2007-059RESOLUTION NO. 07-059 OFFICIAL RECORD A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR TELECOMMUNICATIONS TOWERS, ANTENNAS, AND ANCILLARY BUILDINGS ON PROPERTY WITHIN THE CITY OF SOUTHLAKE, TEXAS, BEING LEGALLY DESCRIBED AS LOT 1, BLOCK A, OIEN ADDITION, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED CONCEPT PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for telecommunications towers, antennas, and ancillary buildings has been requested by a person or corporation having a proprietary interest in the property zoned as "CS" Community Service District; and, WHEREAS, in accordance with the requirements of Section 45.1 (31) and Section 45.8 of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted for telecommunications towers, antennas, and ancillary buildings on the property being legally described as Lot 1, Block A, Oien Addition, an addition to the City of Southlake, Tarrant County, Texas, according to the plat recorded in Volume 388-218, Page 14, Plat Records, Tarrant County, Texas, more fully and completely described in Exhibit "A", and as depicted on the approved Concept Plan attached hereto and incorporated herein as Exhibit "B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and special conditions shall be applicable to the granting of this Specific Use Permit: 1. Approved subject to the representations made by the applicant at City Council and his agreement to double the number of evergreen trees by adding four more trees on each side of the driveway and subject to Concept Plan Review Summary No. 2, dated August 31, 2007, specifically granting the requested variance: a. Number of Buildings — No more than 3 separate equipment buildings/cabinets is permitted on a single lot. The applicant is proposing to add an additional equipment building making the total to be 5 equipment buildings and 3 cabinets at the facility. SECTION 2. This submittal is slightly different due to the nature of the AirCell network. AirCell is developing a limited number of sites to allow communications between an airplane and the traditionally based landline telephone network. This network will allow, subject to government approval, a passenger in an airplane to access the internet and perhaps their cell phone, while in transit. As such there are no "propagation maps". This tower has the capacity to servean area much larger than Southlake. This location has been selected due to its proximity to DFW airport. As required by Southlake Ordinance, we are requesting variances for this installation as follows: a. A variance is requested to locate antennas as indicated on the tower at the referenced location. AirCell's antennas point upwards so as to reach aircraft rather than ground communication. b. A variance is requested to allow more than the 3 allowed accessory structures at this location. Due to the relatively sensitive nature of the equipment AirCell uses a traditional equipment building. Location of this building within the existing compound will exceed the maximum permitted, thus a variance is requested. It is our understanding that with all of the recently installed improvements at 3700 White Chapel variances from required landscaping are not being asked for. We are requesting to be placed on the earliest possible agenda.
