EXECUTIVE
SUMMARY: Steven Hickey is requesting approval of a Specific Use Permit for a Commercial
school, including trade school to allow a martial arts academy, Top Tier Athletics, at
this location on property located at 2820 Market Loop, Suite 100, Southlake, Texas.
The current zoning is “I-1” Light Industrial District. SPIN Neighborhood #8.
REQUEST
DETAILS: The property is located on the west side of Market Loop approximately 340 feet north
of the intersection of Market Loop and Exchange Street.
The tenant lease space is approximately 2,400 square feet of useabl e space/2,600
square feet of rentable space. The 28 parking spaces at this site are shared by two
approximately 5,900 square foot buildings with multiple tenants.
The applicant typically trains 8 students per class and up to 15 students per class on
Saturdays. Based on 15 students at peak time the school would require 5 spaces .
Based on the current te nant mix, the site has enough available parking for the 15
students at the peak time of day.

CURRENT ZONING: “I-1” Light Industrial District
HISTORY: Commerce Business Park was annexed into the City of Southlake in 1986,
with the Light Industrial Zoning (Ordinance No. 333).
September 2, 1986; a Final Plat for Commerce Business Park was approved
by City Council on.
September 5, 1989; the property was given the “I -1” Light Industrial Zoning
with the adoption of the Zoning Ordinance No. 480 .
According to TAD, the building located at 2820 Market Loop was constructed
in 1996.
April 19, 2016; City Coun cil approved a Specific Use Permit for a Commercial
school, including trade school for a proposed martial arts academy for a
period of two years. (ZA16-019)
April 17, 2018; City Council approved a Specific Use Permit for a Commercial
school, including trade school for a proposed martial arts academy tied to the
tenant’s lease of 2 years and any add itional extensions of the lease; and
noting the tenant’s new lease will begin on Ma y 1, 2018. (ZA18-0035)
CITIZEN INPUT: A SPIN Town Hall Forum was not requested for this proposal
TRANSPORTATION
ASSESSMENT: Parking Analysis
Two approximately 5,900 square foot buildings share the parking sp aces at
this site. There are 38 spaces, including 2 handicap spaces and 3 no parking
spaces for the entire site.
The proposed martial arts academy is parked according to the ratio for
Business, Trade or Craft School, which requires 1 s pace per each 3 students
in attendance at peak time of day. The applican t has indicated that there will
be only 1 class at a time during the week with a maximum of 8 students per
class requiring 3 parking spaces and a maximum of 15 students on Saturday,
requiring 5 spaces. Based on the current tenant mix, the site has enough
available parking for the 15 students at peak time of Saturday.

45.19 IN CONSIDERING WHETHER TO GRANT A SPECIFIC USE PERMIT
FOR COMMERCIAL SCHOOL, INCLUDING TRADE SCHOOL, THE CITY
COUNCIL SHALL CONSIDER THE FOLLOWING:
1) Safe access for the ingress and egress of students, pedestrian,
parking and vehicular traffic, including the identification of student
drop-off areas.
2) Adequate illumination will be provided at night to protect the safety of
those persons entering and exiting the site.

and construction begun within six (6) months of the granting of the specific use permit or
if the use shall cease for a period of six (6) months
45.1 GENERAL PROVISIONS - The uses listed in this section are prohibited in the City of Southlake
unless and until a specific use permit is granted for such use by the City Council in accordance with the
requirements and procedures set forth in this Section. A specific use perm it shall be required for the
following uses (as amended by Ordinance No. 480 -D):
48. Commercial school, including trade school, subject to the requirements set forth in
Section 45.18 protect the residential neighborhoods, in so far as practicable, from the
detrimental effects of noise, traffic, fire, etc. and to protect the character of the
neighborhood and the value of surrounding properties;

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE,
TEXAS, GRANTING A SPECIFIC USE PERMIT FOR COMMERCIAL
SCHOOL, INCLUDING TRADE SCHOOL ON PROPERTY DESCRIBED AS
LOT 9, BLOCK B, COMMERCE BUSINESS PARK, AN ADDITION TO THE
CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS, LOCATED AT 2820
MARKET LOOP, SOUTHLAKE, TEXAS. MORE FULLY AND COMPLETELY
DESCRIBED IN EXHIBIT “A”, AND AS DEPICTED ON THE APPROVE D
PLAN ATTACHED HERETO AND INCORPORATED HE REIN AS EXHIBIT
“B” AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, a Specific Use Permit for commercial school, including trade school has been requested
by a person or corporation having a proprietary interest in the property zoned as “I-1” Light Industrial District;
and,
WHEREAS, in accordance with the requirements of Sections 45.1(48) and 45.19 of the City’s
Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given
the requisite notices by publication and otherwise, and have afforded the persons interested and situat ed in
the affected area and in the vicinity thereof; a nd,
WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use
Permit is in the best interest of the public health, safety, morals and general welfare of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE,
TEXAS:
SECTION 1.
A Specific Use Permit is hereby granted to allow commercial school , including trade school on property
within the City of Southlake, Texas, more fully and compl etely described in Exhibit “A”, and as depicted on
the approved plan attached hereto and incorporated herein as Exhibit “B” and providing an effective date,
subject to the provisions contained in the comp rehensive zoning ordinance and the restrictions set forth
herein. The following specific requirements and special conditions shall be applicable to the granting of this
Specific Use Permit:
