2008-042 ResolutionV y RESOLUTION NO. 08-042 OMCIAL RFr.npn A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF - — SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR TELECOMMUNICATIONS TOWERS, ANTENNAS, AND ANCILLARY BUILDINGS ON PROPERTY WITHIN THE CITY OF SOUTHLAKE, TEXAS, BEING LEGALLY DESCRIBED AS A PORTION OF LOT 1, BLOCK 1, YATES CORNER ADDITION AND A PORTION OF TRACT 1E1, FRANCIS THROOP SURVEY, ABSTRACT NO. 1511 AND MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED SITE PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for telecommunications towers, antennas, and ancillary buildings has been requested by a person or corporation having a proprietary interest in the property zoned as "C-1" Neighborhood Commercial District and "S -P-2" Generalized Site Plan District; and, WHEREAS, in accordance with the requirements of Section 45.1(30) and Section 45.7 of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE,TEXAS: SECTION 1. A Specific Use Permit is hereby granted for telecommunications towers, antennas, and ancillary buildings on the property being legally described as a portion of Lot 1, Block 1, Yates Corner Addition, an addition to the City of Southlake, Tarrant County, Texas, according to the plat recorded in Cabinet A, Slide 2231, Plat Records, Tarrant County, Texas and a portion of Tract lEl, Francis Throop Survey, Abstract No. 1511, more fully and completely described in Exhibit "A", and as depicted on the approved Page 1 Site Plan attached hereto and incorporated herein as Exhibit `B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and special conditions shall be applicable to the granting of this Specific Use Permit: 1. Subject to the recommendations of the Planning and Zoning Commission, August 21, 2008 to include the stipulation that if any trees are lost due to improvements or disturbance, they must be mitigated 1 to 1 per caliper inch and the evergreen plant screening must be provided. 2. The base of the pad for the equipment cabinets will be at -grade with the existing surface or a pre -fabricated foundation will be brought to the site. 3. The landscape administrator will be on-site during installation. 4. Subject to Review Summary No. 5, dated August 13, 2008. SECTION 2. Page 4 AH i July 31, 2008 Mr. Richard Schell City of Southlake Planning Dcpartment Southlake, Texas RE: LA08-036 Verizon Wireless Dear Mr. Schell: Verizon Wireless and the property owner, Mr. Rick McPherson, have agreed on a new lease site on his property. It will be approximately 70 feet north of the TXU tower, against the existing chain link fence that encloses the mini -storage units. This means the south side of our screening wall will be approximately 130 feet from Dove Road, which it still has aceess from. The west side of the wrought iron fence surrounding our equipment will line up with the west side of the westernmost storage unit. This is to make it appear, from the street, that nothing has been changed or added. Verizon Wireless still plans to use an existing parking space in front of the convenience store to avoid pouring more concrete than necessmy. The new lease site is not in the TXU easement and right -of -Amy and will be unseen by the neighbors to the west. No trees will be removed at our new lease site, Verizon Wireless is asking for a waiver for the F2 bufferyard and the required eight foot hedge when installing a wrought iron fence. This request is in an effort to preserve the tree roots of the two existing trees on either side of our lease site. We are also asking for a waiver for our screening wall. Verizon Wireless is proposing a wrought iron fence on the east and west sides of the compound and simply connecting to the existing chain link fence surrounding the mini -storage units to the north. Solid metal gates will still be used on the street facing south: side. We ask that the adjacent trees fulfill the requirement as the landscaped screening. The compound is now placed so far back from the road that it will only be seen from the _south side on Dove Road. through the access easement. I am enclosing the survey and two photos that should snake our new site location clear.
