2007-011OFFICIAL RECORD 1_:7 3Y1111i11 I [1]r;K[1X1kff17f1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR TELECOMMUNICATIONS TOWERS, ANTENNAS, AND ANCILLARY BUILDINGS ON PROPERTY WITHIN THE CITY OF SOUTHLAKE, TEXAS, BEING LEGALLY DESCRIBED AS LOT 2112, H. MEDLIN NO. 1038 ADDITION, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED CONCEPT PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for telecommunications towers, antennas, and ancillary buildings has been requested by a person or corporation having a proprietary interest in the property zoned as "S-P-1" Detailed Site Plan District; and, WHEREAS, in accordance with the requirements of Section 45.1 (31) and Section 45.8 of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof, and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted for telecommunications towers, antennas, and ancillary buildings on the property being legally described as Lot 2R2, H. Medlin No. 103 8 Addition, an addition to the City of Southlake, Tarrant County, Texas, according to the plat recorded in Cabinet A, Slides 7276 & 7277, Plat Records, Tarrant County, Texas, more fully and completely described in Exhibit "A", and as depicted on the approved Concept Plan attached hereto and incorporated herein as Exhibit `B" and providing an effective Page 1 date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and special conditions shall be applicable to the granting of this Specific Use Permit: 1. Granting the requested variance waiving the requirement that a telecommunication tower must be 1) used by two or more wireless telecommunications providers; or 2) designed and built so as to be capable of use by two or more wireless telecommunications providers; 2. Noting the applicant's statement that he only needs one lightening rod; 3. Subject to following comments in Site Plan Review Summary No. 4, dated February 16, 2007: a. Identify the parking space to be used by the site. Staff recommends using one of the existing spaces within the site. SECTION 2. This resolution shall become effective on the date of approval by the City Council. PASSED AND APPROVED THIS 6TH DAY OF MARCH, 2007. January H, 2007 Ben Bryner City of Southlake Planning Department RE: Verizon Wireless Request ZA06-133 Dear Mr. Bryner: Verizon Wireless has no plans to construct a tower at the site of this Specific Use Permit request_ Our plans clearly indicate that we plan to locate antennas in a cupola on the existing office building. We have a lease agreement to use the building for the antennas. We will replace the cupola on the building with one that will look just like the existing cupola. Verizon Wireless will construct this unique installation that will not be seen by the public. The stealth installation will be just that. It will be unseen and function just as an antenna atray on a stand alone tower. The site will not be as efficient as one located at a higher elevation on a tower. Since the installation will be in a cupola there will be no opportunity to collocate other antennae in the same cupola. We are prepared to explain this to the Planning and Zoning Commission and to the City Council. If the staff feels that it should recommend against this request because we are not able to guarantee collocation of other antennae at this site then we will be prepared to explain why this is not possible given the limitations of locating antennae in a cupola on a roof. Attached are propagation maps for this site, We provided earlier maps for this site at the times that we filed for antenna sites at Carroll High School.
