A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR
TELECOMMUNICATIONS TOWERS, ANTENNAS, AND
ANCILLARY BUILDINGS ON PROPERTY WITHIN THE CITY OF
SOUTHLAKE, TEXAS, BEING LEGALLY DESCRIBED AS LOT 1,
BLOCK A, OIEN ADDITION, MORE FULLY AND COMPLETELY
DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE
APPROVED CONCEPT PLAN ATTACHED HERETO AND
INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, a Specific Use Permit for telecommunications towers, antennas, and ancillary buildings
has been requested by a person or corporation having a proprietary interest in the property zoned as "CS"
Community Service District; and,
WHEREAS, in accordance with the requirements of Section 45.1 (3 1) and Section 45.8 of the City's
Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the
requisite notices by publication and otherwise, and have afforded the persons interested and situated in the
affected area and in the vicinity thereof; and,
WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use
Permit is in the best interest of the public health, safety, morals and general welfare of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION 1.
A Specific Use Permit is hereby granted for the telecommunications towers, antennas, and ancillary
buildings on the property being legally described as Lot 1, Block A, Oien Addition, an addition to the City of
Southlake, Tarrant County, Texas, according to the plat recorded in Volume 388-218, Page 14, Plat Records,
Tarrant County, Texas, more fully and completely described in Exhibit "A", and as depicted on the approved
Concept Plan attached hereto and incorporated herein as Exhibit `B" and providing an effective date, subject
to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The

following specific requirements and special conditions shall be applicable to the granting of this Specific Use
Permit:
Granting the requested variance to allow more than three equipment structures on the site;
2. Contingent to the screening described in the previous approval for case ZA03-089, "...requiring
installation of an opaque screening material on the entry gates and requiring an evergreen screening
material such as a holly and not red -tipped photinias";
3. Noting the applicant's agreement to relocate the Elaeagnus plants along the north and east property
lines to the south and west property lines;
4. Noting the applicant's agreement to plant Nellie R. Stevens Hollies at a 6 to 8 foot planting height at
five foot centers on the north and east property lines with four additional hollies wrapping around the
southeast corner and working with the city's landscape staff to consider staggering those plants;
Assuring the planting areas are irrigated;
6. Requiring the replacement of the dead plants along the White Chapel Boulevard frontage;
7. Subject to the following conditions of the Concept Plan Review Summary No. 2, dated December 2,
2005:
a. Provide a written scale in close proximity to the north arrow and graphic scales.
b. Label the height of all fences, and screening devices.
C. Provide dimensions for all proposed improvements on the architectural elevation plans. The
heights of the proposed dishes do not match between pages A-1 & A-2.
SECTION 2.
This resolution shall become effective on the date of approval by the City Council.
PASSED AND APPROVED THIS 17TH DAY OF JANUARY, 2006.

XM Satellite Radio Inc. is proposing to install digital simulcast broadcast equipment on the existing
freestanding communication tower referenced above. This proposed collocation requires a specific use
permit.
We have made all the changes requested in the Concept Plan Review Summary and therefore respectfully
request for formal consideration by the Planning and Zoning Commission. In accordance with the site
plan submitted today, we respectfully request a variance to install one cabinet enclosure with dimensions
of 57.2" height, 36.7" length, 31.5" width within the existing fenced compound. The maximum number
of equipment buildings allowed on a single lot is three. Currently, there are 5 equipment buildings and 2
cabinets at this telecommunications facility. The proposed cabinet should not be considered an equipment
building because it is not a walk-in shelter.
The telecommunications tower facility landscaping is in accordance with Section 45.8 on the Zoning
Ordinance.
