� / f RESOLUTION NO. 09-063 OFFICIAL RECORD A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR A MASS GATHERING EVENT FOR HOME FOR THE HOLIDAYS AND FESTIVAL OF TREES ON PROPERTY WITHIN THE CITY OF SOUTHLAKE, TEXAS, LOCATED AT SOUTHLAKE TOWN SQUARE, 1420 DIVISION STREET, BEING LEGALLY DESCRIBED AS SOUTHLAKE TOWN SQUARE, PHASE ONE, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED SITE PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for a mass gathering event for Home for the Holidays and Festival of Trees has been requested by a person or corporation having a proprietary interest in the property zoned as "DT" Downtown District; and, WHEREAS, in accordance with the requirements of Sections 45.1 (36) & 45.14 of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted for a mass gathering event for Home for the Holidays and Festival of Trees on the property located at Southlake Town Square, being legally described as Southlake Town Square, Phase One, an addition to the City of Southlake, Tarrant County, Texas, according to the plat recorded in Cabinet 'A', Slide 4892, Plat Records, Tarrant County, Texas, more fully and completely described in Exhibit "A", and as depicted on the approved Site Plan attached hereto and incorporated herein as Exhibit "B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and special conditions shall be applicable to the granting of this Specific Use Permit: • . f Approved for a term of one year; subject to the Staff Report dated September 11, 2009; subject to Director Bob Price's letter dated October 6, 2009 and subject to the presentation made October 6, 2009, to City Council. SECTION 2. This resolution shall become effective on the date of approval by the City Council. The podium is conveniently located on Plaza Place and very accessible to many patrons; including the high traffic area near the Hilton Hotel. Please direct your attention to the podium located in front of Building 104 Mi Cocina. The podium is conveniently located near shops 98-113. Traffic will flow south on State Street proceed to podium drop off. Valet will take vehicles west on Main and north toward Prospect Street in the middle of the lot. (See Valet Designated Parking area. See red dots for strategically placed podiums and blue arrows for vehicle parking).
