2006-034RESOLUTION NO. 06-034 OFFICIAL RECORD A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR THE SALE OF ALCOHOLIC BEVERAGES ON PROPERTY WITHIN THE CITY OF SOUTHLAKE, TEXAS, LOCATED AT 621 E. SOUTHLAKE BOULEVARD, SUITE A, BEING LEGALLY DESCRIBED AS A PORTION OF LOT 3R, BLOCK 60, TIMARRON ADDITION PHASE 5, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED SITE PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for the sale of alcoholic beverages has been requested by a person or corporation having a proprietary interest in the property zoned as "R -PUD" Residential Planned Unit Development District; and, WHEREAS, in accordance with the requirements of Sections 45.1 (1) and 45.6 of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted for the sale of alcoholic beverages on the property located at 621 E. Southlake Boulevard, Suite A, being legally described as a portion of Lot 3R, Block 60, Timarron Addition Phase 5, an addition to the City of Southlake, Tarrant County, Texas, as recorded in Cabinet A, Slide 4395, Plat Records, Tarrant County, Texas, more fully and completely described in Exhibit "A", and as depicted on the approved site plan attached hereto and incorporated herein as Exhibit `B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions Page 1 set forth herein. The following specific requirements and special conditions, if any, shall be applicable to the granting of this Specific Use Permit: 1. Approved subject to the terms of the existing lease which expires October 31, 2010. This resolution shall become effective on the date of approval by the City Council. Russ Martin, a Southlake resident, is Dallas/Fort Worth's number one drive time radio personality. He's pleased to introduce his new dining and entertainment experience to the City of Southlake Planning & Zoning Commission. Russ Martin's Bar & Grill provides a combination of great food, delicious beverages and fine wines designed to accommodate the sophisticated, high end clientele who reside in the area and provide outstanding service to the community of Southlake, Mr Martin founded the Russ Martin Show Listeners Foundation in November of 2001 The RMSLF is a non-profit organization which provides financial assistance to families of D/FW police officers and firefighters who have courageously fallen in the line of duty, The foundation immediately issues a check for $25,000 to provide immediate assistance to the families of those who have selflessly surrendered their lives serving the citizens in the D/FW area Additionally, Mr_ Martin is well known for his charitable efforts and supports numerous local charities, including acting on the board of advisors for "Operation Kindness", a local "no kill" animal shelter.. A portion of the profits generated by the restaurant will be donated to the Russ Martin Show Listeners Foundation The restaurant will be operated by Don Nedler & the Coconuts Restaurant Group G.P., Inc_ Mr, Nedler is a well respected operator with over 25 years of experience in the DFW area. Current and previous ventures include Dallas' world famous Lizard Lounge, The Velvet Elvis, and Coconuts Island Grill. Additionally, Mr. 'Nedler was recently appointed by Mayor Laura Miller to the Deep Ellum re -development task force in Dallas and is involved with many community projects. He was instrumental in providing funding for the "Bark Park", downtown Dallas' community Dog Park. Mr. Nedler's resume of experience and references are included with this SUP application. Renowned architect and designer John Wheeler created the floor plan and design We intend to utilize the existing entry and kitchen area. No changes to the interior or exterior design are anticipated. A floor plan is included in this package for representative purposes only The restaurant will be open for lunch daily at l 1 am. A wide selection of non-alcoholic beverages will also be available. The menu is attached to this SUP application. Russ Martins Bar & Grill is proudly endorsed by several local police and firefighter associations and pleased to offer a taste of the "Russ Martin Experience" to the citizens of Southlake.
