations of the Tree Preservation Ordinance 585-E. UTILITIES: An 8’ water line exists in E. Dove Rd. to serve the property. The utility plan shows a sanitary sewer manhole on the north side of E. Dove Rd. The sewer line is 18”. DRAINAGE: Drainage is generally west to east across the property to the existing creek. The north portion of the property drains to E. Dove Rd. CITIZEN INPUT/ BOARD REVIEW: A SPIN meeting was not held for this project. The plat must conform to the underlying zoning district and it must be processed, approved and recorded with the County prior to conveyance of the property that was subdivided by metes and bounds. Please make the following revisions per Subdivision Ord. No. 483, as amended, Sections 3.04, 3.01 and 3.03. 2. Place the City case number ZA21-0019" in the lower right-hand corner of the plat. 3. Revise the vicinity/location map to include the total of both lots being platted. 4. Revise the title block as follows: a. Provide a courthouse filing note as follows and place it in the vicinity of the title block: “Filed as Instrument # , Date .” b. Change the name of the addition to F. Throop No. 1511 Addition. 5. Provide the standard approval block for a multiple lot plat showing on the plat per appendix 9. Case No. Attachment C ZA21-0019 Page 1 6. The following change is needed with regard to the legal description: a. The POB must be tied to a survey corner, previously filed subdivision corner, or USGS monument. 7. The following changes are needed in the “owner’s” dedication and notary: a. Revise the owner’s dedication and notary to conform to the standard format as shown in Appendix 1 (Individuals). Add “...are the sole owners…” and “...being all of the owners…” in the preamble and dedication as shown in the attached Appendix1. b. Remove the following sentence at the end of the dedication: “This plat approved subject to all platting ordinances, rules, regulations and resolutions of the Town of Flower Mound.” 8. Add a lienholder statement and signature block with notary to the plat. If there is/are no lienholder(s) then add the statement “There are no liens against this property” at the end of the owner’s dedication before the signature blocks. The standard language for these statements is attached. 9. Revise the surveyor’s certification to conform with the standard format as shown in Appendix 5. 10. Please see the plat for Lot 12, F. Throop No. 1511 Addition, which shows the correct centerline and dimensions. Add the 47’ dimension from centerline to Lot 12, F. Throop No. 1511 Addition and full width across right of way (44’ + 47’ = 91’). Show, label and dimension the right of way dedication in accordance with the current Ma ster Thoroughfare Plan. The Master Thoroughfare Plan shows E. Dove Rd. as an arterial with 88’ of right of way. Please show the centerline of E. Dove Rd. and show and label the required 44’ dedication from centerline and show the dimensions from the center line to both property corners and also dimension the full width dimension across the right of way. Per Section 5.02D of Subdivision Ord. No. 483, as amended, for a development directly adjacent to a major state or county thoroughfare, the development shall only be required to dedicate such right of way as reasonably relates to the need created by and the benefit received by that development. The applicant has chosen the option of dedicating 25’ of right of way from the centerline and placing the additional 19’ to equal the 44’ dedication in a Pedestrian Access, Drainage and Utility Easement (See Concept Plan for City Case No. ZA20-0056). The 40’ front building line is to be shown and dimensioned from the 44’ measured from the centerline. 11. The Master Pathways Plan shows a Future Sidewalk (<8’) along E. Dove Rd. A 5’ sidewalk is required to be constructed at the time of construction of a new home on the property. Please Case No. Attachment C ZA21-0019 Page 2 locate the sidewalk so that it is right up against the bufferyard, as far away from the pavement as possible to allow for future street widening. 12. Show and label adjacent street intersection with street name. Label Lonesome Dove Ave. 13. Show and label the floodway limits with dimensional ties to all lot corners. 14. Add the following notes to the face of the plat: a. The City of Southlake reserves the right to require minimum finish floor elevations on any lot contained within this addition. The minimum elevations shown are based on the most current information available at the time the plat is filed and may be subject to change. b. The City of Southlake shall NOT be liable for any claims, damages, or losses which may occur on account of flooding or inundation of any such lots so reclaimed, and the owner and subsequent owners of any such lots agree to release the City from any and all such claims, damages, and losses. c. Compliance with the provisions of the City’s Storm Drainage Policy does not relieve a person of the responsibility of complying with all other applicable laws, including, but not limited to, Section 11.086, Texas Water Code. 15. The following changes are needed with regard to easements: a. Provide dimensional ties along lot lines to all easements. Provide centerline dimensions and bearings on any easements crossing areas if deflections occur. b. Although the Subdivision Ordinance requires utility easements along internal lot lines as stated below, staff recommends providing easements only if necessary to accommodate franchise utilities that are not provided in the right of way. Where adjacent property is unplatted or platted showing a 5' U.E., provide a 5' U.E. along the property line; if adjacent property is platted and shows no easement, provide a 10' U.E. along the interior of the property line. Alteration or removal of any of the existing trees shown to be preserved on the approved Tree Conservation Plan is a violation of the Tree Preservation Ordinance and the zoning as approved by the Southlake City Council. Please ensure that the layout of all structures, easements, utilities, structures grading, and any other structure proposed to be constructed do not conflict with existing trees intended to be preserved.
