A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR A
CARPORT ON NON-RESIDENTIAL PROPERTY ON PROPERTY
WITHIN THE CITY OF SOUTHLAKE, TEXAS, LOCATED AT 1210 N.
CARROLL AVENUE, BEING LEGALLY DESCRIBED AS LOT 2, BLOCK
1, CHIVERS PARK ADDITION, MORE FULLY AND COMPLETELY
DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED
SITE EXHIBIT ATTACHED HERETO AND INCORPORATED HEREIN AS
EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, a Specific Use Permit for a carport on non-residential property has been requested
by a person or corporation having a proprietary interest in the property zoned as "01" Office District; and,
WHEREAS, in accordance with the requirements of Section 45.1 (33) and 45.11 of the City's
Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have
given the requisite notices by publication and otherwise, and have afforded the persons interested and
situated in the affected area and in the vicinity thereof; and,
WHEREAS, the City Council does hereby find and determine that the granting of such Specific
Use Permit is in the best interest of the public health, safety, morals and general welfare of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION 1.
A Specific Use Permit is hereby granted for a carport on non-residential property on property
located at 1210 N. Carroll Avenue, being legally described as Lot 2, Block 1, Chivers Park Addition, more
fully and completely described in Exhibit "A", and as depicted on the approved Site Exhibit attached
hereto and incorporated herein as Exhibit "B" and providing an effective date, subject to the provisions
contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following
specific requirements and special conditions shall be applicable to the granting of this Specific Use
Permit:
1. Subject to Specific Use Permit Review Summary No. 2, dated February 04, 2009.
2. Subject to Zoning Change & Site Plan Review Summary No. 4 dated February 13, 2009.
SECTION 2.
This resolution shall become effective on the date of approval by the City Council.

Being property located at 1210 N. Carroll Avenue, being legally described as Lot 2, Block 1, Chivers Park
Addition, and more fully and completely described as follows:
BEGINNING at a 1/2 inch iron rod with plastic cap stamped Landes & Assoc.
hereinafter all L&A 1/2 inch iron rods are so marked), found in the west R.O.W.
line of North Carroll Avenue and being the northeast corner of said Lot 2 and
also being the southeast corner of Lot 1, Block 1 of said Chivers Park;
THENCE S 00'31'40" E. along said R_O_W line and along the east line of said Lot
2, 252.46 feet to a 3/4 inch iron rod found at the southeast corner of said Lot
2 in the north line of a tract of land conveyed to Jeerer Dwayne Brown et ux
Charlotte Elisabeth Brown, as recorded in Volume 3776. Page 287, Deed Records
of Tarrant County, Texas,
THENCE N 89'12'28" W. along the south line of said Lot 2 and along the north
line of. said -Brown tract, at 151.80 feet passing the southwest corner of said Lot
2 and a south line of said Lot 3 and continuing in all 164.41 feet to a 1/2 inch
iron rod found at the northwest corner of said Broom tract;
THENCE S 01'01'53" E. along a southerly line of said Lot 3 and along the west
line of said Brown tract, 2.00 feet to a chainlink fence post at the northeast
corner of a tract of land conveyed to The Montessori Academy at Southlake, a
Texas -non profit Corporation d/b/a Highland Meador Montessori Academy, as
recorded in Volume 11546, Page 196, Deed Records of Tarrant County, Texas;
THENCE S 89'08'34" W. continuing along a south line of said Lot 3 and along the
north line of said Montessori tract, 165.22 feet;
THENCE S 01.25'38" W along a west line of said Lot 3 and along the west line of
said Montessori tract, 219.85 feet to a L&A 1/2 inch iron rod set in asphalt at
the - most southerly southeast corner of said Lot 3, also being in the north R.O.W.
line of E. Highland Street;
THENCE . N 89'01'17" W. along the most southerly south line of said Lot 3 and
along said R.O.W. line, 259.79 feet to a DC&A capped 5/8 inch iron rod found at
the southwest corner of said Lot 3, also being in the east line of a remainder
tract of the land conveyed to Highland Group JV, as recorded in Volume 8207,
Page 1513, Deed Records of Tarrant County, Texas;
THENCE N 00"58'43" E. leaving said R_O.W_ line along the west line of said Lot 3
and along the east line of said remainder tract conveyed to Highland Group JV,
440.47 feet to a L&A 1/2 inch iron rod found at the beginning of a tangent
curve to the right whose radius is 25.00 feet and whose long chord bears N
45'13'58" E. 34.89 feet;
THENCE along said curve and said Lot 3 in a northeasterly direction through a
central angle of BWSO'31", an are distance of 36.62 feet to a L&A 1/2 inch iron
rod found in the north line of said Lot 3, also being a south line of said
remainder tract of land conveyed to Highland Group JV;
THENCE N 99'29'14" E, along the north line of said Lot 3, at 42.76 feet passing
the ' 'southwest corner of aforementioned Lot 1 of said Chivers Park and also
passing the common north corner of said Lets 2 and 3 and continuing in all
560.19 feet to the POINT OF BEGINNING and containing 4.683 acres of land.
