2007-051RESOLUTION NO. 07-051 OFFICIAL RECORD A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR A TENT FOR THE PURPOSE OF PROMOTING RETAIL SALES ON PROPERTY WITHIN THE CITY OF SOUTHLAKE, TEXAS, LOCATED AT THE SOUTHLAKE CORNERS DEVELOPMENT, BEING LEGALLY DESCRIBED AS LOT 2A, BLOCK 1, FARRAR ADDITION, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED SITE EXHIBIT ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for a tent for the purpose of promoting retail sales has been requested by a person or corporation having a proprietary interest in the property zoned as "C-3" General Commercial District; and, WHEREAS, in accordance with the requirements of Section 45.1 (42) of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof, and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted for a tent for the purpose of promoting retail sales on the property located at the Southlake Corners development, being legally described as Lot 2A, Block 1, Farrar Addition, an addition to the City of Southlake, Tarrant County, Texas, according to the plat recorded in Cabinet `A', Slide 1975, Plat Records, Tarrant County, Texas, more fully and completely described in Exhibit A", and as depicted on the approved Site Exhibit attached hereto and incorporated herein as Exhibit `B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the Case No. Attachment F ZA07-095 Page 1 restrictions set forth herein. The following specific requirements and special conditions shall be applicable to the granting of this Specific Use Permit: Specific Use Permit to allow a tent for the purpose of promoting retail sales at American Backyard granting permission for two 20' x 40' tents; changing the dates to August 30 September 10, 9:00 a.m. — 9:00 p.m. Monday through Saturday and 11:00 a.m. — 6:00 p.m. on Sunday; the banner will be maximum 3' x 8% allowing the reduction in parking spaces by 30 spaces; subject to the Planning and Zoning Commission's recommendation; and noting the applicant has agreed that all inventory and sales items will be confined to the areas under the tent and there will be nothing on the sidewalk areas. SECTION 2. This resolution shall become effective on the date of approval by the City Council. PASSED AND APPROVED THIS 21s' DAY OF AUGUST • 2007. Case No. ZA07-095 Attachment F Page 3 EXHIBIT "B" AMERICAN RACKYAR Annually, American Backyard conducts an end of season tent sale at all of its locations, offering Southlake consumers quality outdoor furniture and spas at clearance pricing_ Additionally, it will provide past customers a unique opportunity to add to their purchases at end of year prices. This popular event provides a significant boost to the local economy, generating measurable incremental sales tax eligible revenue during the six day event. Additionally, this event attracts shoppers from throughout the Metroplex to surrounding businesses through aggressive advertising and promotion. American Backyard will contract with a local Tarrant County certified event specialist for the tents. We will station two tents measuring 20' x 40' each in our parking lot. The tents will be installed by the certified specialists to ensure structural stability, and will be positioned in the parking area located directly in front of the store as illustrated in the planning submittal. All merchandise will be restricted to the area occupied by the tents. Any merchandise displayed on the storefront patio will offer egress, regress to all pedestrian lanes, and adhere to all safety codes for the city of Southlake. Tent signage will be securely fastened and will reflect the type of event only. No other signage will be erected. Eagle Protection will provide security during the event. Eagle Protection has supported American Backyard in its last five events. Security will arrive at 2100 hrs and depart at 0900 hrs the following morning. An American Backyard representative will be present at the location at all other hours during the event. The tent sale will run for two weeks starting August 30 thru September 12. Hours of operation are from 0900 hrs to 2100 hrs Monday thru Saturday and Sunday from 1100 hrs to 1800 hrs. The contractor will install the tent on August 29 and will provide a safety certificate upon request. Upon approval from the City of Southlake, American Backyard will begin moving furniture to the location. All furniture and spas will be clearly marked with sale tags. Examples are enclosed with this proposal. American Backyard will discard excess trash through our usual contracted service provider, which will be arranged with greater frequency as required. American Backyard will remove all merchandise at 1600 his on September 10 and conclude on September 12. September IP will conclude the event, at which time the tent will be removed from the premises. All signage will be removed and the storefront will be restored to its normal presentation. With the support of the City of Southlake, our 2006 tent sale was a very successful event. We are proud of the professionalism with which it was conducted, and we are committed to ensuring an equally successful and productive event this year. We anticipate a positive response to this request, and look to the future for continued success conducting events of this nature in our Southlake home. The City's continued support is appreciated.
