2008-007RESOLUTION NO. 08-007 OFFICIAL RECORD A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR AUTOMOBILE SALES AND TENT FOR THE PURPOSE OF PROMOTING RETAIL SALES ON PROPERTY WITHIN THE CITY OF SOUTHLAKE, TEXAS, LOCATED AT 1900, 1950, and 2055 GREENWOOD DRIVE, BEING LEGALLY DESCRIBED AS LOT 2, BLOCK B, AND LOTS 6 AND 7, BLOCK A, NORTH DAVIS BUSINESS PARK, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED SITE EXHIBIT ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for automobile sales and tent for the purpose of promoting retail sales has been requested by a person or corporation having a proprietary interest in the property zoned as 1-1" Light Industrial District; and, WHEREAS, in accordance with the requirements of Sections 45.1(41) and 45.1(22) of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted for automobile sales and a tent for the purpose of promoting retail sales on the property located at 1900, 1950, and 2055 Greenwood Drive, being legally described as Lot 2, Block B, and Lots 6 and 7, Block A, North Davis Business park, an addition to the City of Southlake, Tarrant County, Texas, according to the plat recorded in Volume 388-197, Page 40, Deed Records, Tarrant County, Texas, more fully and completely described in Exhibit "A", and as depicted on the approved Site Exhibit attached hereto and incorporated herein as Exhibit "B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and special conditions shall be applicable to the granting of this Specific Use Permit: 1. Approved for tent sale and automobile sales for the purpose of holding an auction for the sale of collectibles and automobiles for a time period not to exceed three days and subject to the recommendations of the Planning and Zoning Commission, which stipulated approval subject to review by the city Department of Public Safety and that an officer be present at the event. Mr. Davis has sold his building and RM has been contracted to sell the contents of the building by way of a public auction. I have outlined our event in the paragraphs below and have attached a diagram of the area where the auction will be held. On Friday, April 18, 2008 there will be a preview from l Dam — 5pm for those customers who have purchased a catalog for this event. We anticipate the attendance of approximately 50-75 customers throughout the day. Friday evening there will be a formal private reception from 7pm 9pm where registered bidders can come and preview the lots for sale. RM is contracting a licensed catering company to serve beer & wine and pass hor'derves to the bidders. On Saturday, April 19, 2008 the actual auction will take place inside the building from 9arn — 6prr Mr Davis has requested that the auction not be open to the public but only to interested paid bidders so we have set the admission at $80, which includes a catalog of the event. Most customers will have been sent their catalog in the mail prior to the event but there will be a limited number for sale onsite for $80. It is difficult to predict the exact number of people that will be in attendance however, based on similar auctions previously held, we anticipate 200-400 coming and going throughout the sale day. No automobiles will be driven inside during the event to eliminate any carbon monoxide and the possibility of an accident. We also maintain a 3' minimum aisle way in the auction room and have all exits posted. In order to achieve this it requires us to move some of the lots from inside the building into two tent structures on the existing parking lot. The approximate size for these two tents are 50 ft. X 150 ft., and 40 ft, X 80 ft.. This will leave plenty of space inside the building to allow customers to walk freely and not block any exits. Parking for this event will mainly take place on the vacant lot adjacent Mr. Davis' building. This lot is owned by Mr. Davis and has room for approximately 250 vehicles and this vacant lot will more than make up for the parking spaces displaced by the two tent structures. RM.will be making a donation to one of the local car clubs in exchange for volunteers to assist in parking customers vehicles. I would also like to make mention of the revenue that will be generated for the local business community in the way of hotel room accommodations, gas, meals, car rentals, etc. as a result of the auction being held in Southlake. I also understand that there is a no sign ordinance that is in effect in Southlake and am requesting that we be able to place a sign approximately 6' X 10' in front of 2055 Greenwood Dr. (on the customers property) for the three days to let customers know where the sale is located. You were very clear in explaining the city's concerns of my parking arrangements for people attending the auction and as a result, we have made arrangements for the use of parking lots of neighboring businesses. With the auction taking place on a Saturday, the use of these existing parking spaces Is not an issue with the neighboring property owners. The parking lots of these immediate neighboring properties combine for a total of 160 parking spaces, which would be adequate for the projected attendance. Should you require letters from area businesses confirming the use of their parking lots, we would be happy to obtain them. We would hire parking attendants to direct traffic into designated parking areas and we would also plan for a secondary off -premises parking lot, with shuttle, should we reach the primary lot's capacity. Also, I would like to point out that this auction will absolutely NOT be accepting outside consignments. Mr. Wayne Davis, who owns all the items that we will be selling, specifically made it clear to us that he would not welcome the "competition" of other items being sold at his auction, and as a result, we will be selling his items only. In closing, we look forward to working with you to conduct this event on April 19'h as it would benefit not only our client's requirements, but it would also generate revenue for the local business community, not to mention the taxes collected on the sale of this collection. A written agreement from the adjoining property owner will be obtained confirming no objection of the use of this land for parking for the event. Should the vacant lot become full during the event, our parking attendants will direct traffic into the parking lots of neighboring businesses. The auction takes place on a Saturday and as a result, these businesses will be closed. We will obtain written permission from these businesses for the use of their parking lots. In closing, RM Auctions is very conscientious about traffic safety, the environment, local businesses and for the community as a whale.
