RESOLUTION NO. 06-072 OFFICIAL. RECORD A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR TELECOMMUNICATIONS TOWERS, ANTENNAS, AND ANCILLARY BUILDINGS ON PROPERTY WITHIN THE CITY OF SOUTHLAKE, TEXAS, BEING LEGALLY DESCRIBED AS LOT 3R5, BLOCK 1, MIRON ADDITION, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED CONCEPT PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for telecommunications towers, antennas, and ancillary buildings has been requested by a person or corporation having a proprietary interest in the property zoned as `B-1" Business Service Park District; and, WHEREAS, in accordance with the requirements of Section 45.1(31) and Section 45.8 of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted for telecommunications towers, antennas, and ancillary buildings on the property being legally described as Lot 3R5, Block 1, Miron Addition, an addition to the City of Southlake, Tarrant County, Texas, according to the plat recorded in Cabinet A, Slide 3 90 1, Plat Records, Tarrant County, Texas, more fully and completely described in Exhibit "A", and as depicted on the approved Concept Plan attached hereto and incorporated herein as Exhibit `B" and providing an effective date, subject Page 1 to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and special conditions shall be applicable to the granting of this Specific Use Permit: 1. Granting the requested variance to number of buildings allowing the total to be 1 equipment building and 5 cabinets at the facility; 2. Subject to the applicant constructing a stone or brick masonry wall 8 -feet in height on the front and sides of the facility; 3. Requiring immediate irrigation of the property that lies south of a line that is 25 feet north of the northerly fence; 4. Requiring that the irrigation not be battery -powered and will be typical irrigation; 5. Requiring replacement of the three dead trees at the back of the facility with a similar caliper tree; 6. Requiring that the gates to be installed will be a metal gate painted to blend with the brick or stone similar to those at the trash dumpsters at Southlake Town Square; 7. Stating that if the applicant has not applied for a re -plat of the property within 60 days, the applicant agrees to irrigate the entire lot; 8. Requiring all conditions to be tied to this particular Specific Use Permit; 9. Subject to the comments from Concept Plan Review Summary No. 4, dated November 3, 2006. Page 2 SECTION 2. Page 4 LETTER OF INTENT and VARIANCE REQUEST METRO PCS 340 Miron Drive Case ZA06-058 (MetroPCS #DFW 392) MetroPCS Communications, Inc. a provider of wireless communications services. It's corporate headquarters is located in Dallas, Texas. MetroPCS holds 23 licenses through its subsidiaries in the greater Miami, Tampa, Sarasota, Atlanta, San Francisco, Dallas/Fort Worth, Detroit and Sacramento metropolitan areas. MetroPCS has more than two million subscribers and offers customers flat rate plans with unlimited anytime local and domestic long distance minutes with no contract. MetroPCS is among the first wireless operators to deploy an all-digital network based on third generation infrastructure and handsets. MetroPCS initially launched service in 2002 in the Atlanta, South Florida, Sacramento and San Francisco areas. In 2004, MetroPCS acquired licenses for the greater Tampa/Sarasota area and has now expanded its Florida footprint from South Florida into the Central Florida region. MetroPCS will be launching additional markets in DFW in March 2006 and Detroit April 2006. With regard to ordinance specifics, we are respectfully requesting variances to the following items: No more than 3 equipment buildings are located on the lot. We are requesting a variance to the rule due to the fact that there are over 3 carriers collocated on this tower and in order to make the equipment function, equipment for radios and batteries need to be sited here. This collocation prevents the need for another tower in this immediate vicinity, which supports the vision of lessening telecommunications towers in Southlake. Provide solid masonry screening and landscaping... MetroPCS is proposing to maintain existing landscaping. As the next collocation provider at this site it is Metro's intent to maintain any landscaping which is there and perhaps add to if need be. We will assist the property owners in maintaining the existing landscaping, however. Due to the existing nature of the site and surrounding conditions, we are requesting a waiver (variance) from landscaping and screening because of the existing treeline to the south, and the setback from the public roadway to the north and surrounding screening.
